The meeting was called to order by President Stanley C. Korpal, who presided. ROLL CALL: PRESENT: Councilman Korpal, Carr, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have in- spected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Stanley C. Korpal Julius B. Christman, Jr. ;Committee George W. Carr Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. PETITIONS: Petition of Dorothy Garland and others to zone recently annexed land at Miami and Ireland Roads. Councilman Muszynski made a motion that the petition be referred to the City Planning Commission. Councilman Carr seconded the motion. Motion carried. PETITION: Petition of Hartman Builders, Inc., to rezone land on Lincolnway West. Councilman Hahn made a motion that the petition be referred to the City Planning Commission.. Councilman Carr second- ed the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE: To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE TRANSFERRING FROM CITY PLAN COMMISSION ACCOUNT NO. 241 - ADVERTISING AND PUBLICATION OF NOTICES, $5P.00; ACCOUNT NO. 242 - PRINTING, OTHER THAN OFFICE SUPPLIES, $80.00; ACCOUNT N0. 331 - Gasoline, $50.00; ACCOUNT NO. 51 - INSURANCE AND PREMIUMS, $195.00: AND ACCOUNT NO. 725 - OFFICE EQUIPMENT, $350.00, TO CITY PLAN COMMISSION ACCOUNT NO, 41 - BUILDING $250.00, AND ACCOUNT NO. 721 - FURNITURE AND FIXTURES, $475.00, ALL OF THE BUDGET FOR THE YEAR 1958 OF THE CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED favorable. /s/ George W. REPORT OF THE COMMITTEE OF THE WHOLE: To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE TRANSFERRING FROM THE PARKING METER FEES AND FUNDS THE SUM OF X15,250.00 TO THE GENERAL FUND, Respectfully report that they have examined the matter and that in their opinion IT'SHOULD BE REPORTED Unfavorable. /s/ George W. Carr, Chairman Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Kroll seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE: To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $15,250.00 TO DEPARTMENT OF PUBLIC WORKS AND SAFETY, SERVICES CONTRACTUAL, ACCOUNT NO. H266 PARKING SURVEY, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1958, AND DECLARING AN EXTRAORDINARY EMERGENCY, Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED Favorable. /s/ George W. REGULAR MEETING SEPTEMBER 8, 1958 REPORT OF THE COMMITTEE OF THE WHOLE: To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $79.82 TO OF- FICE OF CITY JUDGE ACCOUNT NO. E -725 OFFICE EQUIPMENT (Two floor fans) ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1958, AND DECLARING AN EXTRAORDINARY EMERGENCY. Respectfully report that they have examined the matter and that in their opinion IT SHOULD BE REPORTED Favorable. /s/ George W. The Ordinance was given third reading and passed by a roll call vote of 9 ayes, O nays. ORDINANCE, FIRST AND SECOND READING: AN ORDINANCE APPROVING THE CONTRACT BETWEEN BOARD OF WATER WORKS COMMISSIONERS OF THE CITY OF SOUTH BEND AND CLYDE E. WILLIAMS & ASSOCIATES, INC., DATED AUGUST 25, 1958, FOR . SURVEY AND STUDY OF WATER SUPPLY REQUIREMENTS. The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion for suspension of the rules. Councilman Carr seconded the motion. Motion lost by a roll call vote of 5 ayes, (Council- ' men Korpal, Carr, Tellson, Kroll and Muszynski), 4 nays (Councilmen Christman, Glass, Hahn and Erler). Councilman Kroll made a motion that the Ordinance be set for public hearing on September 22, 1958. .Councilman Hahn seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE AND SALE OF BONDS OF SAID CITY FOR THE PURPOSE OF PROVIDING FUNDS TO BE APPLIED TO THE COST OF CONSTRUCTION, RE- CONSTRUCTION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH. Councilman Christman moored that petitions to authorize issuance and sale of bonds be accepted and placed on .file. Councilman Kroll seconded the motion. Motion carried. Councilman Carr made a motion that the Auditor's Certificate be accepted and placed on file. Councilman Kroll second- ed the motion. Motion carried. The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion for suspen- sion of rules. Councilman Carr seconded the motion. Motion lost by a. roll call vote of 5 ayes, 4 nays. Councilman Kroll made a motion that the Ordinance be set for public heating on September 22nd. Councilman Tellson seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Muszynski made a''motion to adjourn. Councilman Tellson seconded the motion.
