Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council
Chambers, City Hall, South Bend, Indiana, on Monday, April 27, 1959, at 8 :48 P.M., with all members present. The
meeting was called to order by President Stanley C. Korpal, who presided.

PRESENT: Councilmen Korpal, Erhardt, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski.
ABSENT: None.
MINUTES
Report of Committee on.Minutes:
To the Common Council of the City of South Bend, Indiana:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected
the minutes of the previous meeting of the Council and found them correct. They therefore -recommend that the same
be approved.

Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Hahn seconded the
motion. Motion carried.
REPORT OF THE COMMITTEE OF THE WHOLE
To the Common Council of the City of South Bend:
Your Committee of the Whole, to whom was referred AN ORDINANCE FIXING THE ANNUAL SALARIES, PAYABLE FROM THE GENERAL
FUND, FOR OFFICERS OF THE CITY OF SOUTH BEND TO BE ELECTED FOR THE TERM COMMENCING JANUARY 1, 1960 AND FIXING THE
TIME WHEN THE SAME SHALL TAKE EFFECT, Respectfully report that they have examined the matter and that in their
opinion it should be reported favorable as amended.

Councilman Erler made a motion that the report be accepted and placed on file. Councilman Kroll seconded the motion.
Motion carried.
ORDINANCE NO. 4263 - - -59
AN ORDINANCE FIXING THE ANNUAL SALARIES, PAYABLE FROM THE GENERAL FUND
FOR OFFICERS OF THE CITY OF SOUTH BEND. TO BE ELECTED FOR THE TERM
COMMENCING JANUARY 1, 1960 AND FIXING THE TIME WHEN THE SAME SHALL TAKE
EFFECT.
The Ordinance was given third reading and passed by a roll call vote of 7 ayes (Councilmen Korpal, Erhardt, Tellson,
Kroll, Glass, Hahn and Muszynski), 2 nays (Councilmen Christman and Erler).

April 24, 1959
The attached petition of Phyllis M. Anderson to rezone the property at 2201 Lincolnway West from "B" Residential Use
to "C "Commercial Use and "A" Height and Area District was legally advertised on March 23, 1959 and given public
hearing on April 2, 1959. The following action was taken:
After due consideration the Commission found that subject property was entirely surrounded by residential land use
and that the entire general area is zoned residential; therefore the granting of the petition would result in spot
zoning. It was therefore duly moved, seconded and unanimously carried that the petition be recommended unfavorably
to the Common Council.

zone real estate
Dear Mrs. Noble:
In view of the fact that the South Bend Plan Commission acted unfavorably in the Petition to rezone: Lot Number 11
(11) in Mayr's Michigan Avenue Addition to the City of South Bend, St. Joseph County, Indiana, and more commonly
described as a vacant lot located at 2201 Lincolnway Nest, South Bend, St. Joseph County, Indiana, we respectfully
request that you withdraw our Petition.
It will therefore be unnecessary to submit the Petition for a hearing before the Common Council.

IICouncilman Hahn made a motion that the report be accepted and placed on file. Councilman Erhardt secm ded the (I
motion. Motion carried.
OLD BUSINESS:
Councilman Muszynski requested information as to what had transpired in the County Court on the hearing of the
Bremen Iron and Metal Company Junk yard injunction. City Attorney Smith stated that on April 24, 1959, at which
time the restraining Order was continued as a temporary injunction, a request was made that an answer be filed.
The answer will be filed this week and a hearing will be had thereon as quickly as possible.
NEW BUSINESS:
Councilman Kroll made a motion that the Council go on record as Congratulating Mr. and Mrs. Stanley C. Korpal,
on the occasion of their twenty - fifth wedding anniversary, which they will celebrate on April 28, 1959. Councilman
Muszynski seconded the motion. Motion carried by a standing vote.
There being no further business before the Council, Councilman Hahn made a motion to adjourn. Councilman Tellson
seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 8 :57 P.M.
