HomeMy WebLinkAbout01-11-60 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend met in Regular Session in the Council Chambers on Monday, January 11, 1960, with all members present. The meeting was called to order at 8:14 P.M. by President Joseph T. Kroll, who presided. ROLL CALL: PRESENT: Councilmen Kroll, Allen, Ladewski, Tellson, Coleman, Glass, Krueper, Lehman and Muszynski. ABSENT: None. MINUTES Report of Committee on Minutes To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. PETITION Petition of Marjorie Drinski to rezone land located at Portage, Navarre and William Streets. Councilman Tellson made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. REPORT OF ATTORNEY FOR BOARD OF ZONING APPEALS Mr. William Mclnerny, Attorney for the.Board of Zoning Appeals, gave an oral report on the non - conforming use of the property located at Columbia and Dubail Streets. Councilman Muszynski made a motion that the report be accepted. Councilman Allen seconded the motion. Motion carried. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: January 11, 1960 The attached petition of The Light Company, Inc., to rezone the property lying generally north of Jefferson Boulevard west of 33rd Street, and south of McKinley Avenue, containing 34 acres, more or less, from "A" Residential Use to "C" Commercial Use and "D" Height and Area District was legally advertised on November 23, 1959 and given public hearing under date of December 3, 1959. The following action was taken: After due consideration the Commission found that no need for commercial use of subject property had been demonstrated, that the best use of the land is residential, that the use of the surrounding land is predominantly residential, and that the best interests of the City and the neighborhood would be served by residential use of subject property. REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: January 11, 1960 The attached petition of Edward and Virginia Buszkiewicz, to rezone Lot Number 2, Wooded Estates, located at 1329 North Ironwood Drive, from "A" Residential Use to "C" Commercial Use and "D"'Height and Area District was legally advertised on December 28, 1959 and given public hearing under date of January 7, 1960. The following action was taken: After due consideration the Commission found that the commercial zoning of subject property would be REGULAR MEETING JANUARY 11, 1960 an unwarranted and needless intrusion into a residential area. REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South.Bend South Bend, Indiana Gentlemen: January 11, 1960 The attached petition of Place and Company to annex to the City of South Bend a parcel of land lying at the southeast corner of Miami Road and Ireland Road, containing 119.22 acres, more or less,.was legally advertised on December 28, 1959 and given public hearing under date of January 7, 1960. The following action was taken: After due consideration the Commission found that the proposed additional land was needed for municipal expansion, and that in their opinion the criteria for annexation as set forth.in the Annexation Statute were present. ORDINANCES, FIRST AND SECOND READING AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (Ireland Road and Miami Road) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on 'January 25, 1960. Councilman Ladewski seconded the motion. Motion carried. AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, (North Ironwood Road) The Ordinance was -given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on January 25, 1960. Councilman Krueper seconded the motion. Motion carriec AN ORDINANCE APPROPRIATING IN THE 1959 GENERAL STREET IMPROVEMENT FUND THE SUM OF $52,947.66 The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on January 25, 1960. Councilman Ladewski seconded the motion. Motion carried. ORDINANCE NO. 4293 - -60 AN ORDINANCE APPROVING THE CONTRACT BETWEEN THE CITY WATER WORKS OF SOUTH BEND AND BURROUGH'S CORPORATION FOR THE PURCHASE OF TWO BURROUGH'S STYLE F5500 DUAL PRINTER SENSIMATICS FOR $13,313.50 The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4294 - - -60 AN ORDINANCE APPROVING AN OPTION TO RENEW A LEASE BETWEEN THE MUNICIPAL CITY OF SOUTH BEND AND ALBERT MEILSTRUP, d /b /a. MEILSTRUP CARTAGE COMPANY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion for suspension of rules. Councilman Coleman seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN BOARD OF HEALTH $2,500.00; ELECTRICAL DEPARTMENT $100.00; AND CITY CLERK $14,539.00 The Ordinance was given first reading by title and second reading in full. Motion carried. 172 REGULAR MEETING JANUARY 11, 1960 ORDINANCE, FIRST AND SECOND READING AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1951 The Ordinance was given first reading by title and second reading in full. ORDINANCE NO. 4294A -60 AN ORDINANCE TO CHANGE THE NAME OF PALACE THEATRE TO MORRIS CIVIC AUDITORIUM The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of the rules. Councilman Allen seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE, FIRST AND SECOND READING.; AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN _MORRIS CIVIC AUDITORIUM $57,830.00 The Ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the Ordinance be set for public hearing on January 25, 1960. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND _READING AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, REPAIR, ALTERATION, LOCATION, OF ALL ELECTRIC SIGNS; LOCATION OF ALL OVERHANGING SIGNS AND ALL TYPES OF ELECTRIFIED SIGNES WITHIN THE CITY OF SOUTH BEND, INDIANA; PROVIDING FOR THE POSTING OF BONDS, LICENSING OF SIGN CONTRACTORS: THE ISSUANCE OF PERMITS AND FEES THEREFORE; AND PROVIDING FOR MINIMUM CONSTRUCTION STANDARDS The Ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the Ordinance be referred to the Ordinance Committee for consideration and that the other members of the Council be invited to attend the meeting. Councilman Coleman seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND (East Jefferson -- -Light Petition) The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that the Ordinance be set for Public Hearing on February 8, 1960. Councilman Coleman seconded the motion. Motion carried. OLD BUSINESS Councilman Muszynski commented on the condition of the Council Chambers and asked that the Clerk of the Board of Public Works and Safety be present at the next meeting of the Council to discuss the possibility of having the Council Chambers washed, the ceiling repaired and the room repainted. The Clerk was directed to ask the Clerk of the Board of Public Works and Safety to be present at the next Regular Meeting of the Council. Councilman Muszynski asked that an investigation be made as to what would be required to secure a traffic light at the .'intersection of Mayflower and Sample Streets. The Clerk was directed to advise the City Traffic Engineer to be present at the next regular meeting of the Council relative to this matter. Councilman Tellson complained about the condition of the railroad crossings at Twyckenham Drive, Ironwood Drive and Kemble Avenue. He asked that the City Engineer be present at the next Regular meeting of the Council to inform the Council as to what has been done during meetings with the railroad Officials. NEW BUSINESS Councilman Tellson asked the City Attorney to prepare an Ordinance regulating the use of Pellett.guns and City Attorney Irving J. Smith informed him that such an Ordinance is already being prepared. There being no further business to come before the Council, Councilman Coleman made a motion to4adjourn.
