President Stanley C. Korpal called the meeting to order and presided. The Clerk read the Call for a Special Meeting. COUNTY OF ST. JOSEPH STATE OF INDIANA SS CALL FOR SPECIAL MEETING CITY OF SOUTH BEND To the President, and Members of the Common Council of the City of South Bend, Indiana: Gentlemen: You are hereby notified that under and by virtue of the authority vested in me by law as Mayor of the City of South Bend, in the State of Indiana, a Special Meeting of the Common Council of said City is hereby called to meet in the Council Chambers in the City Hall, at the hour of 7:30 P.M., on Wednesday, August 5th, ,959, for the purpose of the following: Taking action on the creation of a City- County Building Authority. The Chief of Police or any member of the Police Force is hereby directed to forthwith serve a copy of this notice on each and every member of the Common Council and make due return of such service of said special meeting. Voorde, Mayor of the City of South Bend, Indiana The within call came to hand this 4th day of August, 1959, which I served by reading the same to each Councilman, upon the date designated, as follows: /s/ Albert Tellson /s/ Walter G. Glass /s/ Donald F. Erhardt by Mrs. John J. Erhardt /s/ Joseph Kroll by Mrs. Joseph Kroll /sl Chester Muszynski by Mrs. Chester Muszynski /s/ Walter C. Erler, Sr. /s/ Glenn W. Zubler Member of the South Bend Police Department And by leaving a certified copy thereof at the last and usual place of residence of such members as I was unable to find, as follows: William A. Hahn Officer John J. Istenes # 230 Julius B. Christman Officer John J. Istenes # 230 Stanley C. Korpal Officer John J. Istenes #230 Councilman Muszynski made a motion that the Special Call be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. ROLL CALL PRESENT: Councilmen Korpal, Erhardt, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski. ABSENT: None. RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND WHEREAS, the creation of a Building Authority to be a body corporate and politic is authorized by the statutes of Indiana for the purpose of financing, acquiring, constructing, equipping, operating and leasing to the governmental units within the territorial boundaries of the county, lands or buildings for public or governmental purposes; and WHEREAS; under date of the 25th of May, 1959; the Common Council of 'the City of South Bend by 'resolution deemed'it in the.best interests of the public to create such an authority in St. Joseph County; that a public hearing be held and conducted by the Common Council of the City of South Bend, Board of Commissioners of the County of St. Joseph, and the St. Joseph County Council, and WHEREAS, on the 9th day of June, 1959 a public hearing was held as to the matter of creation of such an authority in St. Joseph County, and WHEREAS, under the Acts of the General Assembly of the State of Indiana, of 1953, Chapter 54, Section 2, page 163, it is required that a concurrent resolution be agreed upon between the Common Council of the City, Board of Commissioners of the County and the County Council that there is a need for such an authority and that such an authority should be created, and WHEREAS, said Acts also require that a separate resolution be adopted by each body, NOW, THEREFORE, BE IT RESOLVED: by the Common Council of the City of South Bend ghat there is a need for such an Authority in St. Joseph County and that such an authority be created as the South Bend - St. Joseph County Building Authority. BE IT FURTHER RESOLVED THAT the President of this Council is authorized to act on behalf of this Council in the signing of a concurrent resolution with the St. Joseph County Commissioners and the St. Joseph County Common Council Done this 5th day of August, 1959. /s/ Stanley C. Korpal, Member of the Common Counc 135 SPECIAL MEETING AUGUST 5, 1959 Councilman Kroll made a motion for adoption of the foregoing Resolution. Councilman Muszynski seconded the motion. Resolution passed by a roll call vote which was as follows: Councilman Korpal Aye Councilman Erhardt Aye Councilman Tellson Aye Councilman Kroll Aye Councilman Hahn Aye Councilman Muszynski Aye Councilman Christman stated that he was not in opposition to a new City Hall but he was opposed to the authority and voted NAy. Councilman Glass voted Nay. Councilman Erler stated that he was not opposed to a new City Hall but he was opposed to the rush. He voted Nay. 6 ayes, 3 nays, Resolution Passed. There being no further business to come before the Special Meeting of the Council, Councilman Hahn made a motion to adjourn. Councilman Muszynski seconded the motion.
