Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Counol Chambers in the County -City Building on Monday, February 8, 1971 at 8:00 p. m. The meeting was called to order by Council President Robert 0. Laven. The invocation was given by Council- Presi- dent Laven. ROLL CALL PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak Palmer and Zielinski. ABSENT: Wise Council- President Laven entertained a motion to amend a motion made at the January 25, 1971 meeting pertaining to "AN ORDINANCE FIXING THE ANNUAL SALARIES, PAYABLE FROM THE GENERAL FUND, FOR OFFICERS OF THE CITY OF SOUTH BEND TO BE ELECTED FOR THE TERM COMMENCING JANUARY 1, 1972 AND FIXING THE TIME WHEN THE SAME SHALL TAKE AFFECT, AS AMENDED ", as follows: the public hearing date set for this ordinance on February 8, 1971 be changed to March 8, 1971. Councilman Craven so moved, seconded by Councilman Allen. Motion carried. 8 ayes, 0 nays, 1 absent RESOLVE INTO COMMITTEE OF THE WHOLE Council President Laven entertained a motion to resolve the Whole on the state of the City to consider the items listed of the Committee of the Whole. Be it remembered that the Common Council of the City of South Bend, Indiana, met in the County - City Building, in the Committee of the Whole, in the Council Chambers on Monday, February 8, 1971 at 8 :05 p. m. The meeting was called to order by Chairman William W. Grounds, who presided. ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION FROM THE REDEVELOPMENT FUND TO ACCOUNT NO. 261, "OTHER CONTRACTUAL SERVICES" IN THE DEPARTMENT OF REDEVELOPMENT." This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. B. J. Ashenfelter, Executive Directo Redevelopment Department explained the need for the appropriation. He said this would defray the cost of providing cul-de-sac treatment to Chapin and Catalpa Streets immediately south of the Industrial Expansion Project (Project, Ind. R -56). Residents of the area had remonstrated at a Board of Works public hearing and in cooperation with the Engineering Dept. after an inves- tigation, it was determined that the two streets should be in a cul -de -sac on the south side of the railroad to provide turn around space for those residents since the two streets are ex tremely narrow in width. The residents objected to the closing and vacation of these streets without certain treatment being made to the streets south of the railroad -- Vacation Resolution No. 3331. Miss Virginia Guthrie, Executive Secretary, South Bend Civic Planning Association, stated that the people did have a problem and creating a cul -de -sac means -as a result of the Cummings Industrial Development - -these people will have an opportunity to turn around without interferring with parking of the people who live in that area. In response to Councilman Laven's inquiry whether or not this was approved by the Area Plan Commission, Mr. Ashenfelter stated this was approved by the Commission. Councilman Palmer asked if signs were posted informing people of the turn around--Mr—Ashenfelter said signs have already been installed. Councilman Reinke made a motion, seconded by Councilman Allen, that the Ordinance go to the Council as favorable. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Wise). ORDINANCE AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA - 1962, SECTION 40 AS AMENDED, AND GENERAL ORDINANCE NO. 4990 -68, AND THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN PARCEL OF LAND. (59800 Miami Rd., Corner of Miami and Wideners Lane, Scottsdale Mall) This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. President Laven instructed the Clerk to read Item #6, Report from the Area Plan Commission,as follows: i COMMITTEE OF THE WHOLE MEETING FEBRUARY 8, 1971 ORDINANCE (Cont'd. Public Hearing of 59800 Miami Rd., Scottsdale Mall Zoning) January 20, 1971 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached rezoning petition of Eugene F. and Mable J. Wilson which was unfavorably recommended to the Common Council on March 31, 1970, and subsequently referred back to the Area Plan Commis- sion for reconsideration was given additional hearing at the January 19, 1971 meeting and the following action was taken: HB:eb After due consideration, it was moved, seconded and carried that this ordinance be returned to the Common Council with an unfavorable recommendation. Mr. Crutchfield abstained from voting. Very truly yours, /s/ Howard Bellinger, Executive Director Mr. Doug Carpenter, Senior Planner, Area Plan Commission explained the Area Plan Commission had made an unfavorable recommendation on the rezoning proposal because the Commission agreed that the commercial area of the mall should not extend south of the by -pass which makes an effective boundary between commercial and residential areas. Councilman Craven noted that the Indiana State Highway Commission had refused to relocate the proposed route of the US #20 by -pass to prevent it from splitting the Scottsdale Mall parking area. (This ordinance was referred back to the Area Plan Commission for further study and final determination of the location of the By -Pass Highway at the May 11, 1970 Council Meeting) Councilman Laven made a motion, seconded by Councilman Craven, that the ordinance go to the Council as unfavorable. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Wise). There being no further business to be considered before the Committee of the Whole, Chairman Grounds entertained a motion to rise and report to the Council.
