The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Glass, Krueper, Lehman and Muszynski. ABSENT: Councilman Coleman. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Lehman seconded the motion. Motion carried. PETITION Petition of Marjorie Drinski to rezone land at Portage, Navarre and William Street. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Krueper seconded the motion. Motion carried. PETITION Councilman. Allen filed a petition bearing eleven signatures requesting improvement of the end of the alley on Howard Street from Lawrence Street to Hill Street by street lighting. Councilman Tellson made a motion that the petition be referred to the Board of Public Works and Safety for Action. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition containing 494 signatures requesting a traffic light at Mayflower and Sample Streets. Councilman Muszynski made a motion, seconded by Councilman Lehman, that the petition be referred to the Board of Public Works and Safety for action. Motion carried. REPORT OF TIE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED (Place and Company to zone recently annexed land), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. ORDINANCE NO. 4311 - - -60 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Miami and Ireland Road- -Place and Company) The Ordinance was given third reading and passed by a roll call vote of S ayes, 0 nays, 1 absent (Councilman Coleman). ORDINANCE NO. 4312 - - -60. AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN 1959 GENERAL STREET IMPROVEMENT FUND $3,500.00 The Ordinance was given third reading and passed by a roll call vote of B ayes, 0 nays, 1 absent (Councilman Coleman). ORDINANCE NO. 4313 - - -60 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN FIRE DEPARTMENT $1,200.00 AND CONTROLLER'S OFFICE $700.00 The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Coleman). REPORT OF THE CITY PLANNING COMMISSION AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (Approximately 48 acres adjacent to the Airport) The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: April 11, 1960 The attached petition of Alice F and Robert C. Barton, et al, to annex to the City of South Bend, Indiana the South one -half of the South one -half of the NEk of Sec. No. 33, T38N, R2E; together with a parcel of reality commenc- ing on the East line of Sec. No. 33 in T3EN, R2E, at a point 660 feet North of the Southeast corner of the NEk of said Sec. No. 33; thence West a distance of 1320.60 feet to the Southwest corner of the North one -half of the Southeast quarter of the NE4 of said Sec. No. 33; thence North 261.56 feet; thence East 1320.67 feet to a point on the East line of Said Sec. No. 33 which is 275.65 feet North of the place of beginning; thence South 275.63 feet to the place of beginning, consisting of approximately 48 acres, more or less, being generally described as being West of Maple Road, East of Sheridan Avenue, and North of the present city limits was legally advertised on March 28, 1960 and given public hearing under date of April 7, 1960. The following action was taken: After due consideration the Commission found that: 1. The annexation is in the best interests of the city and of the territory sought to be annexed. 2. The area is urban in character, being an economic and social part of the annexing city, 3. The city is financially able to provide municipal services to the annexed area within the reasonably near future. 4. The area sought to be annexed is needed for development of the city in the reasonably near future. 5. The lines of the annexation are so drawn as to form a compact area abutting the municipality. ORDINANCE NO. 4314 - - -60 AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (Approximately 43 acres adjacent to the Airport) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of the rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays 1 absent (Councilman Coleman). The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Coleman). ORDINANCE, FIRST AND SECOND READING AN ORDINANCE PROVIDING FOR THE PROTECTION OF POLICE REPORTING SYSTEM AND PROHIBITING THE USE OF SAID REPORTING SYSTEM FOR ANY PURPOSES OTHER THAN MATTERS PERTAINING TO POLICE OR FIREMEN. The Ordinance was given first reading by title and.second reading in full. Councilman Muszynski made a motion that the ordinance be set for public hearing at the next regular meeting of the Council. Councilman Lehman seconded the Motion.— carried. ORDINANCE' AN ORDINANCE TO REGULATE THE BUSINESS OF INSTALLING AND SERVICING TELEVISION EQUIPMENT IN THE CITY OF SOUTH BEND; TO PROVIDE FOR THE ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE; AND TO PROVIDE A PENALTY FOR THE VIOLATION OF THE TERMS THEREOF The Ordinance was given first reading by title. Councilman Lehman moved that the Ordinance be referred to the Com- mittee of the Whole and have second and third reading at its public hearing. Councilman Muszynski seconded the motion. Motion carried. A RESOLUTION APPROVING A FORM OF CONTRACT AMENDING THE COOPERATION AGREEMENT OF . SEPTEMBER 11, 195611 AS AMENDED MAY 15, 1957 and AUGUST 13, 1959, BETWEEN THE CITY OF SOUTH BEND, INDIANA, AND THE HOUSING AUTHORITY OF THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana, has heretofore entered into a Cooperation Agreement with The Housing Authority of the City of South Bend, Indiana, which said Cooperation Agreement dated September 11, 1956, was amended by Amendatory Contracts dated May 15, 1957, and August 13, 1959, and it has now become desirable to further amend said Cooperation Agreement; NOW, 'THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, That the Cooperation Agreement dated September 11, 1956, as amended May 15, 1957 and August 13, 1959, between the City of South Bend, Indiana, and The Housing Authority of the City of South Bend, Indiana, be and the same is hereby further amended as follows: Sub - section (a) of Section 1 of said Cooperation Agreement dated September 11, 1956, as amended, shall read as follows: "(A) The term 'Project' shall mean any low -rent housing not in excess of Six Hundred (600) units hereafter developed as an entity by the Local Authority with financial assistance by the Public Housing Administration." FURTHER RESOLVED, That the proper officers of the City of South Bend, Indiana, are hereby authorized and in- structed to execute the agreement, a copy of which is attached hereto. Voorde, Mayor of the City of South Bend, Indiana AMENDMENT TO COOPERATION AGREEMENT THIS AMENDMENT entered into as of the 11 day of April , 1960, by and between tke City of South Bend, Indiana, (hereinafter called the "Municipality ") and The Housing Authority of the City of South Bend, Indiana, (hereinafter called the "Local Authority, "), WITNESSETH: WHEREAS, the parties - hereto have entered into a Cooperation Agreement dated September 11, 1956, which said Cooperation Agreement was amended by Amendatory Agreements between the parties dated May 15, 1957, and August 13, 1959; and WHEREASm the parties hereto desire to further amend said Cooperation Agreement in the particulars hereinafter set forth: NOW, THEREFORE, the parties hereto do hereby agree that Sub - section (a) of Section 1 of said Cooperation Agreement dated September 11, 1956, as amended May 15, 1957, and August 13, 1959, shall be and it is hereby amended to read as follows: "(a) The term 'Project' shall mean any low -rent housing not in excess of Six Hundred (600) units hereafter developed as an entity by the Local Authority with financial assistance by the Public Housing Administration." Except as amended herein and by said amendments dated May 15, 1957, and August 13, 1959, said Cooperation Agreement dated September 11, 1956, shall, in all other respects, remain and be in full force and effect. Councilman Lehman seconded the motion. Motion carried by a roll call vote of S ayes, 0 nays, 1 absent (Councilman Coleman). OLD BUSINESS Councilman Muszynski suggested that there be a meeting of the Traffic Committee of the Council, the traffic Engineer, and the Olive Street residents, after complaining of excessive truck traffic on Olive Street. REGULAR MEETING NEW BUSINESS APRIL 11, 1960 199 Councilman Tellson stated that there was no unloading zone in front of the New Public Library. After some discussion it was suggested that the Traffic Engineer make a study of the situation and report back to the Council at their next meeting whether or not a loading zone would be recommended. Councilman Muszynski seconded the motion. Motion carried. Councilman Muszynski made a motion that the next regular meeting of the Council be held on Tuesday, April 26, 1960. Councilman Lehman seconded the motion. Motion carried. There being no further business before the Council, Councilman Muszynski made a motion to adjourn. Councilman Lehman seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 10:55 P.M.
