Be it remembered that.the Common Council of the City of South Bend, Indiana, met in.Regular Session in the Council Chambers, Monday, November 23, 1959, at 8 :34 P.M., with all members present. The meeting was called to order by President Stanley C. Korpal, who presided. ROLL CALL PRESENT: Councilmen Korpal, Erhardt, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski. ABSENT: None MINUTES: Report of Committee on Minutes: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have. inspected the minutes of the previous meeting of the Council and found them correct. Pa1'+U'U LR^11i L'iL' C..l 11VV 1VUVz11Dr,K zi, ly7y REPORT OF CITY ENGINEER MEMO TO: Mrs. Freda Noble, City Clerk November 23, 1959 SUBJECT: Report to City Council concerning East Sample Street In answer to the request for a progress report on Sample Street please be informed as follows: The Rieth -Riley Construction Company working on East Sample Street have been waiting for ideal weather to lay the concrete base, if not in total then just enough so that access to Zoker, Mossbergs, Home Plumbing and Heating and the crosswalks for the school children could be built before bad weather closes the project. This is our tentative schedule, however this morning at the Board of Public Works meeting several business men from the Sample Street area and Mr. Glass appeared and it was decided that as soon as the present trench digging operations are completed Sample Street will be opened for traffic and will not be closed again unless the Rieth -Riley Company finds it practical to start laying the concrete base. ORDINANCE NO. 4288 - - -59 AN ORDINANCE FIXING COMPENSATION OF APPOINTED OFFICERS AND EMPLOYEES OF THE SOUTH BEND WATER WORKS AND SEWAGE TREATMENT PLANT The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of the rules. Councilman Kroll seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays, The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE TO AMEND SECTIONS 6, 7, 8, 9, THE LAST PARAGRAPH OF SECTION 11, AND SECTION 14 OF ORDINANCE NO. 3644 ENTITLED "AN ORDINANCE RELATING TO TRAFFIC AND REGULATING THE.USE OF THE STREETS AND HIGHWAYS OF THE CITY OF SOUTH BEND, INDIANA; CREATING AND DEFINING PARKING METER ZONES; PROVIDING FOR THE DESIGNATION OF INDIVIDUAL PARKING SPACES; DEFINING AND PROVIDING FOR THE INSTALLATION, OPERATION AND MAINTENANCE, PURCHASE, LEASING, USE, SERVICING, REPAIR, REPLACEMENT, ACQUIRING AND REGULATION OF PARKING METERS; PRESCRIBING PARKING TIME LIMITS; REQUIRING DEPASITS OF COINS FOR THE USE OF PARKING METERS AND PARKING METER ZONES AND PROVIDING FOR THE COLLECTION AND DISPOSITION OF SUCH COINS; REPEALING CONFLICTING ORDINANCES; PROVIDING FOR THE ENFORCEMENT THEREOF; DEFINING OFFENSES AND PRESCRIBING PENALTIES; AND PROVIDING THAT THE INVALIDITY OF PART SHALL NOT AFFECT THE VALIDITY OF THE REMAINDER OF ORDINANCE" PASSED JUNE 7, 1948, ALSO KNOWN AS SECTIONS 54, 57, 58 and 59 of CHAPTER 29 of THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1949, GENERAL ORDINANCE NO. 3709. Motion carried.I ORDINANCE, FIRST AND SECOND READING AN ORDINANCE TO AMEND SECTION 24 AND PARAGRAPH 4 OF SECTION 25 OF ARTICLE V OF ORDINANCE NO. 3200 AS AMENDED ENTITLED "ORDINANCE PROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT OF THE REGULATIONS GOVERNING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF SOUTH BEND ESTABLISHING A CETY TRAFFIC ENGINEER AND SETTING FORTH HIS DUTIES, ALSO ESTABLISHING A TRAFFIC BUREAU AND SETTING FORTH THE MEMBERSHIP AND DUTIES OF SUCH BUREAU AND REPEALING SUCH PARTS OF ORDINANCES THAT MAY BE IN CONFLICT HEREWITH ONLY INSOFAR AS THEY CONFLICT AND SUPPLEMENTING THE TRAFFIC ORDINANCES, BUT IN NO WAY REPEALING THE INTENT OR PURPOSES OF SAID ORDINANCES" PASSED FEBRUARY 8, 1937, ALSO KNOWN AS CHAPTER 29, SECTION 16 AND SUB - SECTION (c) OF SECTION 17 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1949, GENERAL ORDINANCE NO. 3709. The Ordinance was given first reading by title and. second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on December 14, 1959. Councilman Kroll seconded the motion. Motion carried. RESOLUTION WHEREAS, under Title I of the Housing Act of 19491 as amended, and the Housing Act of 1954, as amended, the Housing and Home Finance Administrator is authorized to extend financial assistance to localities in the elimination and prevention of the spread of their slums and urban blight through the planning and undertaking of urban renewal projects; and WHEREAS, it is desirable and in the public interest that the City of South Bend, Department of Redevelopment by and through the South Bend Redevelopment Commission, prepare surveys and plans, presently estimated to cost approx- imately $101,780 (One- Hundred - One - Thousand, Seven - Hundred Eighty Dollars), in order to undertake and carry out an urban renewal project of the character contemplated by Section 110(c) of said Title I, in that certain area, proposed as an Urban Renewal Area, situated in the City of South Bend, County of St. Joseph, and State of Indiana, and des- cribed as follows: LINDEN AVENUE LEGAL DESCRIPTION BEGINNING at the intersection of the westerly right of way line of Olive Street with the northerly right of way line of the New York Central Line. THENCE, in a southeasterly direction along the northerly right of way line of the New York Central Line for a distance of approximately 2,350 feet to the intersection with the projected center line of College Street. THENCE, in a northerly direction along the projected centerline of College'Street for a distance of approximate] 400 feet to the intersection with the westerly right of way line at Circle Avenue. THENCE, in a northerly direction along the westerly right of way line of Circle Avenue for a distance of approx- imately 400 feet to the intersection of the southerly right of way line at Washington Street. THENCE, in a easterly direction along the southerly right of way line of Washington Street for a distance of approximately 960 feet to the intersection of the easterly right of way line of Walnut Street. THENCE, in a northerly direction along the easterly right of way line of Walnut Street for a distance of approx- imately 680 feet to the point where the southerly property line of the city cemetery intereects with the easterly right of way line of Walnut Street. THENCE, in a northerly direction along the westerly property line of city cemetery for a distance of approx- imately 550 feet to the intersection with the southerly right of way line of city alley. THENCE, in an easterly direction along the southerly right of way line of city alley for a distance of approx- imately 150 feet to the intersection with the westerly property line of the city cemetery. THENCE, in a northerly direction along the westerly property line of the city cemetery for a distance of approx- imately 900 feet to the intersection with the northerly right of way line of LaPorte Avenue. THENCE, in a northwesterly direction along the northerly right of way line of Laporte Avenue for a distance of approximately 150 feet to the intersection with the easterly right of way line of Walnut Street. THENCE, in a northeasterly direction along the easterly right of way line of Walnut Street for a distance of approximately 750 feet to the intersection:with the northerly right of way line of Lincolnway West. THENCE, in a northwesterly direction along the northerly right of way line of Lincolnway West for a distance of approximately 320 feet to the intersection with the extended westerly right of way line of Diamond Avenue. THENCE, in a southwesterly direction along the westerly right of way line of Diamond Avenue for a distance of approximately 650 feet to the intersection with the northerly right of way line of LaPorte Avenue. THENCE, in a northwesterly direction along the northerly right of way line of LaPorte Avenue for a distance of approximately 300 feet to the intersection with the extended westerly right of way line of Studebaker Street. THENCE, in a southerly direction along the westerly right of way line of Studebaker Street for distance of approximately 400 feet to the intersection with the northerly right of way line of Fassnacht Avenue. THENCE, in a westerly direction along the northerly right of way line of Fassnacht Avenue for a distance of approximately 1,860 feet to the westerly right of way lire of Johnson Street. THENCE, in a southerly direction along the westerly right of way line of Johnson Street for a distance of approximately 520 feet to the intersection with the northerly right of way line of Kenwood Avenue. THENCE, in a westerly direction along the northerly right of way line of Ken000d Avenue for a distance of approximately 1,880 feet to the intersection of the westerly right of way line of Olive Street. THENCE, in a southerly direction along the westerly right of way line of Olive Street for a distance of approximately 1,460 feet to the intersection of the northerly right of way line of the New York Central Railroad r of way, the point of beginning. WHEREAS, the above -cited Federal law requires as a condition to the execution of a contract for a loan and capital grant for an urban renewal project that the locality present to the Housing and Home Finance Administrator REGULAR MEETING NOVEMBER 23, 1959 a workable program, as set forth in Section 101 (c) of said Title I, for utilizing appropriate public and private resources to eliminate and prevent the development or spread of, slums and urban blight, to encourage needed urban rehabilitation, to provide for the redevelopment of blighted, deteriorated, or slum areas or to undertake such other feasible community activities as may be suitably employed to achieve the objectives of such a program; and WHEREAS, it is recognized that contracts for loans and capital grants for urban renewal projects will require, among other things, (1) the approval of the urban renewal plan by the goberning body of the locality in which the project is situated; (2) the provision of local grants -in -aid which may consist of donations of cash, land, demolit or removal work, and the installation, construction or reconstruction of streets, utilities, parks, playgrounds or other improvements or the provision of other public buildings or facilities; and (3) the development of a feasible method for the relocation of families displaced from the urban renewal area. NOW, THEREFORE BE IT RESOLVED BY the Common Council of the City of South Bend, Indiana; Section 1. That the proposed Urban Renewal Area described above is a slum, blighted, deteriorated or deteriorating area appropriate for an urban renewal project and the undertaking by the City of South Bend, Department of Redevelopment, by and through the South Bend Redevelopment Commission, of surveys and plans for an urban renewal project of the character contem- plated in Section 110 (c) of the Housing Act of 1949, as amended and supplemented, in the proposed Urban Renewal Area described above, is hereby approved. Section 2. That the financial assistance provided under said Title I to assist urban renewal projects is needed and that the Housing and Home Finance Administrator is hereby requested to reserve for an urban renewal project in the proposed Urban Renewal Area described above Federal Capital grant funds in an amount sufficient to enable the City of South Bend, Department of Redevelopment, by and through the South Bend Redevelopment Commission, to finance the undertaking of the Project. Section 3. That it is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal projects with Federal financial assistance under Title I, including the requirements of said Title I respect- ing the workable program mentioned above, and that it is the sense of this body (a) that a feasible method for the relocation of families displaced from the urban renewal area, in conformity with said Title I, can be prepared, and (b) that local grants -in -aid consisting of donations of cash, land, demolition or removal work, and the installation, construction or reconstruction of streets, utilities, parks, playgrounds or other improvements or the provision of other public buildings or facilities, necessary for carrying out in the Urban Renewal Area the urban renewal objec- tives of said Title I in accordance with the urban renewal plan, can and will be provided in an amount which will not be less than one -third of the net project cost and which, together with the Federal capital grant, will be generally equal to the difference between gross project costs and the proceeds or value of project land sold, leased or retained for use in accordance with the urban renewal plan. Section 4. That the filing of an application the South Bend Redevelopment Commission; for defray the cost of the surveys and plans for hereby approved. ATTEST: /s/ Freda G.
