Home My WebLink About01-12-59 Council Meeting MinutesREGULAR MEETING JANUARY 12, 1959 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers on Monday, January 12, 1959, at 8 :15 P.M., with all members present. The meeting.was called to order by President Stanley C. Korpal, President, who presided. POT.T_ (..AT.T.• PRESENT: Councilmen Korpal, Erhardt, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski ABSENT: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Minutes of Meeting of December 22, 1958 and January 5, 1959. Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Kroll seconded the motion. Motion carried. COMMUNICATION: The Common Council City of South Bend Honorable Body: January 2, 1959 The League of Women Voters of South Bend has for two years studied Public Health and Safety. Prior to that, Zoning and City Planning, Municipal Collection of Garbage and Trash and other related subjects. These remain continuing responsibilities.and our committees work on them. This year Slum Clearance and Urban Renewal has been our specific study. On May 23, 1948 the Building Commissioner, Mr. Verner Lane, submitted an ordinance on minimum standards for buildings ti the City Clerk for consideration and adoption by the City Council. After meeting with members of the Council and making some changes, .it was reinstated July 24, 1958. Again no action was taken to bring this to the Council floor for first o.nd second reading and public hearing. A good minimum standards ordinance is a necessary tool in the Slum Clearance and Urban Renewal program as well as the general health and welfare of the entire City. We therefore urge this Honorable body to sign this ordinance and bring it to the Council floor for adoption. Councilman Christman seconded the motion. Motion carried. COMMUNICATION The Common Council City of South Bend Honorable Body: January 2, 1959 The League of Women Voters'study of Urban Renewal and Slum Clearance brought consensus that responsibility and authority should be in one department, namely, the Building Department. The Heating Contractors Association asked that the Heating Department be incorporated with the Building Department. An Ordinance to effect this was submitted by Mr. Verner Lane, Building Commissioner, signed by Mr. Christman, Councilman for the 1st District, and put on the October 22, 1958 agenda. No further action was taken. We ask you to bring this to the Council floor for adoption. Councilman Erler seconded the motion. Motion carried. DEPARTMENTAL REPORTS A copy of the Annual Report of the City Planning Commission was filed with the Council. Councilman Muszynski made a motion that the Report be accepted and placed on file. Councilman Kroll seconded the motion. Motion carried. REPORT OF GRIEVANCE COMMITTEE Councilman Kroll reported on actions taken relative to xhe Junk yard on Dunham Street, He stated that they have found more things to be considered and that a meeting will be held during the next week and a report ready for the next meeting of the Council, REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE AMENDING ORDINANCES N0. 2243 AND NO. 3208, COMMONLY KNOWN AS THE BUILDING CODE OF THE CITY OF SOUTH -BEND, INDIANA, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED FAVORABLE. /s/ Joseph T. Kroll, Chairman. Councilman Hahn made a motion that the report be accepted and placed on file. Councilman Kroll seconded the motion. ORDINANCE NO. 4254 - - -59 AN ORDINANCE AMENDING ORDINANCES NO. 2243 AND NO. 3208, COMMONLY KNOWN AS THE BUILDING CODE OF THE CITY OF SOUTH BEND, INDIANA, The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays, ORDINANCE NO. 4255 - - -59 AN ORDINANCE TO AMEND ORDINANCE NO. 2135 (Bus) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4256 - - -59 AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1951. The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion that the Ordinance be set for Public Hearing on January 26, 1959. Councilman Erhardt seconded the motion. There was no vote taken on the motion as Councilman Hahn made a motion for suspension of the rules. Then, Councilman Kroll withdrew his motion for Public Hearing and Councilman Erhardt withdrew his second to the motion, Councilman Tellson seconded the motion for suspension of rules. Motion carried by,a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. OLD BUSINESS: Councilman Hahn asked what had been done about a traffic light at the corner of Twyckenham Drive and McKinley Highway. He asked that a check be made with the Traffic Engineer and a report be made at the next meeting of the Council, Councilman Kroll stated that there would be a meeting in regard to intra -city truck traffic Thursday at 8P.M, in the Police Classroom. T03; REGULAR MEETING JANUARY 12, 1959 NEW BUSINESS: Councilman Christman made a motion that the traffic committee study the situation about car - fleets being charged for overtime parking tickets in Cafeteria Court, and if possible have information to turn over to the Ordinance Committee for an Ordinance covering this matter. Councilman Muszynski seconded the motion. Motion carried. Councilman Tellson asked about the Fire Code and its application to inspections of schools. Mr. Smith, City Attorney stated that the Mayor had ordered an inspection each week by the Fire Department and they are to make recommendations when necessary and they are to see that these recommendations are followed. Councilman Hahn asked that the chairs be purchased for the Clerks. There being no further business before the Council, Councilman Kroll made a motion to adjourn. Councilman Hahn s ed the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 8 :51 P.M.
