Councilman Carr, Chairman, presided. ORDINANCE AN ORDINANCE ANNEXING LANDS TO AND DECLARING SAME TO BE A PART OF THE CITY OF SOUTH BEND, INDIANA (195.1 acres along Hickory Road between Edison and Hepler) Proponents and opponents were given an opportunity to be heard on this Ordinance. Mr. Louis Anderson, Attorney, spoke for the remonstrators and filed a petition bearing 47 signatures of land owners in the locality. He spoke against the Ordinance. Also remonstrating were James Sloderbeck, 54765 Hickory Road; Walter A. Rice, Attorney, Jack K. Davis, 17512 Bryan; Paul E. Gibbs, 17511 East Bryan. Councilman Kroll made a motion that the Ordinanance go to the Council as unfavorable. Councilman Hahn seconded the motion. Motion carried. ORDINANCE ORDINANCE ANNEXING LANDS TO AND DECLARING SAME TO BE A PART OF THE CITY OF SOUTH BEND, INDIANA (1.4 acres along Rose Street) Proponents and opponents were given an opportunity to be heard on this Ordinance. James Bratina, the sole owner of this tract of land, remonstrated against passage of the Ordinance. Councilman Korpal made a motion that the Ordinance go to the Council as unfavorable. Councilman Kroll seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, (REAL ESTATE INVOLVED LOCATED ON THE WEST SIDE OF SOUTH MICHIGAN STREET BETWEEN ECKMAN AND OAKSIDE STREET). Proponents and opponents were given an opportunity to be heard on this Ordinance. Councilman Kroll made a motion that the Ordinance be referred to the Ordinance Committee for further study. There was no second to the motion and Councilman Kroll withdrew his motion. Remonstrating were Mrs. A. V. Rogers, 2711 South Michigan Street and R. M. Kentz, 2913 South Michigan Street. Mr. Joseph G. Ettl, Attorney for petitioners spoke in favor of the Ordinance Mr. Walter Rice, Attorney, spoke in favor of the Ordinance. Councilman Kroll made a motion that the Ordinance be referred to the Ordinance Committee for further study. Councilman Glass seconded the motion. Motion carried. AN ORDINANCE TO PROHIBIT THE SALE OF BABY RABBITS, CHICKS, GOSLINGS, DUCKLINGS OR OTHER FOWL FOR NON- POULTRY PURPOSES, AS PLAYTHINGS, NOVELTIES OR FOR DECORATIVE PURPOSES. Proponents and opponents were given an opportunity to be heard on this Ordinance. Councilman Christman made a motion that the Ordinance go to the Council as favorable. Councilman Hahn seconded the motion. Motion carried. There being no further business before the Committee of the Whole, Councilman Korpal made a motion to adjourn. MINUTES: Report of Committee on Minutes: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would.respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. PETITION: Petition of Blenke Brothers to zone recently annexed land. Councilman Kroll made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Housing Authority for authority to issue Bonds, Notes, Interim Certificates, Debentures or other Evidences of Indebtedness. Councilman Carr made a motion that the petition be set for Public Hearing on April 28, 1958. Councilman Kroll seconded the motion. Motion carried. REPORT OF THE BOARD OF PUBLIC WORKS AND SAFETY: Common Council City of South Bend South Bend, Indiana Gentlemen: March 24, 1958 Refering to the directive dated March 10, 1958 from the Common Council pertaining to the removal of the bus from Beacon Heights, I wish to submit the following: A meeting was held between Mr. Anderson, Superintendent of Transportation for Northern Indiana Transit Company, and myself pertaining to this problem. Mr. Anderson stated that statistics show that fewer people are riding the buses on Saturday over this route necessitating the drastic cuts. This change was made in August, 1957. IN REGARD TO OFF- STREET PARKING ORDINANCE: Councilman Kroll made a motion that the Report of the City Planning Commission be referred back to the City Planning Commission because it does not conform to the thinking of the Council with regard to zoning. Councilman Carr seconde the motion. Motion carried. Following is a copy of the report which was read at the March 10th meeting: REPORT OF THE CITY PLANNING COMMISSION: 8 March 1958 The Honorable Common Council City of South Bend South Bend, Indiana We hereby petition your Honorable body to take appropriate action to amend Ordinance #3702 by the adoption of the attached ordinance relative to off - street parking and loading requirements. The attached ordinance amending Ordinance #3702 was legally advertised on 26 August 1957 and given public hearing under date of 5 September 1957. The following action was taken: After due consideration the Commission found that substantial justice would be done by the favorable recommendation of the ordinance. It was therefore duly moved, seconded and unanimously carried that the ordinance be recommended favorably to the Common Council. RLH /mah Attach. ORDINANCE NO. 4222 AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Western, Scott and Taylor -- Housing) MARCH 24, 1958 The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion for sus- pension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9ayes, O nays. OLD BUSINESS: Councilman Hahn stated that he had received complaints from persons living in the vicinity of Eddie's Restaurant, that the owners are using an adjacent lot, which-is zoned "A" Residential, for parking cars. The Clerk was directed to refer the complaint to the Building Department. Councilman Christman made a motion, seconded by Councilman Hahn that the Building Department and Board of Public Works and Safety, throught its Police Department, make an investigation of the unsightly condition and use which does not conform to the Bu lding Code at the filling station at the Northeast corner of South Bend Avenue and Saint Louis Boulevard, with a report back to the Council at the meeting April 28, 1958. The City Attorney, Mr. Smith, directed the Clerk to write to the Board of Public Works and Safety asking the Clerk to contact Mr. Parren Anderson of the Northern Indiana Transit Company, Inc., relative to attending a meeting in the Office of the Board on Monday, March 31, at 9:30 A.M., with Mr. Tellson, to discuss the matter of the Beacon Heights Bus. Councilman Hahn made a motion that the Regular meeting of the Council on April 14, 1958, be cancelled. Councilman Kroll seconded the motion. Motion carried. There being no further business before the Council, Councilman Muszynski made a motion to adjourn. Councilman Hahn seconded the motion.
