The meeting was called to order by Council President Robert O. Laven, The invocation was given by Reverend Jack O. Burrell, Calvary Baptist Church, 1002 Blaine Avenue, South Bend, Indiana. ROLL CALL PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski. ABSENT: None. RESOLVE INTO COMMITTEE OF THE WHOLE Council President Laven entertained a motion to resolve the Council into the Committee of the Whole on the state of the City to consider the items listed on the agenda for the consideration of the Committee of the Whole. Councilman Allen so moved and Councilman Zielinski seconded the motion. Motion carried. Time: 8:11 p.m. COMMITTEE OF THE WHOLE MEETING NOVEMBER 9, 1970 u COMMITTEE OF THE WHOLE MEETING Be it remembered that the Common Council of the City of South Bend, Indiana, met in the County - City Building, in the Committee of the Whole, in the Council Chambers on Monday, November 9, 1970 at 8:12 p.m., all members present. The meeting was called to order by Councilman William W. Grounds, who presided. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATION FROM THE GENERAL FUND IN THE AMOUNT OF $2,500.00 TO ACCOUNT T -726, "OTHER EQUIP- MENT", IN THE BUDGET OF THE TRAFFIC DEPARTMENT AND ALL " BEING WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. City Engineer Lloyd Taylor spoke on behalf of Mr. Clem Hazinski, Traffic Engineer, who was unable to attend the meeting. Mr. Taylor said this amount is for the purchase of parts for traffic signals. This amount, he stated, represented money collected in claims from motorists who damaged traffic signals in the first seven months of the year, therefore, the amount must be transferred back into the fund. Council- man Szymkowiak made a motion, seconded by Councilman Palmer, that the ordinance go to the Council as favorable. Motion carried. 9 ayes, 0 nays, 0 absent. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO ACCOUNT MVH -13 "SERVICES PERSONAL - EXTRA AND OVERTIME" IN THE AMOUNT OF'$6,000.00, AND TO ACCOUNT MVH -722 "MOTOR EQUIPMENT" IN THE AMOUNT OF $7,000.00 AND THE TRANSFER OF SAID SUMS FROM ACCOUNT MVH -11 "SERVICES PERSONAL - ADMINISTRATIVE ALL BEING IN THE MOTOR VEHICLE HIGHWAY DEPARTMENT AND ALL BEING WITHIN THE GENERAL FUND This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Street Commissioner R. B. Gartner explained the need for the appropriation. He stated adoption of the ordinance would provide for overtime pay for the night force used in the downtown resurfacing of streets and the $7,000.0 would pay for snow blades and salt spreading equipment for new trucks. Mr. Gartner said they are now preparing the trucks for the winter weather. Councilman Reinke made a motion, seconded by Councilman Palmer, that the ordinance go to the Council as favorable. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF SOUTH BEND, INDIANA AND DEEDS EQUIPMENT COMPANY, INC., LAWRENCE, INDIANA, FOR THE PURCHASE OF ONE (1) USED SHIELD BANTAM TRUCK CRANE AND EQUIPMENT IN THE AMOUNT OF $8,000.00. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. John Hunter, Director of Utilities, explained the need for the approval of the contract. He said it would enable the purchase of a used truck - mounted crane. He also said a new crane would be quite expensive, perhaps $20,000.0 Councilman Wise made a motion, seconded by Councilman Craven, that the ordinance go to the Council as favorable. ORDINANCE AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, GENERALLY DESCRIBED AS LYING NORTH OF EDISON ROAD AND WEST OF SOUTH BEND AVENUE (Rapper i Petition) This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. There being no remonstrators against the annexation, Councilman Szymkowiak made a motion, seconded by Councilman Reinke, that the ordinance go to the Council as favorable. COMMITTEE OF THE WHOLE MEETING NOVEMBER 9, 1970 ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3913, SECTION 7, AND ORDINANCE NO. 4537 -62, SECTION 3, RELATING TO ELECTRIC WIRING STANDARDS This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Paul D. Hass, President of the Portage Realty Corp., who said he was also speaking in behalf of the Home Builders Assn. of St. Joseph Valley, said that the plastic wrapped wiring, called Romex, is cheaper to install, just as safe as metal - protected wiring, and will result in a saving of up to $300 per apartment in construction costs. (The proposed adoption of the 1968 edition of the National Electrical Code would allow apartment house builders to use plastic- wrapped electrical wiring instead of wiring encased in a metal conduit)Also speaking for the use of the wiring called Romex, were: Dwain Bower, of Bower Homes, Inc.; Andrew S. Place, of Place & Company. Mr. Place said the City must up -date the existing Electical Code. Among those questioning the use of Romex were: Kenneth C. Clawson, Jr., Asst. Chapter Manager of the National Electrical Contractors Association, Inc., Hammond, Indiana. who said he was interested in making sure that wiring will be safe. Mr. Robert L. Pfeil, of the Koontz - Wagner Electric Co., said use of the metal tubes for wiring allows later upgrading to take place by running newer wiring through the metal tubes, a procedure that cannot be done with the plastic romex wiring. Mr. Don Beatty, Chapter Manager of the National Electrical Contractors Association, said he would like to have more questions answered before the Council considered passage of the 'Ordinance. Mr. Matthew Horvath, Jr., President of the Rum Village Businessmen's Association, noted that while metal conduits may melt in a fire, romex will burn up entirely. Councilman Reinke made a motion seconded by Councilman Allen, that the ordinance be returned to the Ordinance Committee for further study. Councilman Reinke's motion seconded by Councilman Allen, to return the ordinance to the Ordinane Committee for further study was amended by Councilman Laven and seconded by Councilman Reinke as follows: The ordinance be returned to the Ordinance Committee for further study and a report by the Committee be submitted to the Council on their findings at the continued public hearing on December 14, 1970. Amended motion carried. 8 ayes, 1 nay 0 absent. ORDINANCE AN ORDINANCE CHANGING THE NAMES OF CERTAIN STREETS WITHIN THE CITY OF SOUTH BEND. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. City Engineer Lloyd Taylor said the street name changes were proposed to eliminate duplication of street names and generally involved roads and streets in recently annexed areas, thereby giving the resident one notice of their new street number and street name. Mr. Taylor said, at the request of Councilman Allen, because of Christmas mail, the changes will become effective January 1, 1971. Councilman Allen made a motion, seconded by Councilman Zielinski, that the Ordinance go to the Council as favorable. Motion carried. 9 ayes, 0 nays, 0 absent. 16IMNYWHA v AYN AN ORDINANCE TO APPROPRIATE $22,819.47 FROM THE LOCAL ROAD AND STREET FUND TO THE ACCOUNT "SERVICES CONTRACTUAL ", BEING WITHIN THE LOCAL ROAD AND STREET FUND. Councilman Laven made a motion, seconded by Councilman Craven, that the public hearing be contin- ued on November 23, 1970. Motion carried. 9 ayes, 0 nays, 0 absent. There being no further business to be considered before the Committee of the Whole, Chairman Grounds entertained a motion to rise and report to the Council.
