DECEMBER 8, 1958 REGULAR MEETING Be it remembered that the Common Council of the City of South Beryl, Indiana., met in Regular Session in the Council Chambers in the City Hall, on Monday, December 8, 1958 at 8 :45 P.M. The meeting was called to order by President Stanley C. Korpal, who presided. All Councilmen were present. ROLL CALL: PRESENT: Councilmen Korpal, Erhardt, Tellson, Christman, Kroll, Glass, Hahn, Erler and 1Suszynski. ABSENT: None. MINUTES: Report of Committee on Minutes: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision recommend that thepsamedbe the minutes of the previous meeting of the Council approved. /s/ Stanley C. Councilman Muszynski made a motion that the Report be accepted and,placed on file. Councilman Glass seconded the motion. Motion carried. COMMUNICATION Communication from the League of Women Voters relative to blighted areas and slum clearance. Councilman Muszynski made a motion that the communication be accepted and placed on file. Councilman Kroll seconded .the motion. Motion carried. COMMUNICATION MEMO TO: Mrs. Freda Noble, City Clerk SUBJECT: Meeting of Railroad Officials December 8, 1958 Will you please remind the Councilmen at the meeting tonight that there will be a meeting of all railroad officials to discuss the condition of the crossings and right of way in South Bend, on Thursday, December 11th at 1 :30 P.M., in the Council Chambers. ORDINANCE, THIRD READING AN ORDIN..ANCE TO AMEND ORDINANCE NO. 3702,"AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Lincolnway West West of Sheridan & North of Elwood) Councilman Kroll made a motion that the Third Reading on the above Ordinance be set over until December:22, 1958. Councilman Erhardt seconded the motion. Motion carried. ORDINANCE NO. 4252 - -58 AN ORDINANCE OF TIE CITY OF SOUTH BEND, INDIANA, APPROPRIATING THE SUM OF ONE MILLION DOLLARS ($1,000,000.00) - TO BE- APPLIED TO THE COST OF CONSTRUCTION, RE- CONSTRUCTION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH, AS AMENDED. The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF CITY PLANNING COMMISSION: The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: December 8, 1958 The attached petition of Edward and Virginia Buszkiewicz to rezone Lot 2 in Wooded Estates, generally described as the Southwest corner of Ironwood Road and Oak Park Drive, from "A" residential Use District to "C" Commercial Use District was legally advertised on 24 November 1958 and given public hearing on 4 December 1958. The following ac- tion was taken: After due consideration the Commission found that commercial use of subject area would be an unwarranted intrusion into a residential area. It was therefore duly moved, seconded and unanimously carried that the petition be recommended unfavorably to the Common Council. Very truly yours, CITY PLANNING COMMISSION /s/ Robert L. RESOLUTION AUTHORIZING CERTAIN PAYMENTS TO BE MADE TO SALARIED EMPLOYEES OF THE CITY OF SOUTH BEND INDIANA WHEREAS, the City of South Bend, Indiana, is approaching the close of its fascal year; and, WHEREAS, the office of the City Controller will be required to make numerous payments and close its numerous and complicated accounts; and, WHEREAS, it is desirable that the work of said office be simplified; i NOW, THEREFORE, BE IT RESOLVED by the Common Council-of the City of South Bend, Indiana: !� SECTIONI: That all salaried officers and employees of the City shall be paid their salaries for the month of Dec,%� Ulm REGULAR MEETING ber, 1958, on the 20th day of said month. DECEMBER 8, 1958 _SECTION II: The Controller of the City of South Bend is hereby authorized to make said salary payments upon said date. SECTION III: This Resolution shall be in full force and effect from and after its passage by the Common Council and approval by the mayor. /s/ William A. Motion carried by a roll call vote of 9 ayes, 0 nays. Resolution adopted. OLD BUSINESS Councilman Kroll made a motion, seconded by Councilman Muszynski, that the City License for the Bremen Iron and Metal Company be withheld until investigations can be made in regard to numerous complaints against the company. Also, that the matter be referred to the Board of Public Works and Safety. Motion carried. Mrs. John Cackley, Mrs. Elmer Navarre and others from the League of Women Voters inquired about sub - standard dwell and asked that a list be made of those which have been investigated. Councilman Kroll made a motion that the Building Commissioner, Verner Lane, appear before the Council at their next meeting, December 22, to make a report on sub- standard dwellings; said report to include how many dwellings have been demolished and how many have been brought up to standard within the past two and a half years. Councilman Muszynski seconded the motion. Motion carried. Councilman Christman made a motion to add to Councilman Kroll's Motion, that Mr. Lane also show in his report the homes owned by absentee owners, as well as the ownership of sub- standard dwellings under inspection. Councilman Muszynski seconded the motion. Motion carried. Councilman Muszynski made a motion that the Board of Public Works and Safety direct the Police Department to enforce the Inter -City Truck Route Ordinance Immediately. Councilman Kroll seconded the motion. Motion carried. NEW BUSINESS: In Re: Election of Chairman of Committee of the Whole. Councilman Erhardt nominated Councilman Joseph Kroll. Councilman Erler moved that the nominations be closed. Councilman Muszynski seconded the motion. Motion carried. Councilman Erler made a motion that the Clerk be instructed to cast an unanimous ballot for Councilman Kroll. Councilman Hahn seconded the motion. Motion carried. Councilman Kroll made a motion that Verner Lane, the Building Commissioner give a report of what has been done on sub - standard housing during the past year, and to be present at the December 22nd meeting of the Council to explain his report and answer any questions. Councilman Muszynski seconded the motion. Motion carried. Councilman Christman mentioned the fact that many of the homes are owned by absentee owners and asked that owners be listed as well as the homes; and not only the owners on Sample Street by any other areas under investigation. Councilman Glass made a motion that the City Attorney study the Motor- Scooter Ordinance received from Aurora, Illino and that a similar ordinance by drafted an presented at the meeting of December 22nd. Councilman Christman second( the motion. Motion carried. There being no further business before the Council, Councilman Hahn made a motion to adjourn. Councilman Erler seconded the motion.
