HomeMy WebLinkAbout05-11-59 Council Meeting MinutesREGULAR MEETING MAY 11, 1959 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers of the City Hall on Monday, May 11, 1959, at 8 :07 P.M., with all members present except Councilman Muszynski. The meeting was called to order by President Stanley C. Korpal, who presided. ROLL CALL PRESENT: Councilmen Korpal, Erhardt, Tellson, Christman, Kroll, Glass, Hahn and Erler. ABSENT: Councilman Muszynski. MINUTES: Report of Committee on Minutes To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: May 11, 1959 The attached petition of William P. and Daniel C. Kraft to rezone land located on the north side of Ewing Avenue between Franklin Street and William Street, as follows: Lots Numbered 302 (419 W. Ewing Avenue) and 303 (415 W. Ewing Avenue) as shown on the Citizens Home Corporation Re -Plat, an addition to the City of South Bend, Indiana, from "B" Residential Use and "A" Height and Area District to tPD: Light Industrial Use and "E" Height and Area District was legally advertised on April 27, 1959 and given public hearing on May 7, 1959. The following action was taken: After due consideration the Commission found that: 1. The property to the sourth, to the east, and to the north of subject property was zoned light industrial. 2. That proposed zoning would be a logical and warranted extension of existing zoning. IT was therefore duly moved, seconded and unanimously carried that the petition be recommended favorably to the Common Council. Very truly yours, CITY PLANNING COMMISSION /s/ Robert L. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: May 11, 1959 The attached petition of Richard A. Muessel, Jr., to rezone the property generally described as being located on the northeast corner of Jefferson Boulevard and Eddy Street with a frontage of approximately 308 feet on Jefferson boulevard and approximately 722 feet on Eddy Street containing 4.5 acres, more or less, from "A" Residential Use District to "B" Residential Use District and "C':' Height and Area District was legally advertised on March 30, 1959, and given public hearing on April 9, 1959 and April 23, 1959. The following action was taken' RLH /ma.h Attach. After due consideration the following findings were adopted on motion duly made, seconded and unanimously carried: 1. The City Planning Commission recognizes that a serious problem exists in maintaining the existing character of surrounding property and in the opinion of the Commission the proposed zoning will tend to maintain Jefferson Boulevard and the general area in its present character and further that it is the Commission's opinion that it would not be generally economically feasible were the subject property to be used for one single family dwelling. 2. That the subject area is bordered on three sides by "B" multi - family Residential zoning and that on Eddy Street between Ewing Avenue on the south and Napoleon Street on the North there is no "A" single family zoning except the subject property, a distance of approximately four miles. It was therefore duly moved, seconded and carried (five ayes, one no) that the petition be recommended favorably to the Common Council. Very truly yours, CITY PLANNING COMMISSION /s/ Robert L. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: May 11, 1959 The attached petition of Charles and Katherine Cataldo, and others, to rezone land located on Lincolnway East between Twyckenham Drive and Caroline Street as follows: Lots Numbered 1 (1504 Lincolnway East), 2 (1508 Lincolnway East, 3 (1512 Lincolnway East), 4 and 5 (1514 Lincolnway East), 6 (1520 Lincolnway East), and 7 (1528 Lincolnway East as shown on the recorded plat of Clapp's Subdivision, and Lot Numbered 1 as shown on the recorded plat of Major's Addition to the City of South Bend, said parcel of land lying directly north of Lots 1 -7, inclusive, Clapp's Sub- division, from "b" Residential Use and "A" Height and Area District to "C" Commercial Use and "C" Height and Area District was legally advertised on April 27, 1959 and given public hearing on May 7, 1959. The following actiat was taken': After due consideration the Commission found that: 1. The commercial zoning of subject property would constitute strip zoning. 2. That both sides of Lincolnway East from Caroline Street east to the city limits was now zoned to allow commercial use, yet the predominant use is residential, thus clearly indicating the lack of demand or need for additional commercial zoning. 3. That in the opinion of the Commission a part of the subject area, constituting almost half the front footage of the petition area and being specifically Lot No. 1, Major's Addition, is now in violation of Ordinance #3702, the Zoning Ordinance. It was therefore duly moved, seconded and unanimously carried that the petition be recommended unfavorably to the Common Council. Very truly yours, CITY'PLANNING COMMISSION /s/ Robert L. REPORT OF CITY PLANNING COMMISSION The'Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: May 11, 1959 The attached petition of Iiilton Construction Company to annex to the City of South Bend a parcel of land containing 7.97 acres, more or less, lying on the north side of Ireland Road and approximately 2,640 feet east of Miami Road, bounded on the west and north by the present city limits was legally advertised on April 27, 1959 and given public hearing on May 7, 1959. The following action was taken: After_ due consideration the Commission found that in their opinion the proposed Annexation meets the criteria of the annexation statute of 1955 and is needed for the proper and logical development of the entire Broadmoor Addition. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY: To the Common Council May 11, 1959 Attached is a reply to the Board of Public Works and Safety from Mr. Dan W. Sabo Dear Mr. Sabo: Reply is made to your letter of April 16, 1959, requesting work projects referred from the South Bend Common Council. The following is the action taken: 1. Councilman Glass' request on the alley in the rear of 916 Roberts Street. Work has been completed. The alley was filled with gravel and graded to permit as much drainage as possible. No difficulties exist in the use of garages by residents of this area. 2. Councilman Tellson's request for checking of the crosswalk at the alley adjacent to 1101 E. Madison. We have surveyed this alley and have taken whatever corrective measures possible. The crosswalk is too high to permit proper drainage from the alley. However, a petition for paving of this alley is now in circulation under Barrett Law and seems reasonably sure of success. The paving of this alley will eliminate any problems that now exist. We are reluc- tant to rip out and lower the entrance to this alley if this paving project is being contem- plated. We have patched the crosswalk as well as possible. 3. Councilman Erler's request to correct broken pavement and elimination of water at 3314 and 3318 Addison Street. This work has been completed and situation corrected. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA.' (West Ewing Avenue) The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion that the Ordinance be set for public hearing on May 25, 1959. Councilman Erler seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Eddy and Jefferson Boulevard) The Ordinance was given first reading by title and second reading in full. Councilman Erler made a motion that the Ordinance be set for public hearing on May 25, 1959. Councilman Christman seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY CONTIGUOUS THERETO (Broadmoor) The Ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the Ordinance be set for public hearing on May 25, 1959. Councilman Erhardt seconded the motion. Motion carried. Councilman Kroll asked that the Committee of the Whole remain after the meeting to have a closed meeting in regard to the Clay Township Annexation. The Councilmen all agreed to remain. There being no further business before the Council, Councilman Kroll made a motion to adjourn. Councilman Hahn seconded the motion. Motion carried and the Council meeting adjourned at 8 :25 P.M.
