Chambers, Tuesday, October 14, 1958, at 7 :14 P.M., with all members present except Cow- ng was
called to order by President Stanley C. Korpal, who presided.
ROLL CALL:
PRESENT: Councilmen Korpal, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski.
ABSENT: Councilman Carr.
REPORT OF COMMITTEE ON MINUTES:
To the Common Council of the City of South Bend, Indiana:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected'-the minutes of the previous meeting of the Council and found them correct. They therefore recommend that
the same be approved.

Councilman Hahn made a motion that the report be accepted and placed on file. Councilman Kroll seconded
the motion. Motion carried.
REPORT _'OF THE CITY PLANNING COMMISSION
The Honorable Common Council
City of South Bend
South Bend, Indiana
Gentlemen:
October 14, 1958
The attached petition of George Cassell, et al, to rezone the following described property: Lots 10 and 11, Miami
Heights, being 2322 and 2318 Miami Street, and Lots 4 -6, inclusive, of Charles Weidler Addition, being 2313 , 2317 a
2321 Miami Street, from "A" Residential Use District to "C" Commercial Use District and "C" Height and Area District
was legally advertised on 22 September 1958 and given public hearing on 2 October 1958. The following action was
taken:
After due consideration the Commission found that the granting of the petition would permit
an unwarranted encroachment of a commercial use in a residential neightborhood. It was
therefore duly moved, seconded and unanimously carried that the petition be recommended un-
favorably to the Common Council. 0

Councilman Erler made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion.

The attached petition of Dorothy Garland, et al, to'zone the following described property "C':' Commercial Use District
and "E" Height and Area District: Beginning at the Northeast corner of the Southeast Quarter of Section 25, T37N,
R3E, thence West along the centerline of Ireland Road 200 feet; thence South 200 feet; thence East 200 feet to the
Centerl -Ine of Miami Street; thence North 200 feet to the place of beginning, generally described as the Southwest

corner of Ireland Road and Miami Road was legally advertised on 22 September 1958 and given public Ye aring on 2
October 1958. The following action was taken:

After due consideration the Commission found that commercial zoning of subject property might
possibly be desirable in the future as part of a general plan of development of a larger area,
but that the granting of the subject petition at this time would constitute undesirable spot
zoning. It was therefore duly moved, seconded and unanimously carried that the petition be
recommended unfavorably to the Common Council.

Councilman Glass made a motion that the report of the City Planning Commission be accepted and placed on file. Counci
man Erler seconded the motion. Motion carried.

On the 22nd day of August, 1958, Dorothy K. Garland, Rose Miller, and Place and Company, Inc., filed with you a .
petition to zone certain property at the Southwest corner of Miami and Ireland Road, South Bend, Indiana, as "C"
Commercial. South petition was accompanied by a proposed amendment to the Zoning Ordinance.
As the Attorney for Dorothy K. Garland, Rose Miller and Place and Company, Inc., I hereby on their behalf withdraw
such petition.

Councilman Erler made a motion that the communication be accepted and placed on file. Councilman Hahn seconded the
motion. Motion carried.
ORDINANCE, FIRST AND SECOND READING:
AN ORDINANCE TRANSFERRING FROM BUILDING DEPARTMENT ACCOUNT M- 261 - DEMOLITION OF
CONDEMNED BUILDINGS $150.00 TO ACCOUNT MB-334-OTHER GARAGE AND MOTOR SUPPLIES;
AND FROM POLICE DEPARTMENT ACCOUNT P -11 - SERVICES PERSONAL $1,400.00 TO ACCOUNT
P -262- MEDICAL, SURGICAL AND DENTAL $600.00, TO ACCOUNT P -23 - INSTRUCTION $400.00,
AND TO ACCOUNT P -333 - TIRES AND TUBES $400.00; AND FROM FIRE DEPARTMENT ACCOUNT
Q -11 - SERVICES PERSONAL $1,100.00 TO ACCOUNT Q -712 - OTHER STRUCTURES, ALL OF THE
BUDGET FOR THE YEAR 1958 OF THE CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING
AN EXTRAORDINARY EMERGENCY.
The Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the
Ordinance be set for public hearing on October 27, 1958. Councilman Kroll seconded the motion. Motion carried'.
ORDINANCE, FIRST AND SECOND READING:
AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $100.00 TO OFFICE OF CITY JID GE
ACCOUNT NO. E -216B Travel Expenses - Probation Officer, ALL OF THE BUDGET FOR THE
CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1958, AND DECLARING AN EXTRAORDINARY EMERGENCY.
The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion that the
Ordinance be set for public hearing on October 27, 1958. Councilman Hahn seconded the motion. Motion carried.
There being no further business before the Council, Councilman Hahn made a motion to adjourn. Councilman Kroll
seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 8 :28 P.M.
