Councilman Erhardt seconded the motion. Motion carried. REPORT OF BUILDING DEPARTMENT October 13, 1959 Common Council Civil City of South Bend, Indiana Attention: City Clerk - City Hall Gentlemen: In accordance with your request, I am submitting headjacent to the Broadmoord Shopping cCenter asewellsasialreport on illegal activities in conjunction with parking to � the conditions and safety of the retaining wall on the same property. Please be advised, that the Shopping Center, and the property presently used for parking, has been zoned t'C" Commer- cial, and with such zoning no conditions other grantedoaevariance, in the its use. However, the Board of Zoning Appeals gran ertain restrictions. However, as nearly as I can determine, thes poses. This variance was granted contingent upon c 154 REGULAR MEETING OCTOBER 13, 1959 residentially zoned lots are not as yet being used for off - street parking purposes. Therefore, you may rest assured that this Department had scrutinized the .plans for said wall for compliance with all Building Code regulations. During construction diligent inspections were made, and it is, therefore, my opinion that the wall in its present condition does not exist as a hazard -.-to the general public. Councilman Erler asked that the matter be referred to the Miscellaneous Committee for study. Councilman Erhardt withdrew his motion. Councilman Kroll withdrew his second to the motion. Councilman Erler then made a motion that the report be referred to the Miscellaneous Committee for study. Councilman Kroll seconded the motion. Motion carried. REPORT OF STREETS AND ALLEYS COMMITTEE Attn: The Common Council of the City of South Bend October 13, 1959 This committee held a meeting in reference to ordinance before the common council on naming former Monroe Street, between Taylor and Scott Streets to DeKovats Drive. The committee finds that such street as Monroe St. between Taylor and Scott never existed, therefore this ordinance would not be valid, as you cannot rename a street that never existed. The committee recommends to the common Council, this ordinance as unfavorable. Chester Muszynski, Chairman Streets and Alleys Committee Councilman Erhardt made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN ENGINEERING DEPART- MENT AND PUBLIC HEALTH CLINIC IN AMOUNT OF $600.00, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED favorable. /s/ Joseph T. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN CONTROLLER'S OFFICE $3,500.00 AND STREET AND TRAFFIC FUND $800.00, Respectfully report that they have examined the matter and that in their opinion it should be reported favorable. /s/ Joseph T. ORDINANCE NO. 4282 - - -59 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN ENGINEERING DEPARTMENT AND PUBLIC HEALTH CLINIC IN AMOUNT OF $600.00 The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Hahn). ORDINANCE NO. 4283 - - -59 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN CONTROLLER'S OFFICE $3,500.00 AND STREET AND TRAFFIC FUND $800.00 The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Hahn). REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: October 7, 1959 The attached petition of Peter Bognar, et al, to rezone Lot Number 2, Plat of Dunbar and Company, Subdivision of B.O. No. .31 and 32 of the First Plat of Out Lots of the Town, now the City of South Bend, located at 807 West Washington Street, from "B" Residential Use and "A". Height and Area District to "C -1" Commercial Use and "D" Height and Area District, was legally advertised on Sepember 21, 1959 and given public hearing under date of October 1, 1959. The followine action was taken: VVIVULI\ 1 ✓1 1 /,�� After due consideration the Commissiow . found that subject property is entirely surrounded by residential zoning and, within the general area, by predominantly residential use and that the proposed zoning would result in spot zoning. REPORT OF CITY PLANNING COMMISSION To the Common Council of City of South Bend South Bend, Indiana Gentlemen: the City of South Bend October 7, 1959 The attached petition of Edward Meredith, et al, to rezone Lots 7 -13, inclusive, of Morris Park Addition, located at 1601 and 1625 Portage Avenue, from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and 11D" Height and Area District was legally advertised on August 24, 1959 and given public hearing under date of September 3, 1959. The following action was taken: RLH /mah Attach. After due consideration the Commission found that ample commercially zoned area existed in the immediate vicinity and that a large amount of this land was not used commercially and that further a large amount of this land was vacant. The Commission therefore found that no need existed for proposed zoning and that said zoning would result in 1) an unwarranted intrusion into a predominantly residential area of commercial use, 2) an unwarranted and undesirable extention of strip zoning. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: October 7, 1959 The attached petition of Austin F. Riggs, et al, to rezone Lots Numbered 113, 114, and 115 in Sorins Second Addition to the City of South Bend, Indiana located at 920 North Frances Street from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "D" Height and Area District was legally advertised on September 21, 1959 and given public hearing under date of October 1, 1959. The following action was taken: After due consideration the Commission found that commercial zoning of subject property would result in a logical expansion of commercial zoning. It was therefore duly moved, seconded and unanimously carried that the petition be recommended favorably to the Council. Also attached is a consent petition bearing fourty -one signatures, being approximately 98 per cent of the property owners in the immediate vicinity. RLH /mah 2 attachs. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Petition of E. Meredithg- -Lots 7 to 13, Morris Park Addn.) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on November 9, 1959. Councilman Erler seconded the motion. Motion carried. ORDINANCE NO. 4284 AN ORDINANCE AMENDING ORDINANCE NO. 3702, AS AMENDED, COMMONLY KNOWN AS „THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND; INDIANA" (Austin. Riggs, et al, Land located at N. Francis & Howard Streets) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Hahn. The Ordinance was then given third reading and passed by a roll call vore of 8 ayes, 0 nays. 1 absent (Councilman Hahn.)
