HomeMy WebLinkAbout07-11-60 Council Meeting MinutesREGULAR MEETING JULY 11, 1960 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, City Hall, Monday, July 11, 1960, at 8:18 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. PETITION Petition of Meyer and Ruth Steinberg to rezone land at 1323 North Ironwood Drive. Committee Councilman Lehman seconded the Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Ladewski seconded the motion. Motion carried. PETITION Petition of Cecil Daniels, et al, to rezone land located at 2806 Lincolnway West. Councilman Lehman made a motion that the petition be referred to the City Planning Commission. Councilman Krueper seconded the motion. Motion carried. DEPARTMENTAL REPORTS REPORT OF BOARD OF HEALTH City Clerk City Ball July $, 1960 South Bend, Indiana Re: Complaint received at Council Meeting of June 27, 1960 s Please be advised that an investigation was made on July 7, 1960 regarding the weeds at Harris and Nord Streets; same has been cut:and cleared, also, the weeds have been cut at the East Indiana Avenue and the Meade Street right of way of the New York Central Railroad. Carter, Heallth Officer na:yua.nic c�utlLVV JULY 11, LVOV Councilman Muszynski commended the Health Vepartment on their promptness in complying with the request of the Council to direct the New York Central Railroad to cut weeds at the Ford and Harris intersections. Councilman Mus- zynski then made a motion that the report be accepted and placed on file. Councilman Ladewski seconded the motion. Motion carried. (REPORT OF TRAFFIC ENGINEER Members of the Common Council South Bend, Indiana Gentlemen: July 11, 1960 Re: Petition to State Highway Department to install traffic signals at the intersection of Sample and Mayflower Road At the request of this department, another traffic ount and survey was made at Sample Street (SR 223) and Mayflower Road (SR 123) on June 13, 1960. I received a report from Mr. E. M. Davis, Traffic Engineer for the LaPorte District of the Indiana State Highway Department, in which he stated that using rural warrants, which are lower than urban warrants, there is not justifi- cation for the installation of traffic signals at this intersection. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY City Attorney Irving J. Smith, made the following oral report for the Board of Public Works and Safety: Mr. Smith stated that he wished to advise the Council that the Board of Public Works and Safety in their regular meeting directed the Street Department Commissioner that the first item of business when they returned to work on Monday morning will be the oiling of West Washington Street. This is appropo of the direction of the Council last meeting when they promised to aleviate conditions on West Washington Street. Councilman Tellson made a motion that the report be accepted. Councilman Muszynski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN GENERAL FUND $14,662.26 AND STREET AND TRAFFIC FUND $1,200.00, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. ORDINANCE NO. 4325 - - -60 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN CITY PLAN COMMISSION FUND $975.00 The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: July 11, 1960 The attached petition of Armelda Baker, et al, to rezone Lot Numbered Four (4) as shown on the recorded Plat of Anthony's Addition to the City of South Bend, Indiana, generally described as 355 Logal Street, from "A" Residential Use District to "C" Commercial Use District was legally advertised on June 25, 1960 and given public hearing under date of July 7, 1960. The following action was taken: After due consideration the Commission found that the proposed zoning would result in a continuation of strip zoning and that it was not in keeping with the general character of the area. It was therefore duly moved, seconded and unanimously carried that the petition be recommended unfavorably to the Common Council. HB /mah Attach. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana July 11, 1960 Gentlemen: The attached petition of John VanVynckt, et al, to rezone Lots Numbered 79, 80, and 81 in the recorded Plat of Belmont Addition to the City of South Bend, Indiana, generally described as the northwest corner of Jefferson Boulevard and 36th Street, from "A" Residential Use to "C -1" Commercial Use and "A" Height and Area District was legally advertised on June 25, 1960 and given public hearing under date of July 7, 1960. The following action was taken. After due consideration the Commission found that the proposed zoning would tend to be an encroachment of commercial use on residential areas and that it was not in keeping with the general character of the existing residential development. It was therefore duly moved, seconded and carried that the petition be recommended unfavorably to the Common Council. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: July 11, 1960 The attached petition of Irene Stanz and the North Side Lumber Company, Inc., to rezone the property generally described as having a 177 foot frontage on Jefferson Boulevard and 148 foot frontage on Thirty- Second Street from "A" Residential Use and "A: Height and Area District to "B" Residential Use and "C" Height and Area District was legally advertised under date of June 25, 1960 and given public hearing on July 7, 1960. The following action was taken: After due consideration the Commission found that the proposed zoning would result in spot zoning. It was therefore duly moved, seconded and unanimously carried that the petition be recommended unfavorably to the Common Council. COMMUNICATION FROM MAYOR VOORDE To the Common Council of the City of South Bend, Indiana: I, the undersigned, Edward F. Voorde, Mayor of the City of South Bend, Indiana, as required by Chapter 107 of the Ac of 1959, hereby fix the maximum salaries for the herein named appointed officers and.employees of the City of South Bend, Indiana, beginning January 1, 1961, and continuing thereafter until ,duly changed, and request that such maxi- mum salaries be approved by the Common Council. /s/ Edward F. ORDINANCE AN ORDINANCE FIXING MAXIMUM SALARIES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1961 The Ordinance was given first reading by title and second reading in full. Councilman Lehman made a motion that the Ordinance be set for public hearing on July 25, 1960. Councilman Tellson seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE 4148 WHICH AMENDED ORDINANCE 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND (335 Logan Street) The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that the Ordinatiee:.be set for public hearing on August 8, 1960. Councilman Krueper seconded the motion. Motion carried. ORDINANCE NO. 4326 - - -60 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (East Jefferson at 36th Street) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702 ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14th DAY OF JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Corner of East Jefferson and Thirty- second Street) The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that the Ordinance be set for public hearing on August 8, 1960. Councilman Allen seconded the motion. Motion carried. MEMORANDUM TO: Members of the Common Council, City of South Bend From: Henry Sucher, Executive Director South Bend Redevelopment Commission Date: July 7, 1960 Re: General Neighborhood Renewal Plan - Application for Linden School Area The resolution submitted for your approval authorizes the Redevelopment Department to request a federal advance for planning funds. This money will be used to make a comprehensive study of the Linden School Area to determine the Renewal treatment most suitable for various parts of the area. The federal funds used will be considered part of the costs of the first actual project undertaken within the Linden School area, to be borne two - thirds by the federal government, one -third by the City. The advantage of following this "General Neighborhood Renewal Plan" procedure lies in the maximum credit the City can thereby receive for the funds spent by the School City in building a new school. The City does commit itself to undertake all necessary measures to eliminate blight from the entire area over a ten year period. The first project will be a clearance area of approximately forty acres, to be followed by rehabilitation and code enforceme$t through the remaining 120 acres of the area. RESOLUTION RESOLUTION OF COMMON COUNCIL OF SOUTH BEND, INDIANA APPROVING UNDERTAKING OF GENERAL NEIGHBORHOOD RENEWAL PLAN AND FILING OF APPLICATION FOR FEDERAL ADVANCE OF FUNDS. WHEREAS, under Title I of the Housing Act of 1949, as amended, the Housing and Home Finance Administrator is authorized to extend financial assistance to localities in the elimination and prevention of the spread of their slums and urban blight through the planning and undertaking of urban renewal projects; and WHEREAS, under Section 102 (d) of said Title I, the Housing and Home Finance Administrator may make advanc of funds for the preparation of General Neighborhood Renewal Plans for urban renewal areas of such scope that the urban renewal activities therein may have to be carried out in stages over a period of not more than ten (10) years; and WHEREAS, it is desirable and in the public interest that the City of South Bend, Department of Redevelopme prepare such a General Neighborhood Renewal Plan, presently estimated to cost Six Thousand, Seven Hundred and Thirty Dollars ($6,730) in that certain area, proposed as an Urban Renewal Area, situated in the City of South Bend, County of St. Joseph, and State of Indiana, and described as follows: New York Central Railroad and Washington Avenue on the South, Walnut Street and City Cemetery on the East, Lincolnway West, Fassnacht Avenue and Kenwood Avenue on the North, and Olive Street on the West. NOW, THEREFORE, BE IT RESOLVED by the Common Council, City of South Bend, Indiana as follows: 1. That the proposed Urban Renewal Area described above is an'area of such scope that it is estimated that ij the urban renewal activities therein may have to carried out in stages over a period of not more than ten (10) years. 2. That the undertaking by the City of South Bend, Department of Redevelopment of the preparation of a General Neighborhood Renewal Plan for the proposed Urban Renewal Area described above is hereby approved. 3. That it is cognizant of the intention of the City of South Bend, Department of Redevelopment to under -. take an urban renewal project promptly upon completion of the General Neighborhood Renewal Plan and the preparation of an urban renewal plan for such project, which project shall embrace at least ten (10) percent of the Urban Renewal Area and shall be of the character contemplated by Section 110 (c) of said Title I. 4. That it is cognizant of the conditions that are imposed in the undertakipg and carrying out of urban renewal projects with Federal assistance under Title I, including the requirements that a General Neighborhood Renewal Plan conform to the Workable Program of the community, as set forth in Section 101 (c) of Title I, and to a general plan of the locality as a whole, as well as those requiring a feasible method of relocation and the provision of necessary local grants-in-aid. I S. That it is the intention of this body that the General Neighborhood Renewal Plan will be used to the fullest extent feasible as a guide for the provision of public improvements in such Area and that the Plan will be considered in formulating codes and other regulatory measures affecting property in the Area and in undertaking other local governmental activities pertaining to the development, redevelopment, rehabilitation, and conservation of the Area. 6. That the filing of an application by City of South Bend, Department of Redevelopment for an advance of funds from the United States in an amount not to exceed Six Thousand, Seven Hundred and Thirty Dollars ($6,730) for the preparation of a General Neighborhood Renewal Plan for the Urban Renewal Area described herein is hereby approved /s/ Chester Muszynski Member of the Common Council Councilman Muszynski made a motion for Adoption of the Resolution. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 8 ayes, 1 nay (Councilman Glass). Resolution Adopted. OLD BUSINESS Councilman Tellson made a motion that the New Jersey Railroad be contacted to repair their Prairie and Remble crossing. NEW BUSINESS Councilman Lehman made a motion, seconded by Councilman Allen, that the.general address be included on-petitions for rezoning or annexation. Motion carried. Councilman Coleman requested that a copy of each petition for rezoning and annexation filed in the Clerk's Office be sent to the Councilmen before the next regular meeting. This request was referred to the Ordinance Committee to determine whether an Ordinance was required to change the procedure. There being no further business to come before the Council, Councilman Muszynski made a motion to adjourn. Councilmani Tellson seconded the motion.
