HomeMy WebLinkAbout07-13-59 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, Monday, July 13, 1959, at 8 :41 P.M., with all members present except Councilmen Korpal and Tellson. The meeting was called to order by Vice President William A. Hahn, who presided in the absence of President Korpal. ROLL CALL: PRESENT: Councilmen Erhardt, Christman, Kroll, Glass, Hahn, Erler and Muszynski. ABSENT: Councilmen Korpal and Tellson. MINUTES Report of Committee on Minutes To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspectE the minutes of the previous meeting of the Council and found them correct. REPORT OF BUILDING DEPARTMENT Common Council of the Civil City of South Bend, Indiana Attention: City Clerk - City Hall Gentlemen: July 13, 1959 In response to your request, I am submitting herein a report on possible violation of those ordinances under my jurisdiction perpetrated by the owner(s) /and or occupant of the property located on the North East corner of Lincoln- way East and Twyckenham Drive in the City of South Bend, Indiana. Please.be advised that I have investigated the subject property and have found the following. 1. That 185 feet of frontage on Lincolnway East on the North side of said street is zoned "B" Residential as to use. 2. That the property is presently occupied by the firm known as Allied Motor Sales Used Cars and is more specifically defined as that property fronting on Lincolnway East on North side of said street and bounded by the East line of Caroline Street extended, West to the East line of Twyckenham Drive. 3. That the property is presently occupied for the purpose of resale of used automobiles and is presently being sub- let for the purpose of commercial advertising. 4. That the aforesaid use of the property, as defined in part 3, is a violation of Ordinance #3702, Section No. 4, as such pertains to permissable uses on property zoned "B" Residential as to use. Consequently, I hereby assure you that action will be taken by this Department, insofar as it is capable, of insuring' compliance with said zoning ordinance. However, there exists the possibility that there may have been further violation of other ordinances of this City by virtue of the fact that some evidence exists which indicates that a portion of the natural river bed has been filled in for the purpose of extending the illegal commercial use. Since this possible violation does not come within the realm of police powers designated to this Department, we shall refer this matter to the Park Department and to the Board of Public Works and Safety for their consideration, with a recommendation for possible remedial action. I trust that this information will answer satisfactorily any question which you may have had pertaining to the subject property, but if you should have further question, please contact me. Councilman Muszynski seconded the motion. Motion carried. REPORT OF BOARD OF HEALTH July 13, 1959 Mrs. Freda G. Noble, City Clerk City Hall South Bend, Indiana Dear Mrs. Noble: The matter of "trash pickup" for the City of South Bend, referred to in your communication of June 24th, has been brought to the attention of the Board of Health. There are 186 cities in the United States with a population of 100,000 or more: In the greater number of these cities both garbage and trash are picked up, done either by the city itself or by private contract with some indivi- dual or corporation. The Board of Health is heartily in favor of adding "trash pickup" to the list of various services which the city already provides for its citizens. South Bend is a city of hundreds of homes and it is a fact that by far the greatest majority of the owners of these homes take great pride in maintaining their property in good condition, however, a minority are indifferent, or unwilling to make any effort to keep the home and premises free from collections of undesirable trash and unsightly debris: Such a resident is a_ detriment to the community in which he lives and to the city in general. The morale of the community is definitely lowered by the presence of such residents and their presence is often the beginning of a new slum area. A trash pickup ordinance, with a penalty for lack of observance, will result in a cleaner and better city for all to live in; hence, the Board of Health is very much in favor of adding trash pickup as a governmental service. A second consideration that makes the Board of Health favor "trash pickup" is the ever increasing danger to our community of rabies. All over the country rabies is becoming more and more a disease of wild life. Domestic animals are protected by preventive treatments but this cannot be carried out in wild life therefore this is the source from which this disease is propogated today. Throughout the current summer season a rat has been found in our city that was definitely rabied: This is the second rat that has been found in recent years with this disease. Collection of trash and unsightly debris very quickly becomes a harbor for our rat population. The danger of such a condition is apparent. A rabied rat could bite a child, or even an adult and thereby start this always fatal disease in one of our residents. Elimination of the rat hazard will be the result of "trash pickup South Bend, in every decade of its existence, has increased its population and it is to be anticipated that the same pattern will be followed in the future. Trash pickup, as well as garbage pickup is essential to large, con- centrated areas of population and its existence in a community is evidence of the progressiveness of the city and the people who live within its boundary lines. The Board of Health definitely favors "trash pickup`.' as a governmental service to be rendered to the people of our city. Yours sincerely, /sl F. R.N. Carter, MD F.R.N.Carter, M.D. c :b To supplement the above, the following communication was read from the City%Engineer To Whom It May Concern: The City of South Bend, Indiana operates a sanitary land fill disposal method along with public garbage collection for residential property only. We now have 10 trucks and two on order which will eventually mean 12 trucks operating on a nine route basis. If the city of South Bend is to make a combined collection of garbage and other trash we will nearly triple the volume of material to be picked up. We could provide this dual service by operating 15 routes with 18 trucks. This would mean that we would have to purchase six additional trucks and hire 15 more men for pick up service, one addi- tional maintenance man and one man and one additional piece of equipment at the sanitary land fill site. At the present time the budget for the Sanitation Department is $202,401.50. If this additional service is to be rendered in 1960, the budget for 1960 would be raised by $220,000.00 or a total budget of $422,401.50. The $220,000.00 increase.would represent a ten cent increase in the tax rate. I would recommend that, if such an ordinance were to bs adopted a regulation type and size can be used and that the City pick up only such trash and garbage as would fit in the can with the lid closed. In order to help reduce the rat nuisance, greater cooperation by the residents and strick enforcement of cleanliness around the garbage paid area will be necessary. RSA: me R. S. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council July 10, 1959 City of South Bend South Bend, Indiana Gentlemen: The attached Petition of Carleton and Nancy Smith to rezone Lot Number 31, as shown on the recorded plat of Wooded Estates Addition to the City of South Bend, Indiana, located at 1630 South Bend Avenue, from "A" Residential Use and "A" Height and Area District was legally advertised on June 22, 1959 and given public hearing on July 2, 1959. The following action was taken: After due consideration the Commission found that: 1. The favorable recommendation of the petition would result in a further intrusion into a residential area. 2. Existing commercial zoning was adequate in size, shape and frontage for commercial use. COMMUNICATION FROM MAYOR VOORDE To the Common Council of the City of South Bend, Indiana: I, the undersigned, Edward F. Voorde, Mayor of the City of South Bend, Indiana, as required by Chapter 107 of the Acts of 1959, hereby fix the maximum salaries for the herein named appointed officers and employees of the City of South Bend, Indiana, beginning January 1, 1960, and continuing thereafter until duly changed, and request that such maximum salaries be approved by the Common Council. Councilman Kroll made a motion that the Ordinance be set for public hearing on July 27, 1959. Councilman Erhardt seconded the motion. Motion carried. Councilman Kroll made a motion that the two Resolutions in regard to Urban Redevelopment Surveys be referred to the Urban Redevelopment and Housing Committee. Hahn, Councilman for the Fourth District of the Municipal City of South Bend, is celebrating his seventieth birthday, this date, and WHEREAS, William A. Hahn has worked expeditiously, diligently and efficiently for and on behalf of the Municipal City of South Bend in his capacity of Councilman, and WHEREAS, through his assistance and services on various committees in the Council, the tasks and duties of the Common Council and of the administration of the City of South Bend have been lessened considerably, and WHEREAS, the members of the administration of the City of South Bend, including the members of the Common Council are indebted and grateful fcr these services which have been of benefit to the entire community, and WHEREAS, it is our desire to congratulate William A. Hahn on his seventieth birthday and to wish him many more years of health and happiness and to express our appreciation to him for the civic services performed on behalf of the community, NOW, THEREFORE, it is RESOLVED that William A. Hahn be and he is hereby congratulated on his seventieth birthday and it is further RESOLVED that this Council wish him many more years of service to the City of South Bend, and it is further RESOLVED that we express our appreciation and gratitude for the civil services performed by William A Hahn. IT IS FURTHER RESOLVED that from and after the passage, attestation and signature by the Clerk and members of the Council, that this resolution become effective and a copy be delivered to William A. Kemper, former South Bend Councilman from 1948 through 1951, and WHEREAS, his death has brought much grief and sorrow to his family and his many friends, and WHEREAS, he served the City of South Bend diligently and efficiently as a member of the Common Council, and WHEREAS, the City of South Bend has been deprived of an able and outstanding citizen, NOW, THEREFORE, BE IT RESOLVED that we, the Common Council of the City of South Bend, do hereby extend to the entire family of ALVIN P. KEMPER, our sincere sympathy in this, their deepest hour of sorrow; and, BE IT FURTHER RESOLVED, that a page in the Council records of the City of South Bend be set aside and this resolution be copied therein and a copy, duly certified by the Clerk, be sent to the bereaved. OLD BUSINESS Councilman Muszynski made a motion that there be a full investigation of the junk yard lo * cated at 2214 W. Dunham Street and that Mr. Kopec, the Assistant City Attorney representing the City, be directed to report at the next meeting of the Council, July 27, 1959, and bring with him all his notes to enable him to make a full report as to the status of the action against the Junk yard. Councilman Christman seconded the motion. Motion carried. IN RE Encroachment along the banks of the St. Joseph River east of the Twyckenham Street Bridge. Councilman Erler made a motion that this violation be called to the attention of the Park Department and such steps - be taken in order to clarify this condition and return the property to the City of South Bend. Councilman Muszynski seconded the motion. Motion carried. There being no further business before the Council, Councilman Christman made a motion to adjourn. Councilman Kroll seconded the motion.
