HomeMy WebLinkAbout02-23-60 Council Meeting MinutesREGULAR MEETING FEBRUARY 23, 1960 Be it remembered that the Common Council of the City of South Bend, met in Regular Session ,in the Council Chambers, in,the City Hall, on Monday, February 23, 1960, at E :26 P.M., with all members present. The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervison of the minutes, would respectfully report that they have inspec= ted the minutes of the previous meeting of the Council and found them correct. COMMUNICATION Committee Councilman Lehman seconded the Common Council City of South Bend February 16,1960 City Hall South Bend, Indiana Gentlemen I very much appreciate the honor you have given me by your appointment as a Trustee for the South Bend -St. Josep County Building Authority. COMMUNICATION The following Resolution which was passed by the Civic Planning Association was read by the Clerk. RESOLUTION OF THE SOUTH BEND CIVIC PLANNING ASSN., INC. BE IT RESOLVED that the South Bend Civic Planning Association, Inc., by this resolution adopted by its members respectfully requests that all or as much as needed of the proceeds from the proposed MILLION DOLLAR STREET BOND issue be used to complete the city's share of the East and West Sample Street projects before beginning any other street projects. BE IT FURTHER RESOLVED that this Association requests the South Bend City Council to specify their intentions and plans for the proceeds of the MILLION DOLLAR STREET BOND ISSUE at or before the City Council meeting on Feb- ruary 23, 1960 in order to give taxpayers time to remonstrate if, in their opinion, the announced use of these funds is not acceptable. PETITION TO THE HONORABLE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA GENTLEMEN: WE, THE UNDERSIGNED PROPERTY OWNERS, PETITION THE HONORABLE COMMON COUNCIL OF THE CITY OF SOUTH BEND.FOR THE FOLLOWING CHANGES IN ZONINGS AND HEIGHT AND AREA CLASSIFICATION: Land in Kaley's 2nd Addition ---- Bendix Aviation Corporation by George E. Stoll, Vice President, Petitioner. Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Ladewski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, REPAIR, ALTERATION, LOCATION, OF ALL ELECTRIC SIGNS; LOCATION OF ALL OVERHANGING SIGNS AND ALL TYPES OF ELECTRIFIED SIGNS WITHIN THE CITY OF SOUTH BEND, INDIANA; PROVIDING FOR THE POSTING OF BONDS, LICENSING OF SIGN CONTRACTORS; THE ISSUANCE OF PERMITS AND FEES THEREFORE; AND PROVIDING FOR MINIMUM CONSTRUCTION STANDARDS, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE, AS AMENDED. /s/ T. REPORT OF THE COMMITTEE OF -THE WHOLE To the Common Council of the City of South Bend: J' Your Committee of the Whole, to whom was referred AN ORDNANCE PREVENTING AND REGULATING THE USE OF FIREARMS,1. AND OTHER INSTRUMENTS TENDING TO ENDANGER PERSONS OR PROPERTY WITHIN THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, I Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE kept in Committee of the Whole for further study. The Committee of the Whole and the City Attorney will meet on March 7th to discuss i the Ordinance and draw up an Ordinance to present at meeting of March 14th. February 23, 1960, /s/ T. W. ORDINANCE NO. 4303 - - -60 AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, REPAIR, ALTERATION, LOCATION, OF ALL ELECTRIC SIGNS: LOCATION OF ALL OVERHANGING SIGNS AND ALL TYPES OF ELECTRIFIED SIGNS WITHIN THE CITY OF SOUTH BEND, INDIANA; PROVIDING FOR THE PSOTING OF BONDS, LICENSING OF SIGN CONTRACTORS; THE ISSUA14CE OF PERMITS AND FEES THEREFORE; AND PROVIDING FOR MINIMUM CONSTRUCTION STANDARDS, AS AMENDED. The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: February 23, 1960 185 The attached petition of the Industrial Foundation, Inc., et al, to rezone the No. k of the SE-4 of Sec. 33, T38N, R2E, generally described as lying east of Sheridan Avenue, West of Maple Road and north of Keller Street to the present city limits, except the following parcel, to wit: Commencing at the point of the intersection of the north line of Keller Street with the east line of North Illinois Street, as extended; thence north 400 feet; thence east 1266.25 feet; thence south to the north line of Keller Street to the point of beginning from "A" Residential Use and "A" Height and Area District was legally advertised on February 9, 1960 and given public hearing under date of February 19, 1960. The following action was taken: After due consideration the Commission found that the subject land was not suitable for residential development; that its best use is for Industrial purposes; and that the proposed industrial zoning will be in accordance with the spirit of the Zoning Ordinance. It was therefore duly moved, seconded and unanimously carried that the petition be recommended favorably to the Common Council. RLHJmah Attach. ORDINANCE, FIRST AND SECOND READING ORDINANCE NO. , BEING AN ORDINANCE AMENDING ORDINANCE NO. 3702, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Industrial Foundation, Inc., -- -Maple Road) The Ordinance was given first reading by title and second reading in full. Councilman Coleman made a motion that the Ordinance be set for public hearing on March 14, 1960. Councilman Muszynski seconded the motion. Motion carr ORDINANCE, FIRST AND SECOND READING AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING THE SUM OF ONE MILLION DOLLARS ($1,000,000.00) TO BE APPLIED TO THE COST OF CONSTRUCTION, RE- CONSTRUCTION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on March 14, 1960. Councilman Coleman seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Coleman made a motion to adjourn. Councilman Allen seconded the motion.
