HomeMy WebLinkAbout05-25-59 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, City Hall, on Monday, May 25, 1959, at 11 :05 P.M., with all members present. The meeting was called to order by President Stanley C. Korpal, who presided. ROLL CALL PRESENT: Councilmen Korpal, Erhardt, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski. ABSENT: None. MINUTES Report of Committee on Minutes: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Stanley C. Korpal Julius B. Christman, Jr. : Committee Donald F. Erhardt Councilman Erhardt made a motion that the report be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. COMMUNICATION South Bend City Council City Hall, South Bend, Ind. Dear Sirs: South Bend, Ind. May 18, 1959 Much has been said but nothing done to solve the daily burning of junk, rags, sweepings, wet grass, weeds, and even garpage that burn with a slow smothering smoking stinking fire for hours at a time especially at evenings and night. After sun down to send fumes into the rooms cuthing off fresh air and clothes drapes and bed clothes become saturated with such smoke. This is most effective from May until November. Along the alley between Oakwood and Lathrop there are about 15 or 16 common oil Brims with no ventilating holes in. These are used as burners instead of wire caging and grate. When the drum becomes loaded with sour stinking ashes a refuse, the trash hauler empties the contents for another charge. Last year we attended a council meeting and the Central fire department tried to get a voice in to eliminate this hazard but this soon died down. We have asked the Health department of their opinion but they had no authority so it still remains unsolved. The time has come to formulate an ordinance and enforce it. I suggest that every property owner or renter must pro- vide a wire cage burner and only burn trash between 7 o'clock in the morning and no later than 5 o'clock evening, and in event of ,a smudging smoke screen Continues, kill the smudge with water. I have no authority to tell others along the line what to do in this case. All these neighbors would become offended. They are all good citizens only they have the wrong equipment to handle trash and rubbish. To eliminate this offensive smudge burning. It is up to the Authority to enforce the law once it becomes effective. I therefore appeal to the City Council to enforce more sanitary measures. Respectfully submitted, /s/ Otto L. REPORT OF THE COMMITTEE OF THE WHOLE The Honorable Common Council of the City of South Bend Your Committee of the Whole, to whom was referred AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SOUTH BEND, INDIANA (Clay Township,) Respectfully report that they have examined the matter and that in their opinion it SHOULD BE REPORTED FAVORABLE. REPORT OF THE COMMITTEE..OF THE WHOLE To the Common Council of the City of South Bend Your Committee of the Whole, to whom was referred AN ORDINANCE TO AMEND ORDINANCE NO, 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (West Ewing Avenue), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend : Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Land at Eddy and East Jefferson), Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED UNFAVORABLE. /s/ Joseph T. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY CONTIGUOUS THERETO (Broadmoor), Respectfully report that they have examined the matter and that in their opinion it should be reported favorable. /s/ Joseph T. ORDINANCE NO. 4264 - - -59 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SOUTH BEND, INDIANA (Clay Township) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4265 - - -59 AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (West Ewing Ave.) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE N0. 3702 (Eddy and Jefferson) The Ordinance was given third reading and lost by a roll call vote of 7 nays, 2 ayes, (Councilmen Muszynski and Christman) ORDINANCE NO. 4266 - - -59 AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY CONTIGUOUS THERETO (Broadmoor) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. RESOLUTION RESOLUTION OF TIE COMMON COUNCIL OF THE CITY OF SOUTH BEND CREATING A BUILDING AUTHORITY WHEREAS, the creation o£.a'Building_- .Authority to be a body corporate and politic is authorized by the statutes of Indiana for the purpose of financing, acquiring, constructing, equipping, operating and leasing to the governmental units within the territorial boundaries of the county, lands or buildings for public or governmental purposes; and WHEREAS, it is deemed in the public interest for the creation of such an authority in'St. Joseph County to be con- sidered in public hearing to be held and conducted by the Board of Commissioners of the County of St. Joseph, the St. Joseph County Council and the Common Council of the City of South Bend, Indiana, NOW, THEREFORE, be it resolved by the Common Council of the City of South Bend that there be filed with the Auditox of St. Joseph County as provided by law a notice to be signed by the President of this Council stating that this body has agreed, and this body does-hereby so-agree, to held a public hearing on and consider the creation of such an authority to be known as "South Bend - St. Joseph County Building Authority " on June 9, 1959, at 7:30 o`Clock P.M., in the St. Joseph Circuit Court Room in South Bend, Indiana, which said notice shall be signed also by the presiding officers of the Board of Commissioners of the County of St. Joseph and the St. Joseph County Council, stating the agreement of those bodies if said bodies so agree and the Auditor of St. Joseph County shall give notice as provided by law. Done this 25th day of May, 1959. /s/ Stanley C. Korpal President of the Common Council. Councilman Kroll made a motion for adoption of the Resolution. Councilman Muszynski seconded the motion. Motion unanimously carried. Resolution adopted. RESOLUTION A RESOLUTION APPROVING A FORM OF CONTRACT AMENDING THE COOPERATION AGREEMENT OF SEPTEMBER 11, 1956 BETWEEN THE CITY OF SOUTH BEND, INDIANA, AND THE HOUSING AUTHORITY OF THE CITY OF SOUTH BEND, INDIANA The Clerk read the Resolution in its entirety. Councilman Erler made a motion that the Resolution be set for public hearing on June 8, 1959. seconded the motion. Motion carried. Councilman Glass RESOLUTION A RESOLUTION APPROVING APPLICATION FOR PRELIMINARY LOAN FOR LOW RENT PUBLIC HOUSING The Clerk read the Resolution in its entirety. Councilman Hahn made a motion that the Resolution be referred to the Public Improvement Committee for further study. Councilman Erhardt seconded the motion. ;Motion carried. Other Business Councilman Muszynski requested that the Health Department investigate the large number of rats in the Bremen Iron and Metal Company Junk Yard on West Dunham Street. Report on June 8, 1959. Councilman Erler requested the Board of Health to investigate the rats and unsanitary conditions across from the A & P on South Michigan Street at Donald Street. Report on June 8, 1959. Councilman Tellson stated he-had received a complaint from a Mrs. Reed in regard to breeding of dogs on 21st Street near Pleasant Street. Report on June 8, 1959. Councilman Erler complained of the deisel engines on the switch tracks of the Pennsylvania Railroad near West Ewing Avenue and stated that there is too much noise. Request the Board of Public Works and Safety to investigate and report on June 8, 1959. Councilman Muszynski complained that inter -city trucks are still using Olive Street and the Chief of Police is directed to place officers there continuously and also that a report at the next meeting be made on the coverage by the Police Department, the arrests made and the disposition of each case. There being no further business before the Council, Councilman Glass made a motion to adjourn. Councilman Kroll seconded the motion.
