HomeMy WebLinkAbout08-11-58 Council Meeting MinutesREGULAR MEETING AUGUST 11, 1958 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, Monday, August 11, 1958, at 8 :12, p.m. with all members present excepting Councilman Carr. The meeting was called to order by President Stanley C. Korpal, who presided. ROLL CALL: PRESENT: Councilmen Korpal, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski ABSENT: Councilman Carr REPORT OF COMMITTEE ON MINUTES: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have in- spected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Stanley C. Korpal Julius B. Christman, Jr. Committee Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Kroll seconded the motion. Motion carried. PETITIONS: Petitions bearing 131 signatures were filed with the Clerk petitioning the South Bend Common Council to exercise its legal authority to enact such legislation as is nessary to prohibit heavy industrial semi -truck vehicles from travel on their streets. The petition concerning S. Wellington Street contained 74 signatures, and the petition concerning S. Sheridan Street contained 57 signatures4 Councilman Muszynski made a motion that the petitions be referred to the Traffic Committee for study. Councilman Kroll seconded the motion. Motion carried. Petition of George .Cassell, et al, to rezone lots 4, 5, 6, 10, 11, and 12 in C. Weidler's ist Addition from t1B" Residential to "C" Commercial and "0" Height and Area, was read. Councilman Kroll made a motion to refer the peti- tion to the City Plan Commission. Councilman Hahn seconded the motion.. Motion carried. s 52 REGULAR MEETING REPORT OF BOARD OF PUBLIC WORKS AND SAFETY: To the Common Council: AUGUST 11, 1958 Attached please find a copy of a letter from the Pennsylvania Railroad Company with reference to watchman protection at its crossings in the City of South Bend; a report from Sgt. Podell of the Board of Health, in regards to chickens being raised in the City limits; and a letter from the Board of Public Works in regards to the status on the re- location of the signals and gates of the South Shore Railroad on Johnson and Orange Streets. Logansport, Indiana July 31, 1958 City of South Bend, Indiana Board of Public Works and Safety, Att;: Mr. Irving Smith, Chairman Dear Mr. Smith: I was very much surprised, on receiving your letter of July 21, 1958, to find a complaint of our having worked a crew at South Bend without the protection of a watchman. I do not know what specific date you have in mind or who made the complaint but at the time the regular crossing watchmen were taken off at South Bend, instructions were issed to our crews in general order #410, dated April 1, 1958, which instructed members of our crews to operate the flasher signals on the crossings so equipped and to manually flag the other crossings zhead of any movement over the crossings. I have checked with the members of the crews and the Yardmaster at South Bend to see that this protection was being furnished. I have also gone to South Bend personally on several Sundays and found that the crews were pro- viding the proper protection at the crossings. While the crossings are not being protected by the regular crossing watchman, they are being protected as prescribed by law by qualified members of our crews. If, for any reason, you should find a specific date and time of any such violation, I would be very happy ;to hear from you and will handle the matter immediately. Works and Safety, City Hall, South Bend, Indiana Dear Mr. Sabo: On August 4, 1958 Mr. M. Ezsol of 1238 Goodland was informed by me that all the chickens must be removed. He raised 12 chickens for a hobby particularly for his wife who is ill. Mr. Ezsol stated he didnt want trouble, and therefore, will cooperate. Sincerely, St. R. J. Podell, Sanitation Officer To the Common Council: The Board of Public Works and Safety received a_report from Traffic Engineer, Clem Hazinski, stating that his counts indicate that the signals that are now on Orange and Johnson Streets should be relocated at College and Orange Street The Chicago, South Bend and South Shore Railroad Company were informed by letter to proceed with this matter immediately. Councilman Kroll seconded the motion. Motion carried. SEWAGE TREATMENT PLANT REPORT: The annual report for the year 1957, of the Sewage Treatment Plant, was presented by Lou Bourden, Superintendent. Councilman Hahn made a motion that the report be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. AM REGULAR MEETING REPORT OF THE COMMITTEE OF THE WHOLE: To the Common Council of the City of South Bend: AUGUST 11, 1958 Your Committee of the Whole, to whom was referred AN ORDINANCE ANNEXING AND BRINGINE WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS ( IRELAND ROAD AND MIAMI ROAD) Respectfully report that they have examined the matter and that in their opinion it should be reported favorable. /s/ W. The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion that the Ordinance be set for public hearing on September 8, 1958. Councilman Christman seconded the motion. Motion carried. REGULAR MEETING ORDINANCE:NO 4240 -58: AN ORDINANCE APPROVING THE CONTRACT BETWEEN THE SOUTH BEND SEWAGE TREATMENT PLANT AND INTERNATIONAL HARVESTER COMPANY FOR ONE 1958 INTERNATIONAL TRUCK MODEL A -120 FOUR WHEEL DRIVE, 114 INCH BASE FOR $2,923.32''. AUGUST 11, 1958 The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion for suspen- sion of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 8 ayes, no nays, 1 absent The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, no nays, 1 absent. NEW BUSINESS: Councilman Tellson informed the Council that complaints had been received from residents of Gertrude Street about the number of large trucks using the Street. The Street is narrow and the pavement is not adequate for truck traffic Mr. Louis Nagy, 3307 Gertrude. Street, also spoke on the subject, and said heavy trucks use Gertrude Streetas a short cut from Rum Village Park. Councilman Tellson made a motion that the Traffic Engineer be requested to make a study of traffic on Gertrude Street and to determine the size of the tricks that can safely use Gertrude Street, and to post signs limiting the weight of trucks on the Street, if necessary. Councilman Muszynski seconded the motion. Motion Carried, and the Clerk was directed to refer the matter to the Board of Public Works and Safety. There being no further business before the Council, Councilman Hahn made a motion to adjourn. Councilman Tellson seconded the motion.
