The meeting was called to order by Council President Robert 0. Laven. The invocation was given by Reverend Freeman A. Whetstone, Stewart Memorial Baptist Church, 4849 Ford Street, South Bend, Indiana. ROLL CALL PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, Wise, Palmer and Zielinski. ABSENT: Councilman Szymkowiak. (On Vacation) RESOLVE INTO THE COMMITTEE OF THE WHOLE Council President Laven entertained a motion to resolve the Council into the Committee of the Whole on the state of the City to consider the items listed on the agenda for the consideration of the Committee of the Whole. COMMITTEE OF THE WHOLE MEETING Be it remembered that the Common Council of the City of South Bend, Indiana met in the Committee of the Whole in the Council Chambers of the County City Building on Monday, May 10, 1971, at 8:11 p. m. The meeting was called to order by Chairman William W. Grounds, who presided. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE, BEING ORDINANCE NO. 4990 -68, AS AMENDED, (FORMERLY ORDINANCE NO. 3702), BY ADDING PROVISIONS DEALING WITH MOBILE HOME PARKS. This being the time heretofore set for public hearing on the above ordinance, proponents and and opponents were given an opportunity to be heard thereon. Mr. Douglas Carpenter, Senior Planner of the Area Plan Commission said that this ordinance would allow mobile home parks to be established within the city limits and it established Use Districts.and Subdivisions. He explained the difference between a mobile home park and a subdivision. He stated that in a park the lots are rented and in a subdivision the lots are plotted out and sold. The ord- inance requests some design, site plan, final development plan, development schedule and staging requirements and the final development plan shall be submitted to the Area Plan Comm- ission for approval. The ordinance requests that the home be properly secured according to the Building Commissioner against tornadic winds and must be anchored into the ground. Miss Virginia Guthrie, Executive Director of the South Bend Civic Planning Association, stated that everything should be done to make these homes attractive and suggested that skirts be required to cover the opening under the trailer. Mrs. Fredrick Mutzl., 320 Parkovash Ave., South Bend, Indiana, asked if there was a difference in the taxing if the home retains wheels. City Attorney S. J. Crumpacker explained that mobile homes are taxed under a procedure that fixes the assessed valuation at not more than one - third the market value and that a deprec- iation scale allows depreciation to a minimum figure over eight years. Mr. Carpenter said the wheels should be removed. Reverend Father Thomas L. Depa, New Carlisle, representing the St. Joseph County Fair Tax Association said mobile home parks are being developed in soil conditions that are not suit- able and asked that they not be premitted to be built near streams and said they should not be built unless they are connected to city sewers. City Engineer Lloyd Taylor said the city ordinance prohibits mobile homes unless trailers are connected to city sewer and water fac- ilities. Councilman Laven made a motion, seconded by Councilman Wise, that the ordinance be amended as follows: On page 5, in Section III, C, Mobile Home Park Design Requirements, add the following item: 21. Each mobile home shall have properly attached to it a skirt or extension of adequate opaque non - flammable material, or any other material acceptable to the Building Commissioner, covering the opening from the bottom of the unit to the ground. The above motion carried. 8 ayes, 0 nays, 1 absent (Councilman Szymkowiak) Councilman Allen made a motion, seconded by Councilman Zielinski, that the ordinance go to the Council favor- able as amended. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Szymkowiak) ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40 OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA (627 W. Washington St.) This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. James Cronk, 627 W. Washington Street, the petitioner, spoke for the proposed zoning. He said it is not intended to struct- urally alter the existing buildings but that the detached building, which is a garage with an apartment above it, would be used for an antique and gift shop. Councilman Allen made a motion, seconded by Councilman Palmer, that the ordinance go to the council as favorable. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Szymkowiak). COMMITTEE OF THE WHOLE MEETING MAY 10, 1971 COMMITTEE OF THE WHOLE MEETING ORDINANCE AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA -1962 SECTION 40 AS AMENDED AND GENERAL ORD- INANCE NO. 4990 -68, AND THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN PARCEL OF LAND. (Lot #2, Pleasant View Manor) This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Douglas Carpenter, Senior Planner of the Area Plan Commission, explained that this lot had been omitted when its surrounding area, recently annexed, was zoned residential. He said the Area Plan Commission was asking that this be zoned to single family residential as the surrounding area is now zoned. Councilman. Palmer made a motion, seconded by Councilman Craven, that the ordinance go to the Council as favorable. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Szymkowiak). ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 4990 -68 CHAPTER 40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, FORMERLY REFERRED TO AS ZONING ORDINANCE NO. 3702. (Portage & Maple Roads) This being the time heretofore set for public hearing on the above ordinance, proponents and opponents.were given an opportunity to be heard thereon. Mr. Joseph Roper, Attorney -at -Law, (representing the Grant Holladay Development Corporation, Fort Wayne, Indiana, stated that the land had been zoned in November 1969 but that the firm had been unable to get financing and start construction within a year as required. Therefore, he said the zoning reverted to single family residential. The petitioner now is asking the Council to rezone the tract to "B" re- sidential again and he said the firm is ready to begin construction immediately. A discrepancy in the legal description in the petition was clarified by Mr. Douglas Carpenter, Senior Planner of the Area.Plan Commission. (The clarification follows in the minutes of this meeting listed under Reports from the Area Plan Commission and Citizens Requests - Miscellaneous Matters) Mr. James Kelley, Grant - Holladay Construction Corporation, assured Councilman Grounds, in whose'- distri tract is located, that two junior league baseball diamonds will be developed to replace the existing two Chet Waggoner parks in the area. He agreed to send Councilman Grounds a copy of the contract so the Chet Waggoner League could be assured of the agreement. Councilman Zielinski made a motion, seconded by Councilman Craven, that the ordinance go to the Council as favorable. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Szymkowiak). There being no further Grounds entertained a seconded by Councilman business to be considered before the Committee of the Whole, Chairman motion to rise and report to the Council.
