The meeting was called to order by President Joseph T. Kroll, who presided. ROLL CALL ' PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None MINUTES Report of Committee on Minutes To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have inspected th minutes of the previous meeting of the Council and found them correct. Councilman Allen made a motion that the report be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Hartman Builders, Inc., to rezone land at Ryer and Lincolnway West. Councilman Coleman made a motion that the petition be referred to the City Planning Commission. Councilman Krueper seconded the motion. Motion carried. PETITION Petition of Place and Company to zone recently annexed land at Miami and Ireland. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Allen seconded the motion. Motion carried. PETITION Petition of Industrial Foundation, Inc., to rezone land in Northwest Section of City -- -North of Keller Street. Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Lehman seconded the motion. Motion carried. REPORT OF BOARD OF PUBLIC WORKS AND.SAFETY To the Common Council South Bend, Indiana Gentlemen: February 4, 1960 Your directive to the City Attorney to appropriate $900.00 for repairs for painting of the Council Chambers was referred to my office for further information. In my 1960 budget, I have earmarked at this time the sum of $7000.00 in Repairs of Buildings and Structures which I can use part of to do the necessary repairs. REPORT OF ORDINANCE COMMITTEE To the Common Council of South Bend, Indiana: Your Committee on Ordinance, to which was referred Ordinance No. - - -- submits the following report Your Committee met on Monday, February 1, 1960 and after discussion of said ordinance with a representative of the City's Electrical Inspection Bureau recommends that said ordinance be amended as follows: That the following paragraph be designated as Section 19 of said ordinance "Whenever the word approved is mentioned in this ordinance, such word shall mean approval by the Chief Electrical Inspector of the City of South Bend." ly. Councilman Allen made a motion that the Ordinance on Electrical Signs be set for public hearing on Tuesday, February 23, 1960. Councilman Tellson seconded the motion. Motion carried. REPORT OF ORDINANCE COMMITTEE To the Common Council of South Bend, Indiana: Your Committee on Ordinances, To whom was referred Ordinance No. - - -- submits the following report: Your Committee met on Monday, February 1, 1960 and after reviewing existent statutes and ordinances pertaining to the subject matter of this ordinance,concluded that the same should be amended. Accordingly, your committee submits the attached amended ordinance and recommends that said ordinance, as amended, be set for public hearing. Councilman Allen made a motion, that the Ordinance on firearms be set for public hearing on Tuesday, February 23, 1960, at 8:00 P.M. Councilman Coleman seconded the motion. Motion carried. RECESS 8 :39 -- -8:41 P.M. After the Council meeting was reconvened, President Kroll asked that the Boy Scouts who were elected to serve as City Officials on this, Scouts in Government Day, rise and introduce and identify themselves. Then President Kroll introduced Mayor Edward F. Voorde who recognized the presence of the Boy Scouts and commended them for their interest in Government. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE APPROPRIATING IN THE 1959 GENERAL STREET IMPROVEMENT FUND THE SUM OF $52,947.66, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ T. W. Lehman, Chairman February 8, 1960. Councilman Tellson made a motion that the report be accepted and placed on file. Councilman Ladewski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole,to whom was referred AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, (Light Petition), Respectfully report that they have examined the matter and Councilman Kroll moved, seconded by Councilman Muszynski, that the Ordinance be withdrawn. Council voted unanimously to withdraw Ordinance, /s/ T. W. Lehman, Chairman February 8, 1960. Councilman Muszynski moved, seconded by Councilman Allen, that the Ordinance be withdrawn and expunged from the Council records. Motion was unanimously carried. Councilman Ladewski made a motion that the Report of the Committee of the Whole be accepted and placed on file. Councilman Allen seconded the motion. Motion carried. ORDINANCE N0, 4300-- - - - -60 AN-.ORDINANCE APPROPRIATING IN THE 1959 GENEERAL STREET IMPROVEMENT FUND THE SUM OF $52,947.66 The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays, ORDINANCE NO. 4301-- - - - -60 AN ORDINANCE APPROVING AN OPTION FOR THE PURCHASE OF REAL ESTATE BETWEEN THE MUNICIPAL CITY OF SOUTH BEND AND MABEL M. CROWEL The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. RIM __ Ri _:i.- :i AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE AND SALE OF BONDS OF SAID CITY FOR THE PURPOSE OF PROVIDING FUNDS TO BE APPLIED TO THE COST OF CONSTRUCTION, RE- CONSTRUCTION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH. The City Clerk presented to the Council a petition filed by owners of taxable real estate in the City of South Bend, Indiana, requesting the Common Council to authorize the issuance of bonds of the City of South Bend in an amount not exceeding One Million ($1,000,000.00) Dollars, for the purpose of providing funds to be applied to the cost of construction, re- construction and improvement of streets in said City and expenses incurred in connection therewith. Said petition having been examined and found to be sufficient and to be properly verified and certi- fied, on motion duly made by Councilman Lehman, seconded by Councilman Allen, and carried, the same was approved and ordered filed. Councilman Krueper made a motion that the St. Joseph County Auditor's Certificate be found sufficient, be approved, accepted and ordered placed on file. Councilman Allen seconded the motion. Motion carried. RESOLUTION OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND WHEREAS, the Board of Public Works and Safety of the City of South Bend, Indiana, has found that many streets in the City of South Bend have deteriorated and have become defective to a great and serious extent, and accordingly have created an emergency requiring immediate construction, re- construction and improvement of said streets; and, WHEREAS, the Board of Public Works and Safety of the City of South Bend finds that the construction, re -con- struction and improvement of such streets is necessary in order to protect the safety and well -being of the citizens, of said City and will be of general benefit to the entire City; and, WHEREAS, This Board finds that the estimated cost of the construction, re- construction and improvement of said streets and the incidental expenses in connection therewith will be in the amount of One Million Dollars ($1,000,000.00); now, therefore, BE IT RESOLVED by the Board of Public Works and Safety of the City of South Bend, Indiana, that this Board request the City Controller of said City and the Common Council of said City to take proper steps immediately to provide the necessary funds for said purpose, in the amount of One Million Dollars ($1,000,000.00), and to that end that a copy of this resolution be filed with the City Controller and City Clerk and presented to the Common Council at the next meeting thereof. TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND INDIANA: The Board of Public Works and Safety of the City of South Bend, Indiana, has requested an appropriation in the amount of One Million Dollars ($1,000,000.00) for application on the cost of construction, re- construction and improv ment of streets in said City and the incidental expenses to be incurred in connection therewith. I recommend that said appropriation be made, and am submitting herewith for the consideration of the Council, a form of ordinance authorizing such appropriation. The City does not have funds available to pay the cost of said project, and in order to provide funds to meet said appropriation it will be necessary to authorize, issue and sell bonds of the City of South Bend in the amount of One Million Dollars ($1,000,000.00), and I am handing you herewith a form of ordinance drawn for such purpose. The Clerk then gave the Ordinance first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of the rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Clerk then gave the Ordinance Third reading and it was passed by a roll call vote of 9 ayes, 0 nays. RESOLUTION WHEREAS, the 8th day of February. 1960, has been proclaimed as BOY SCOUT DAY in the City. of South Bend, Indiana; and, WHEREAS, the Boy Scouts of Tri- Valley Council,Boy Scouts of America, elected Officials amongst the Boy Scouts for the various offices in the City of South Bend; and, WHEREAS, the Boy Scouts have fulfilled their duties very efficiently and with dispatch; NOW, THEREFORE, BE IT RESOLVED: That the Common Council go on record as commending the Tri - Valley Council, Boy Scouts of America, the various elected officials amongst the Boy Scouts of America, the various elected official amongst the Boy Scouts, as well as the appointed Officials, for their service to the City of South Bend; and, BE IT FURTHER RESOLVED that the Common Council go on record as commending the Tri - Valley Council, Boy Scouts of America, for the program instituted and trusting that it will continue this program from year to year; and, BE IT FURTHER RESOLVED that the Common Council realizes that by this type of program, the young people of our community can become better acquainted with the government of the community; and BE IT FURTHER RESOLVED that a copy of this Resolution be sent to the Tri- Valley Council, Boy Scouts of America and a copy be given to each Boy Scout elected to take part in Boy Scout day. Resolution adopted. RESOLUTION WHEREAS, The American Legion, dedicated to service for God and Country, has become one of the great bulwar o£. the American way of life through its leadership in all movements designed to promote a dynamic conviction of Americanism for the preservation of our free institutions and freedoms; and WHEREAS, The American - Legion with 110,000 members in Indiana who have served in three wars will celebrate the anniversary of its birth, March 15 to 17, 1960, marking the completion of -41 years of patriotic labors which hav had a great and beneficial impact on the welfare and security of America; now, THEREFORE, we, the Common Council, City of South Bend, do h3ereby,.proclaim the week of March 13 to 19 1960, as American Legion Birthday Week and do call upon all citizens and:all organizations to join in paying tribute to the good works of this great veterans organization. /s/ Eugene Ladewski Eugene Ladewski Council,-Member Councilman Allen made a motion for adoption of the Resolution. Councilman Ladewski made a motion to have the next regular meeting of the Council on Tuesday, February 23, 1960, since Monday, February 22, 1960 is a legal Holiday. Councilman Muszynski seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Coleman made a motion to adjourn.
