The meeting was called to order by Presiden Stanley C, Korpal, who presided. ROLL CALL: PRESENT: Councilmen Korpal, Carr, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski ABSENT: None. REPORT OF COMMITTEE ON MINUTES: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have in- spected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved, Stanley C. Korpal Julius B.Christman, Jr. Committee G. W. Carr Councilman Glass made a motion that the report be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. PETITIONS Petitions bearing 514 Signatures were filed with the Clerk petitioning the South Bend Common Council to exercise its legal authority to enact such legislation as is necessary to prohibit heavy industrial semi truck vehicles from travel on their streets. The streets and number of signatures are as follows: South Illinois Street South Brookfield Street Lombardy Drive South Albert Street South Lake Street West Monroe Street South Chicago Street South Kenmore Street South Kentucky Street 74 signatures 59 signatures 34 signatures 66 signatures 115 signatures 24 signatures 30 signatures 68 signatures 44 signatures Also a Petition signed by Mrs. Hattie Grabarz, who canvassed South Illinois Street and asked that control be enforced II of speeding on Illinois Street. Councilman Muszynski made a motion that the petitions be referred to the Traffic Committee for study. Councilman Erle seconded the motion. Motion carried. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY: Report to Board of Public Works and Safety from Sgt. Richard Podell, Sanitation Officer: Dear Mr. Sabo: On July 14th, 1958 Councilman Christman asked that an investigation be made of a complaint that people are keeping chickens in their yard. The house is located off Lincolnway West, 2 blocks North and 2 blocks east of Eclipse. On:July 16th and 24th an investigation was made and the above directions lead to the corner of Meade and Elwood Stree I spoke to the neighbors at this location and none knew of chickens being kept in this vicinity. However, I believe that someone is keeping chickens in this neighborhood and the investigation is being continued.. After further information is received, a report will be submitted at the next Council Meeting. Sincerely. /s/ Sgt. R. J. REPORT OF CITY PLANNING COMMISSION: The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen? The attached petition of Dorothy Garland and Andrew Place to annex to the City of South Bend a parcel of land at the southwest intersection of Ireland and Miami Roads, described as 556 feet, more or less, south of said intersection, thence 1,195 feet, more or less, west, thence 556 feet, more or less, north thence 1,195 feet, more or less, east to the point of beginning, containing approximately 14.8 acres was legally advertised on 17 July 1958 and given public hearing under date of 28 July 1958. The following action was taken: After due consideration the Commission found that substantial justice would be done by the favorable recommendation of the petitinn. Common Council Civil City of South Bend, Indiana Gentlemen: Attached herewith are copies of the proposed Minimum Housing Ordinance, revised in accordance with your suggestions, as agreed upon at a recent special meeting with you, Mr. Sucher and myself. I hope you will find the revised Ordinance in accordance with your suggestionp, but wish to assure you that if you should desire further information or should wish to hold further meetings with Mr. Sucher and myself, we would be more than happy to cooperate in every way. However, if the Ordinance in its present form is satisfactory to you, we desire and respectfully request that it be introduced for consideration at the earliest possible date. The Clerk then read the headings of each Department and the grand total of each department, for second reading. Councilman Carr made a motion that the Ordinance be advertised on August 1st and August 8th, for Public Hearing on August 25th, 1958. Councilman Kroll seconded the motion. Motion carried. The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on August 11, 1958. RESOLUTION [WHEREAS, it is provided under the Acts of the General Assembly of the State of Indiana adopted in 1949, Chapter 157, Section 402, page 416, that upon the approval of the Common Council, the health officer may receive financial assistance from the State Government provided the conditions under which the grant is made are submitted to and approved by the State Board, and WHEREAS, the State Health Board has approved the granting of the sum of Five Thousand ($5,000.00) Dollars to the health officer of the City of South Bend for the use of the Health Department of the City of South Bend in its program for the aged. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend that it approve the receipt by the health officer of the City of South Bend for the Health Department of the City of South Bend in its program for the aged, the sum of Five Thousand ($5,000.00) Dollars from the State of Indiana Health Department. The President called for a roll call vote for the adoption of the Resolution. Resolution adopted by a roll call vote of 9 ayes, 0 nays. OLD BUSINESS: made a motion and Councilman Kroll, as Chairman of the Traffic Committee, /said he would ask Mr. Sabo to write to all Railroads to set up a meeting to discuss the repair of grade crossings within the City and to set a definite time limit of 30 days in which these grade crossings.must be repaired. Councilman Carr seconded the motion and suggested that the meeting with the Railroads be expedited within the next ten (10) days. Motion carried. The Clerk was directed to send a notice of the motion to Mr. Sabo, and also to Mr. Andrysiak, City Engineer. Councilman Glass requested that an addendum be drawn up to be attached to the lease between the Municipal City of South Bend and the Franternal Order of Police for the Police Pistol Range (Ordinance Number 4233), which should read as follows: "Lessee herein is authorized to tear down the structures now found on the premises, provided that Lessee should replace such structures with suitable structures subject to the approval of the Lessor ". (Mr. Smith to prepare this addendum and present it to the Board of Public Works and Safety for approval). Councilman Glass put the above in the form of a motion. Councilman Christman seconded the motion. Motion carried. There being no further business before the.Council, councilman Hahn made a motion to adjourn. Councilman Carr seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 9 :24 P.M.
