The meeting was called to order by President Stanley C. Korpal, who presided. ROLL CALL PRESENT: Councilmen Korpal, Carr, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski ABSENT: None MINUTES Report of Committee on Minutes To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. COMMUNICATION: WHEREAS, the Saint Joseph County Industrial Union Council, CIO comprises a substantial body of men and women with a vital stake in the continued progress and development of the South Bend Community; and WHEREAS, the development of a governmental center, as proposed, would greatly contribute to the beauty as well as indelibly imprint the stamp of progress on this comminity;:and WHEREAS, this wise plan can be achieved only throught the wholehearted cooperation of people in every walk of life, public and private; and WHEREAS, the Board of Library Trustees missed a golden opportunit to figure prominently in this com- munity development, and stood aloof and indifferent to�the challenge; and WHEREAS, the City of.-South'Bend has an= urban redevelopment pr gram presently underway which will fit perfectly into the planning for the development of the governmental center/ and r" WHEREAS, this ambitious plan demands concerted cooperative action immediately- -not at some time in the future -- BE IT THEREFORE RESOLVED by the Saint Joseph County Industrial Union Council that it endorses the plan for the development of a government center without reservations and call upon all governmental units to join forces forthwith for the determined effort that will be required to bring the plan to fulfillment. AND BE IT FURTHER RESOLVED that the Saint Joseph County Industrial Union Council will regard lack of cooperation on the part of any governmental units or responsible persons as evidence of disinterest in the common cause of continued progress and development of the South Bend community. No community can stand still. It is either progress or regression and the Saint Joseph County Industrial Union Council stands for progress. AND BE IT THEREFORE RESOLVED that copies of this resolution be sent to the Saint Joseph County Commissioners the South Bend and Mishawaka Common Council, The Mayors of South Bend and Mishawaka and the press. /s/ Stanley J. DEPARTMENTAL REPORTS REPORT OF TRAFFIC ENGINEER To the Common Council June 6, 1958 Ref: ray 26th Motion by City Council to investigate locations where bus service has been discontinued Gentlemen: Upon investigation of yellow painted curb space where bus service has been cut, I find that only one location has been discontinued completely. This is at the Jefferson Hotel, on Jefferson Blvd. just west of Main Street. However, since this space opens a lane for a heavy right turn onto Main Street, I will investigate further as to the advisability of locating two parking spaces at this curb. In areas where bus service has been curtailed, but not discontinued, I feel that it would be difficult to control parking when the curb spaces are actually necessary and would contribute to a hazardous condition to both motor vehicles and to passengers loading and unloading the bus, should the curb space be occupied by a violator. I believe that if motoristd were p*mitted to park in some yellow zones and not in others, it would.eventually lead to their disregard for those zones where there is a heavy usage by buses, thereby resulting in added hazards and congestion. REPORT OF CLERK OF BOARD OF PUBLIC WORKS AND SAFETY To the Common Council: June 9, 1958' In reference to your directive dated May 27, 1958, this office has contacted the executives of the Northern Indiana Transit Company regarding the exhaust of the busses operating in City of South Bend. Northern Indiana Transit Company informed this office that Rules and Regulations pertaining to exhaust pepes, window, doors, etc., are laid out by the Public Service Commission. ORDINANCE NO. 4230 AN ORDINANCE CONTROLLING THE OPERATION OF SELF - SERVICE LAUNDRIES, AS AMENDED. The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. REPORT OF CITY PLANNING COMMISSION: The Honroable Common Council, City of South Bend, South Bend, Indiana June 9, 1958 Gentlemen: The attached petition of Jack Lee Guyberson, 4031 South Michigan Street, to zone property located between Main and Michigan Streets and 200 feet, more or less, north of Albert Street, being recently annexed land to the City of South Bend, Indiana, to "C" Commercial Use District and "A" Height and Area District was legally advertised on May 26,' 1958 and given public hearing under date of 5 June 1958. The following action was taken: After due consideration the Commission found that substantial justice would be done by the favorable recommendation of the petition. REPORT OF THEc'CITY PLANNING COMMISSION: The Honorable Common Council City Of South Bend South Bend, Indiana Gentlemen: June 9, 1958 The attached petition of Edward and Virginia Buszkiewicz to rezone Lot Numbered 2 in Wooded Estates from "A "Resident Use District to "C" Commercial Use District and "A" Height and Area District was legally advertised on May 26, 1958 and given public hearing under date of 5 June 1958. The following action was taken: It was duly moved, seconded and unanimously carried that the withdrawal of said petition without prejudice be accepted by the Commission. Motion carried, ORDINANCE NO. 4231 AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules: Councilman Hahn seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes 0 nays. ORDINANCE NO. 4232 AN ORDINANCE TO CHANGE_THE NAME OF SEABURY DRIVE IN THE CITY OF SOUTH BEND TO ST, JOHNS WAY, The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion for suspension of rules. Councilman Carr seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $260.00 TO OFFICE OF CITY JUDGE ACCOUNT NO. E -725 OFFICE EQUIPMENT (Three floor fans and one table) ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA FOR 1958, AND DECLARING AN EXTRAORDINARY EMERGENCY The Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the Ordinance be referred to the Ordinance Committee for further study. Councilman Carr seconded the motion. Motion carried. ORDINANCE AN ORDINA= ANENDING SECTION 5.OF ORDINANCE`NO.,3743'ADOPTED APRIL 25, 1950, WHICH SAID ORDINANCE TITLE READS"AS'FOLLOWS; AN ORDINANCE PROVIDING FOR:.THE; ESTABLISHMENT OF A BUREAU OF FIRE PREVENTION, PROVIDING OFFICERS THEREFOR AND DEFINING THEIR POWERS AND DUTIES, PRESCRIBING REGULATIONS FOR FM PREVENTION AND LIFE SAFETY, AND PRESCRIBING RENAlTIESFOR "THE VIOLATION ;'01` .ITS PROVISIONS The Ordinance was given first reading by title-and second reading in full, Councilman Kroll made a motion that the Ordinance be referred to the Ordinance Committee for further study. Councilman Carr seconded the motion. Motion carried. OLD BUSINESS Councilman Muszynski announced that Railroad ;Grader<crossings in several parts of the City are in deplorable con- dition despite the letter received from the Board of Public Works and Safety at the last regular meeting of the Council stating the conditions to be corrected, The Clerk was directed to refer the matter to the Board of Public Works and Safety with a recommendation that a stronger letter be written to the Railroads demanding that the Railroads obey their contracts with the City which include the maintenance of all grade crossings. Councilman Kroll informed the Council that when a portion of Johnson Street was vacated, the Chicagg South Shore and South Bend Railroad promised to move their signals from Johnson Street to Brookfield Street. To date the signals have not been moved. The Clerk was directed to ask the Board of Public Works and Safety to remind the C.S.S.& SB, RR of this matter and have it corrected. 41 REGULAR MEETING JUNE 9, 1958 Councilman Tellson complained that rubbish and debris are being thrown into the St. Joseph River and down the river banks. Councilman Glass concurred with Councilman Tellson and cited instances namely, a building being torn down at 23rd Street and Mishawaka Avenue, with materials hauled to and dumped into the river, and also the Humping at the site of the Indiana University Extension Building on Northside Boulevard. Councilman Erler stated that fill dirt was being deposited on the banks at Twyckenham Drive and Lincolnway East to extend property. Councilman Carr made a motion that the Ordinance prohibiting the dumping of any rubbish in the river be enforced immediately. Councilman Muszynski seconded the motion. Motion carried and the Clerk was directed to notify the Police Department and the Board of Public Works and Safety of the action taken. Councilman Muszynski made a motion that the next Regular Meeting of the Council be held on July 14, 1958. Councilman Christman seconded the motion. Motion carried. There being no further business before the Council, Councilman Kroll made a motion to adjourn. Councilman Carr seconded the motion.
