HomeMy WebLinkAbout03-09-59 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, Monday, March 9, 1959, at 8 :12 P.M., with all members present except Councilman Glass. The meeting was called to order by President Stanley C. Korpal, who presided. ROLL CALL: PRESENT: Councilman Korpal, Erhardt, Tellson, Christman, Kroll, Hahn, Erler and Muszynski. ABSENT: Councilman Glass. MINUTES: Report of Committee on Minutes To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Kroll seconded the motion. Motion carried. PETITION Petition of Phyllis M. Anderson, Executrix of the estate of Harry D. Weaver, deceased, for the rezoning of Lot 11 Mayr's Michigan Avenue Addition, located at 2201 Lincolnway West. Councilman Hahn made a motion that the petition be referred to the City Planning Commission. seconded the motion. Motion carried. COMMUNICATION: Members of the City Council City Hall South Bend, Indiana Gentlemen: February 24, 1959 The River Park Business Men's Association by action taken on Monday night February 23, 1959 want to thank the members of the City Council for approving funds out of the Bond issue for the repairing of the streets in South Bend. Councilman Kroll seconded the motion. Motion carried. ORDINANCE NO. 4261 - - -59 AN ORDINANCE RATIFYING, APPROVING AND CONFIRMING THE TRANSFER AND CONVEYANCE BY THE MUNICIPAL CITY OF SOUTH BEND FOR THE USE OF ITS PARK DEPARTMENT AND /OR BOARD OF PARK COMMISSIONERS OF VACANT REAL ESTATE ON NORTHSIDE BOULEVARD WHICH IS NO LONGER USED OR USEFUL FOR MUNICIPAL PURPOSES TO THE TRUS- TEES OF INDIANA UNIVERSITY, A BODY POLITIC, IN ACCORDANCE WITH THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1951, CHAPTER 72, PAGE 178, AND AUTHORIZING THE EXECUTION -OF A DEED OF CONFIRMATION THEREOF. The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion that the 94 IEGULAR MEETING MARCH 9, 1959 Ordinance be set for Public Hearing on March 23, 1959. The Council was advised by the City Attorney that this was not an appropriating Ordinance and did not require public hearing. Mr. Kroll withdrew his motion. Councilman Hahn made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion _carried by a roll call vote of 8aye, 0 nays, 1 absent (Councilman Glass). The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). ORDINANCE NO. 4262 - - -59 AN ORDINANCE APPROVING AN AGREEMENT EXECUTED BY THE BOARD OF PUBLIC WORKS OF THE MUNICIPAL CITY OF SOUTH BEND WITH THE STATE HIGHWAY DEPARTMENT OF INDIANA FOR FIFTY PER CENT PARTICI- PATION OF THE MUNICIPAL CITY OF SOUTH BEND FOR THE CONSTRUCTION OF STATE PROJECT 82 (D)ON STATE ROAR 2 (Western Avenue) FROM MAPLE STREET EAST TO 0.02 MILE' EAST OF TAYLOR STEET IN THE CITY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Christman seconded the motion. Motion carried by a roll call vote of 8ayes, 0 nays, 1 absent (Councilman Glass). The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). RESOLUTION: See opposite page. OLD BUSINESS Councilman Kroll made an oral report of the Transportation Committee meeting with the Traffic Engineer in regard to removal of two hour parking signs in the vicinity of the Studebaker Packard Corporation. Mr. Ray Andrysiak, City Engineer, reported on progress being made by the Railroad Companies relative to repairing crossings. He said that the Prairie Avenue, Kemble and Walnut crossings should be started this week and that the Twyckenham Drive and Ironwood Drive (at St. Anthony's School) would be started in the near future. There being no further business to come before the Council, Councilman Hahn made a motion to adjourn.. Councilman Kroll seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 8:41 P.M. ATTEST: CLERK PRES 95 REGULAR =-MEETING RESOLUTION . MARCH 9, 1959 COUNCILMAN ERLER presented the following Resolution: R E S O L U T I O N WHEREAS, God, in his Infinite Wisdom, has called from this life, MRS. ADOLPH DUTRIEUX, the Mother of J. CHARLES DUTRIEUX, Chief of Police of South Bend, Indiana; and, WHEREAS, her death has brought much grief and sorrow to her family, relatives and many friends. NOW, THEREFORE, BE IT RESOLVED, That we, the Common Council of the City of South Bend, do hereby extend to the entire family of Mrs. Adolph Dutrieux, our sincere sympathy in this, their deepest hour of sorrow; and, BE IT FURTHER RESOLVED, That a copy of this Resolution, duly certi- fied by the Clerk, be sent to her husband, Adolph Dutrieux, and her son, J.
