HomeMy WebLinkAbout06-13-90 Council Meeting MinutesC] REGULAR MEETING JUNE 23, 1960 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the-.Council Chambers, City Hall, on Monday, June 13, 1960, at 9:22 P.M., with all members present. The meeting was called to order by Joseph T. Kroll, President, who presided. ROLL CALL PRESENT: Councilmen Kroll, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Allen seconded the motion. Motion carried. PETITIONS Petition of Charles E. Stickler, et al to rezone 2.3 acres of land at 2254 Portage Avenue. Councilman Coleman made a motion that the petition be referred to the City Planning Commission. Councilman Allen seconded the motion. Motion carried. Petition of Armelda Baker, et al to rezone land at Logan Street North of Jefferson. Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Allen seconded the motion. Motion carried. Petition of Irene Stanz, et al, to rezone land on East Jefferson Boulevard. Councilman Allen made a motion that the petition be referred to the City Planning Commission. Councilman Ladewski seconded the motion. Motion carried. Petition to annex 100.7 acres of land to the City of South Bend (Ireland and Miami) Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. REPORT OF ORDINANCE COMMITTEE To the Common Council of the City of South Bend: Your Committee on Ordinances, to whom was referred AN ORDINANCE TO AMEND AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING THE SUM OF ONE MILLION DOLLARS ($1,000,000.00) TO BE APPLIED TO THE COST OF CONSTRUCTION, RE- CONSTRUCTION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH, KNOWN AS ORDINANCE NO. 4305, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED AS FAVORABLE AND RECOMMEND ITS PASSAGE. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE TO REGULATE THE BUSINESS OF INSTALLING AND SERVICING TELEVISION EQUIPMENT IN THE CITY OF SOUTH BEND; TO PROVIDE FOR THE ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE; AND TO PROVIDE A PENALTY FOR THE VIOLATION OF THE TERMS THEREOF, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REFERRED TO THE ORDINANCE COMMITTEE WHO WILL REFER IT TO THE LEGAL DEPARTMENT. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: June 8, 1960 The attached petition of Joseph Lee to rezone Lot Numbered One Hundred Twenty (120) in,Hartman and Miller's Addi- tion to the City of South Bend, Indiana, commonly known as 1215 South Bend Avenue, from "B" Residential Use to "C" Commercial Use was legally advertised on May 23, 1960 and given public hearing under date of June 2, 1960. The following action was taken: After due consideration the Commission found that the proposed zoning would result in spot zoning. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended unfavorably to the Common Council. RLH /mah Attach. Motion carried. r.nvu1JC A ru.L+l liNv _ REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: June 8, 1960 The attached petition of Jerome A Osborne to rezone Lots 17 and 18 of the Roseland Park Addition, commonly known as 1849 and 1853 East Randolph Street, from "B" Residential Use to "C" Commercial Use was. legally advertised on May 23, 1960 and given public hearing under date.of June 2, 1960. The following action was taken: After due consideration the Commission found that the general character of the neighborhood is residential and that the proposed zone change would result in spot zoning. COMMUNICATION TO CITY PLAN COMMISSION Mr. Robert L. Huff Director - Secretary City Planning Commission City Hall South Bend, Indiana Dear Mr. Huff: June 1, 1960 IN RE: Petition of Clarence W. and Martha Dockery for rezoning - Hearing before City Plan Commission June 2, 1960 Because of certain information which is not available at this time, our clients, Clarence W. and Martha Dockery, have decided to withdraw their petition as filed by them and -as now set for hearing on June 2, 1960, before the City Plan Commission of the City of South Bend, On ?theit "tehhlf;"thepefore, we now request that the petition of Clarence W. and Martha Dockery be withdrawn and that no hearing be had on the same at the - public hearing before the City Plan Commission on June 2, 1960. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (REAL ESTATE INVOLVED LOCATED AT 1215 SOUTH BEND AVENUE) The Ordinance was given first reading by title and second reading in full. Councilman Ladewski made a motion that the Ordinance be set for public hearing on June 27, 1960. Councilman Allen seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SOUTH BEND - ST. JOSEPH COUNTY BUILDING AUTHORITY, $13,500.00 The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that the Ordinance be set for Public Hearing on June 27, 1960. Councilman Allen seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AUTHORIZING THE ALIENATION AND CONVEYANCE OF CERTAIN REAL PROPERTY BELONGING TO THE CITY OF SOUTH BEND The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion for sus- pension of rules. Upon roll call, the motion was lost. Councilman Lehman made a motion that the Ordinance be set for Public Hearing on June 27, 1960. Councilman Glass seconded the motion. Motion carried. OLD BUSINESS Mr. Raymond Andrysiak, City Engineer reported on test borings that were made on West Washington. He explained the results of the borings to the Council. He; then f iled the following report: ". MEMO TO: Mrs. Freda Noble June'13, 1960 SUBJECT: Test Soil Boardings made on West Washington Street from Kaley Street to Sheridan Avenue There were 17 such tests made a they showed varying depths of undesirable soil,.therefore, considerable excavation REGULAR MEETING, JUNE 13, 1960 217 would have to be made before a street of top quality could be built in this area. When taking the excavation item into consideration the cost of such a street would run well over $150,000.00. /s/ R. S. Andrysiak (me) R. S. OLD BUSINESS Councilman Allen made a motion that the Grievance Committee of the Council make an examination of the premises of the Beth Steel Company on West Dunham Street and make a report to the Council at the next meeting. There bsing no further business to come before the Council, Councilman Lehman made a motion to adjourn. Councilman Muszynski seconded the motion.
