St. PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski ABSENT: None RESOLVE INTO THE COMMITTEE OF THE WHOLE Council President Laven entertained a motion to resolve the Council into the Committee of the Whole on the state of the City to consider the items listed on the agenda for the considera- tion of the Committee of the Whole. Councilman Wise so moved and Councilman Craven seconded the motion. Motion carried. Time: 8:10 P. M. COMMITTEE OF THE WHOLE MEETING Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Com- mittee of the Whole in the Council Chambers of the County -City Building on Monday, July 12, 1971, at 8:11 P. M., all members present. The meeting was called to order by Chairman William W. Grounds, who presided. nPnTNAWrR AN ORDINANCE ESTABLISHING A SCHEDULE OF RATES AND CHARGES FOR SERVICES RENDERED BY THE WASTEWATER TREATMENT PLANT OF THE CITY OF SOUTH BEND TO AREAS OUTSIDE THE CORPORATE LIMITS OF THE CITY OF SOUTH BEND This being the time heretofore set for the continuation from the June 28, 1971 meeting on the above ordinance, proponents and opponents were given an opportunity to heard thereon. City Controller James Bickel said the ordinance was to fix sewage charges for residents outside the City. Councilman Laven made a motion, seconded by Councilman Szymkowiak, to change the figure from 120/ to 150°/. Motion carried. Councilman Laven made a motion, seconded by Councilman Szymkowia% that the ordinance go to Council favorable as amended. Motion carried. ORDINANCE AN ORDINANCE AMENDING CHAPTER 40 OF THE MUNICIPAL CODE OF ' THE CITY OF SOUTH BEND, INDIANA, 1963, ALSO KNOWN AS ORDI- NANCE NO. 3702 AS AMENDED, THE ZONING ORDINANCES OF THE CITY OF SOUTH BEND (123 East Ireland Road) This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Attorney Bruce Stewart stated the ordinance was to rezone from "A" Residential Use to "C" Commercial Use with no change from "A" Height and Area District for the demolition of the present gasoline service station and to construct a new building, install new landscaping and extend into the property to the east. The Area Plan Commission suggested that new plans show the drainage facilities and curb around the eastern portion of the property. The site plan presented to the Area Plan Commission on June 15, 1971 did not show drainage. They approved the rezoning subject to the petitioner showing the drywells on the site plan. Drawings were shown to the Council. Councilman Laven suggested that if the Area Plan Commission and City Engineer can accept this as it is, we could postpone the public hearing until later on in the meeting. Councilman Craven proposed that the item be moved down to after Item 7 and Councilman Grounds /_,pr°potfiat it be set down to after Item 9. Councilman Allen moved that public hearing be held over until July 26, 1971, seconded by Councilman Zielinski. Motion carried. REGULAR MEETING JULY 12, 1971 COMMITTEE OF THE WHOLE MEETING ORDINANCE (Continued) AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 4990 -68 CHAPTER 40 OF THE MUNICIPAL CODE (FORMERLY ZONING ORDINANCE NO. 3702) (3306 South Fellows Street) This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Attorney Thomas Laughlin represent - ed Mr. Lawrence Garatoni who resides in Mishawaka, Indiana and is requesting the rezoning of 1.7 acres near Monroe School, 321 E. Donmoyer Ave., South Bend, from "A" Residential to "B" Residential for the purpose of building a Day Care Center for children ranging from 2 to 6 years. The structure would be very attractive and do no harm to the area and would accommo- date 100 children. The neighbors have no objections. Fellows Street is very busy, but also wide at this point. It would be/_._conven2_.ei8r working mothers dropping off their school age children as they can also drop off their younger children close by. There is a jungle area not being put to any use at the present time except perhaps for a bird sanctuary. The storm water drainage has been worked out. The Area Plan Commission has approved changes and addi- tions. Mr. Garatoni has a day care center in operation in Mishawaka and has one under con- struction in Elkhart. His building methods are financed locally and he does not seek federal funds. He showed colored pictures and pamphlets of his presenthAig $jogosed center. He stated there are 22 million children under the age of 6,that/ need for proper care and guidance as there has been a 43% increase of working mothers. He would maintain a staff of ten, serve snacks, lunches and have facilities for naps. He would like to be in operation by Christmas and does not plan any expansion as he feels it would be best to build another facility in another locality. Councilman Reinke made a motion, seconded by Councilman Wise, that the ordinance go to Council as favorable. Motion carried unanimously. ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION IN THE AMOUNT OF $800.00 FROM ACCOUNT M -11, "SERVICES PER- SONAL" IN THE BUILDING DEPARTMENT, AND THE TRANSFER OF SAME TO MUNICIPAL SERVICES FACILITY ACCOUNT U -252, "REPAIRS OF EQUIPMENT ", ALL BEING WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. City Controller James Bickel stated that the funds were required for a vehicle that was used in the Building Department. It was damaged when the driver operated it on slick pavement and slid off the side of the road. They plan to use salvaged parts from other old trucks which will save approximately $500.00. Councilman Szymkowiak made a motion, seconded by Councilman Wise, that the ordinance go to Council as favorable. Motion carried unanimously. ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION IN THE AMOUNT OF $1,200.00 TO ACCOUNT Q -54 "CLOTHING ALLOW- ANCES", AND THE TRANSFER OF SAME FROM ACCOUNT Q -11 "SERVICES PERSONAL" IN THE FIRE DEPARTMENT BUDGET, ALL BEING WITHIN THE GENERAL FUND This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Fire Chief Joseph Zurat said the money was required to replace present scuba diving equipment that was beyond repair and not salvagable. It was 12 years old and unsafe to use. The amount would equip four scuba divers complete. We have seven scuba divers. Councilman Grounds suggested that one outfit be re- placed each year and we should not jeopardize our firemen's lives with inferior equipment. Councilman Reinke made a motion, seconded by Councilman Craven that the ordinance go to the Council as favorable. Motion carried unanimously. ORDINANCE AN ORDINANCE FIXING THE ANNUAL PAY OF POLICEMEN FOR THE CALENDAR YEAR 1972 This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Chairman Grounds requested City Clerk Kathryn L.Blough to read the following communication: "IT IS IMPERATIVE AT THIS TIME FOR THE SOUTH BEND COMMON COUNCIL TO APPROVE A REALISTIC PAY RAISE FOR THE SOUTH BEND POLICE AND FIRE DEPARTMENTS. IT IS NOW APPARENT THAT THE MAJORITY OF OUR CITIZENERY REALIZE THAT THESE MEN DESERVE A PAY RAISE COMPARABLE WITH ALL OTHER EXTREMELY IMPORTANT JOBS IN OUR COMMUNITY. LAWRENCE OPPENHEIM PRESIDENT ST. JOSEPH COUNTY LAW ENFORCEMENT ASSOCIATION" REGULAR MEETING JULY 12, 1971 COMMITTEE OF THE WHOLE MEETING (Continued) Mr. Keith BonDurant, President of the South Bend Civic Planning Association, asked the Coun- cil to "hold the line" by not increasing the 1972 police pay due to the increases of the wel- fare services, aid to dependent children, poor relief, teacher's salaries and the doubling of sewage charges. He read the following letter: "South Bend Common Council South Bend School & Library Board St. Joseph County Council Public Transportation Corp. Board Ladies and Gentlemen: June 11, 1971 Officers and directors of the South Bend Civic Planning Association have been making an in -depth study of the local economic conditions and must request on be- half of the citizens and taxpayers of the community, that no salary increases be allowed for 1972. We make this recommendation on the basis of the following facts: First four months 1970 1971 Public Welfare costs $ 1,718,000.00 Ai..d to Dependent Children cost 807,000.00 Number of cases 3,980 Portage Township Poor Relief $ 146,000.00 $ 1,921#'-000.00 1,230,000.00 6,425 Per Cent Increase 11.8% 52.4% 61.4% $ 320,000.00 119.2% Number of Cases 820 2,678 226.6% The Portage Township Trustee has requested an additional appropriation of $500,000 for the balance of this year (1971), which will cost the taxpayers 22� more in the 1972 tax rate without consideration of the 1972 budget and rate. The sewage rates, as proposed, will increase from a minimum of $1.60 per month to $ 3.40 per month which will place a further burden on the citizens and taxpayers. Unemployment in St. Joseph and Marshall Counties was 7.5% as compared to the national average of 5.9% for the first quarter of 1971. The cost of living increase has been slowed down. 1966 -67 Schools: Teachers average salary $ 7,390.00 $ Number of teachers Pupil- Teacher ratio 1,451 25 to 1 Per Cent 1971 Increase 10,053.00 36.0% 1,551 6.9°% 23 to 1 We ask the School and Library Board not only to retain the present salary sched- ule but the present salaries, except where an individual has changed classification. This would mean a savings of $358,120 for teachers alone and would amount to over 114.1 on the tax rate. We are making one exception in our request to "hold the line" and this is in the Township Trustee office where the employees have received no increase in some thirteen years. We understand that in a number of instances these employees earn less than some of those asking aid. We recognize there are many people in government service who are doing very good jobs and should be properly compensated. We know practically all of the employees have received salary and /or fringe benefits over the last few years. We also know there are many more people who are unemployed, others who are on fixed income, and these too deserve your and our special consideration. Regrettable as the situation may be, these are the facts in St. Joseph County today and are the basis of our request to hold the line on salaries for 1972. BonDurant, President by order of the Board of Directors" Mr. Kenneth DeVoe, 15978 Highland Drive, South Bend, speaking for the policemen, urged support of the ordinance. Miss Virginia Guthrie, executive secretary of the Civic Planning Association, stressed the potential burden this raise plus the possibility of the other city salary raises which would follow, will be to the taxpayers which could create a serious tax delinquency that we wouldn't want. She urged the Council to consider this added tax strain on the people and to deny the 5% increase. Mrs. Lee E. Swan, 2022 Swygart Street, South Bend, stated that we have recently been taxed with the additional sewage; there is a possibil- ity that there will be a new tax for municipal trash collection; 66% of the newly married young people are moving out of the City because of these higher tax rates - she cautioned there will be very few left to pay these taxes. Councilman Reinke stated that the Council REGULAR MEETING JULY 12, 1971 COMMITTEE OF THE WHOLE MEETING (Continued) -9 had reviewed the proposal and having talked with both the policemen and firemen and were un- able to give the 6/ increase in 1970, were considering this merely as a cost of living in- crease in which we are one year behind. Councilman Laven said slides were being shown to re- flect the Council's thinking. Councilman Palmer moved for a five minute recess. Motion was seconded by Councilman Wise. Motion carried unanimously. Time: 9:20 P. M. Committee of the Whole reconvened at 9 :30 P. M. Councilman Reinke made a motion, seconded by Councilman Szymkowiak, that the ordinance go to Council as favorable. Motion carried unanimously. nPnTWAWrR AN ORDINANCE FIXING THE ANNUAL PAY OF FIREMEN FOR THE CALENDAR YEAR 1972 This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Miss Guthrie asked "Row much is this going to increase the taxes next year? Do you have any idea? What can be reduced in the budget ?" Those questions were not answered. Salaries for policemen and firemen total approximately $4,700,000 and for City employees salaries total approximately $2,000,000. Miss Guthrie said many people in this community do not have a cost of living increase, there are a lot of people who are on a fixed rate. Councilman Allen stated "I don't care what you call it, it is a raise, and should be recognized as a raise. I am in accord with Miss Guthrie that cuts must be made in this budget and we must hold it on any increases." Councilman Laven said that the Council has acted responsibly in the past and would undoubtedly do so in the future. Councilman Reinke made a motion, seconded by Councilman Szymkowiak, that the ordi- nance go to Council as favorable. Motion carried unanimously. There being no further business to be considered before the Committee of the Whole, Chairman Grounds entertained a motion to rise and report to the Council. REPORT OF THE COMMITTEE ON MINUTES Your Committee on the inspection and supervision of the minutes would respectfully report that they have inspected the minutes of the June 14, 1971 regular meeting, June 17, 1971, special meeting and June 28, 1971 regular meeting of the Council and found them correct. CITIZENS REQUESTS - MISCELLANEOUS MATTERS Mrs. Lee Swan said she has observed some young boys in groups of five or six who were to be working cleaning up the park. They play at picking up a few papers, then play follow the leader and go play ball. They arrive at 8 AM and by 8:10 they are finished. They are paid $1.65 per hour. "This is criminal. Does this help to build character for these underpri- vileged boys ?" Councilman Grounds said that he too had seen similar actions and agreed that this is not the way to teach these children. He stated that the Model Cities Program is in charge and that they were in need of supervision./ 48uncil asked the City Clerk to send a letter to Mr. Bickel, who volunteered his services, voicing concern. Motion carried unanimously. roc, REGULAR MEETING JULY 12, 1971 ORDINANCES, THIRD READING ORDINANCE NO. 5313 -71 AN ORDINANCE AMENDING AND ?SUPPLEMENTING ORDINANCE NO.4990 -68 CHAPTER 40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, FORMERLY REFERRED TO AS ZONING ORDINANCE NO. 3702 (Ironwood & Scottsdale Addition) The ordinance was given third reading. Council President Laven stated that third reading was being given at this time because there were only seven councilmen in attendance at the last meeting on June 28. There were 4 ayes and 5 ayes would be required for passage-of the ordi- nance. Attorneys for both parties have informed Councilmen Palmer and Zielinski who were ab- sent previously. Public hearing is terminated. ORDINANCES, FIRST AND SECOND READING Mr. Hunter replied "No ". AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA AND REITH -RILEY CONSTRUCTION CO., INC. OF GOSHEN, INDIANA, FOR THE INSTALLATION OF A SIXTEEN (16) INCH WATER MAIN ON SAMPLE STREET BRIDGE IN THE AMOUNT OF $5,900.00. Council'-President Laven entertained a motion for suspension of rules. Councilman Palmer so moved, seconded by Councilman Craven. Roll Call on the motion. Voted 9 ayes, 0 nays. Mr. John Hunter spoke on the urgency of this request that Reith Riley the only bidder on the replacement of the Sample Street bridge are now working on it and while they already have the excavations we could save approximately $8,097.00 by installing the 16" water main at this time. ORDINANCE AN ORDINANCE AMENDING CHAPTER 20, ARTICLE I, OF THE SOUTH BEND, INDIANA, MUNICIPAL CODE, 1962, AS AMENDED. The ordinance was given first reading by title and second reading in full. Councilman Palmer made a motion, seconded by Councilman Szymkowiak that the ordinance be set for public hearing on July 26, 1971. Motion carried. 9 ayes, 0 nays. 53� REGULAR MEETING JULY 12, 1971 UNFINISHED BUSINESS Councilman Robert 0. Laven read a communication which he had received with reference to campaign posters. Mrs. Blough, City Clerk, raised the issue in a letter to the council in which she said political posters still blot utility poles, trees and buildings from the spting city election campaign. City Attorney Shepard J. Crumpacker said an ordinance forbids the placing of posters on utility poles and trees in public rights- of- way:and that the ordinance is hard to enforce because criminal action can be brought only against the person who actually put it on a pole. Council President Laven, said "I wonder if we could ask The Tribune to call attention to this and ask the politicians as a matter of courtest to remove them ?" There was some objection on spending city money for their removal. There being no further business to come before the Council, Councilman Craven moved for ad- journment. Councilman wise so moved.
