MARCH 10, 1958
Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council
Chambers, Monday, March 10, 1958, at 8:14 P.M., with all members present. The meeting was called to order by
President Stanley C. Korpal, who presided.
ROLL CALL:
PRESENT: Councilmen Korpal, Carr, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski.
ABSENT: None.
MINUTES:
Report of Committee on Minutes
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected
the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same
be approved.

Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Kroll seconded the
motion. Motion carried.
PETITION
Petition of John Pence to rezone land at the Northwest corner of Lincolnway West and Johnson Street.
Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Kroll
seconded the motion. Motion carried.

Gentlemen:
At our recent club meeting, our membership passed a motion opposing fluoridation of our city water.
Everyone who had anything to say, had an opportunity to be heard, and there were many and varied reasons to oppose
fluoridation ... but the often repeated reason was that with 11% of the working force of the community out of work and'
many on a reduced work week, it is hardly the time to be spending tax payers money on anything new, especially when
the end result is debatable.

Northern Indiana Transit Company February 24, 1958
South Bend, Indiana
Gentlemen:
Why have you taken the 9:10 bus off the Lincolnway and Beacon Heights line on Saturday Morning?
You know, we sales people all have to work Saturdays, and the way you have the Saturday schedule now, makes it
impossible for us to get to work on time or much too early to go to work.
Your Beacon Heights bus leaves at 9:20, the Ardmore leaves the end of the line at 9:15, both buses arriving down
town after 9:30.
Why can't you schedule the Beacon Heights bus the same as work days.
We are forwarding a copy of this letter to our city council.

The attached petition to annex to the City of South Bend a parcel of land beginning at a point on the centerline
of Rose Street 140 feet, more or less, west of the north -south centerline of Sec. 32, T37N, R3E, thence north
parallel with said north -south centerline a dinstance of 1290 feet, more or less, to the south line of Hepler
Street, thence east along the south line of Hepler Street a distance of 2809.6 feet, more or less, to the east line
of Hickory Road, thence north a distance of 20 feet, more or less, to the centerline of Hepler Street, thence
east along the centerline of Hepler Street extended a distance of 662.4 feet, more or less, thence south parallel
with the centerline of Hickory Road, a distance of 2670 feet, more or less, to the centerline of Edison Road,
thence west along the centerline of Edison Road, a distance of 2882 feet, more or less, thence north a distance
of 220 feet, more or less, thence east a distance of 77 feet, more or less, thence north a distance of 1110 feet,
more or less, thence west a distance of 635 feet, more or less, to the place of beginning containing approximately
195.1 acres was legally advertised on 27 January 1958 and given public hearing under date of 6 February, 1958.
The following action was taken:
After due consideration the Commission found that substantial justice would be done by the
favorable recommendation of the petition. It was therefore duly moved, seconded and unanimously
carried that the petition be recommended favorably to the Common Council.
The original ordinance of 178.8 acres has been changed by the Commission to read 195.1 acres.

Gentlemen:

The attached petition of property owners to zone from "B" Residential Use to "C" Commercial Use and "E" Height and
Area District lots numbered 8, 9 and a part of 10 of the St. Joseph County Agricultural Society Addition being
generally located on the southwest side of Portage Avenue north of Pierce Street and having 240 feet frontage
on Portage Avenue was legally advertised on 24 February 1958 and given public hearing under date of 6 March 1958.
The following action was taken:

After due consideration the Commission found that the granting of the petition would result
in spot zoning and was therefore illegal. It was therefore duly moved, seconded and unan-
imously carried that the petiton be recommended unfavorably to the Common Council.

REPORT OF CITY PLANNING COMMISSION:
The Honorable Common Council March 7, 1958
City of South Bend
South Bend, Indiana
Gentlemen:
The attached petition of Michael Ettl, et al, to zone from "B" Residential Use to "C" Commercial Use and "D" Height
and Area District lots numbered 25 -32, inclusive, of the Oakside 2nd Addition being on the west side of Michigan
Street between Eckman and Oakside Streets was legally advertised on 24 February 1958 and given public hearing under
date of 6 March 1958. The following action was taken:

After due consideration the Commission found that the commercial zoning of subject property
would extent undesirable strip zoning thus creating more traffic conflict, that there existed
in the immediate vicinity ample commercially zoned land on either side of Michigan Street that
was not now used commercially, and that substantial justice would be done by the unfavorable
recommendation of the petition.
It was therefore moved, seconded and unanimously carried that the petition be recommended
unfavorably to the Common Council.

We hereby petition your Honorable body to take appropriate action to amend Ordinance #3702 by the adoption of the
attached ordinance relative to off - street parking and loading requirements.
The attached ordinance amending Ordinance #3702 was legally advertised on 26 August 1957 and given public hearing
under date of 5 September 1957. The following action was taken:
After due consideration the Commission found that substantial justice would be done
by the favorable recommendation of the ordinance. It was therefore duly moved, seconded
and unanimously carried that the ordinance be recommended favorably to the Common Council.

Ordinance be set for Public Hearing on March 24, 1958. Councilman Kroll seconded the motion. Motion carried.

ORDINANCE ANNEXING LANDS TO AND DECLARING SAME TO
BE A PART OF THE CITY OF SOUTH BEND, INDIANA
(1.4 acres Rose Street - -Clay Township)
The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that
the Ordinance be set for public hearing on March 24, 1958. Councilman Kroll seconded the motion. Motion carried.

AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING
ORDINANCE NO. 3702 (Portage Avenue -- Leland and Pierce)
The Ordinance was given first reading by title and second reading in full. Councilman Christman made a motion that
the Ordinance be stricken from the record. Councilman Erler seconded the motion. Motion carried by a roll call vot
of 9 ayes, 0 nays.
AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY
KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH
BEND, INDIANA. (REAL ESTATE INVOLVED LOCATED ON
THE WEST SIDE OF SOUTH MICHIGAN STREET BETWEEN:
ECKMAN STREET AND OAKSIDE STREET)
The Ordinance was given first reading by title and second reading in full. Gouncilman Kroll,.made a- motion that the
Ordinance be set for Public Hearing on March 24, 1958. Councilman Muszynski seconded the motion. Motion carried.

AN ORDINANCE TO PROHIBIT THE SALE OF BABY RABBITS,
CHICKS, GOSLINGS, DUCKLINGS OR OTHER FOWL FOR
NON - POULTRY PURPOSES, AS PLAYTHINGS, NOVELTIES OR
FOR DECORATIVE PURPOSES.
The Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the
Ordinance be set for-public hearing on March 24, 1958. Councilman Muszynski seconded the motion. Motion carried.
There being no further business before the Council, Councilman Muszynski made a motion to adjourn. Councilman
Kroll seconded the motion. Motion carried and the Regular meeting of the Common Council adjourned at 8:41 P.M.
