COMMITTEE OF THE WHOLE MEETING REGULAR MEETING JANUARY 13, 1958 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers, Monday, January 13, 1958, at 8:14 P.M., with all members present except Councilmen Hahn and Erler. Councilman Carr, Chairman, presided. ORDINANCE AN ORDINANCE AUTHORIZING THE INCREASE OF SEWAGE SERVICE CHARGE TO ALL USERS FOR THE PURPOSE OF REPAIR AND/OR REPLACEMENT OF WATER SERVICE LINES AND SHUT -OFF BOXES WITHIN AND /OR UNDER PUBLIC PROPERTY Proponents and opponents were given an opportunity to be heard on this Ordinance. City Engineer Ray Andrysiak explained that a new Ordinance had been submitted to the Council for their consideration, inasmuch as the Ordinance previously submitted was not wholly agreeable to the Committee of the Whole. Mr. Andrysiak stated that the new Ordin- ance more fully covered the rights of all property owners and explained the changes. Chairman Carr then asked if anyone else wished to be heard. Councilman Kropal made a motion that the Original Ordinance be referred to the Council as unfavorable and the Ordinance which was substituted be referred to the Council favorably. .Councilman Kroll seconded the motion. Motion carried. ORDINANCE ORDINANCE ANNEXING LANDS TO AND DECLARING SAME.TO BE A PART OF THE CITY OF SOUTH BEND, INDIANA Proponents and opponents were given an opportunity to be heard on this Ordinance. Remonstrating were the following: Mr. H. Milkey, 55299 Hickory Road; John Van Vynck, 55411 North Hickory Road; Doyle Hood, 17054 East Edison Road; Mr. Laudeman, 55081 Hickory Road; Mrs. Harold Burket, 55071 Hickory Road; George Hochgesang, 17034 East Edison Road; Paul Harmon, 55115 Hickory Road; Gordon Shock, 55095 Hickory Road; Mrs. Pickett, 55061 Hickory Road; F. L. Murphy, 55085 Hickory Road; Mrs. Harold Kohler, 55316 Hickory Road. Mr. Ray Andrysiak, City Engineer, explained the proposed annexation. He clarified the question of services to be furnished by the City and stated that the fact that this area was annexed would not necessarily mean that sewers, etc., would be put in service at once. Councilman Korpah made a motion that the Ordinance go to the Council as favorable. Councilman Kroll seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (East Jefferson Boulevard - -36th Street) Proponents and opponents were given an opportunity to be heard on .this Ordinance. Councilman Korpal made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE ORDINANCE ANNEXING LANDS TO AND DECLARING SAME TO BE A PART OF THE CITY OF SOUTH BEND, INDIANA (OLIVE AND PRAIRIE) Proponents and opponents were given an opportunity to be heard on this Ordinance. Councilman Muszynski made a motion that the Ordinance go to the Council as favorable. Councilman Kroll seconded the motion,. Motion carried. ORDINANCE AN ORDINANCE TO AMEND ORDINANCE NO..3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA' (East Jefferson -- Whitmore Corporation) Proponents and opponents were given an opportunity to be heard on this Ordinance. Councilman Korpal made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded the motion. Motion carried. There being no< further business before the Committee of the Whole, Councilman Muszynski made a motion to adjourn. Councilman Kroh seconded the motion.
