The meeting was called to order by Countil Presidetn Robert 0. Laven. The invocation was given by Father F. Thomas Lallak, Assistant Pastor, St. Anthony Parrish, 2310 E. Jefferson Blvd., South Bend, Indiana. _ T _1 VT PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski. ABSENT: None. REPORTS FROM ORDINANCE COMMITTEE To the Common Council of the City of South Bend: October 26, 1970 Your Committee, The Ordinance Committee, to whom was referred "AN ORDINANCE CREATING A DEPARTMENT OF.ECONOMIC DEVELOPMENT TO PROVIDE FOR INDUSTRIAL EXPANSION" respectfully report that they have' examined the matter and that in their opinion recommend that the public hearing be continued on October 26, 1970. /s/ William W. Grounds Chairman There being no objections, the report was accepted as read and placed on file. REPORTS FROM ORDINANCE COMMITTEE To the Common Council of the City of South Bend: October 26, 1970 Your Committee, the Ordinance Committee, to whom was referred "AN ORDINANCE PROPOSING AMENDMENTS TO AN ORDINANCE AMENDING CHAPTER 9, SECTION 9 -3 (30), AND CHAPTER 11, SECTION 11 -3 OF THE MUNI- CIPAL CODE OF SOUTH BEND, INDIANA, 1962, AS PRESENTED JULY 8, 1968 ", (Electrical Ordinance), respectfully report that they have examined the matter and that in their opinion the Ordinance be withdrawn in its entirety. /s/ William W. Grounds Chairman There being no objections, the report was accepted as read and placed on file. f RESOLVE INTO COMMITTEE OF THE WHOLE Council President Laven entertained a motion to resolve the Council into the Committee of the Whole on the state of the City to consider the items listed on the agenda for the consideration of the Committee of the Whole. Councilman Allen so moved and Councilman Zielinski seconded the motion. Motion carried. Time: 8:07 p.m. COMMITTEE OF THE WHOLE MEETING Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers of the County -City Building on Monday, October 26, 1970, at 8:08 p.m., all members present. The meeting was called to order by Chairman William W. Grounds, who presided. COMMITTEE OF THE WHOLE MEETING OCTOBER 26, 1970 ORDINANCE: This being the opponents were explained that radios for use carrying case, to the Council nays, 0 absent. (ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION IN THE AMOUNT OF $4,375.00 FROM ACCOUNT Q -11, "SERVICES PERSONAL ", TO ACCOUNT Q -724, "RADIO EQUIPMENT ", IN THE FIRE DEPARTMENT BUDGET, ALL BEING WITHIN THE GENERAL FUND. time heretofore set for public hearing on the above ordinance, proponents and given an opportunity to be heard thereon. Assistant Fire Chief Richard Busfield the extra funds are needed for the purchase of new equipment; five two -way portabl for communications among firemen especially in high -rise buildings, this includes and -volt charger and etc. Councilman Palmer made a motion that the ordinance go as favorable. Councilman Wise seconded the motion. Motion carried. 9 ayes, 0 AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION IN THE AMOUNT OF $900.00 FROM ACCOUNT Q -11, "SERVICES PERSONAL ", TO ACCOUNT Q -221, "ELECTRIC CURRENT ", IN THE FIRE DEPARTMENT BUDGET, ALL BEING WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Assistant Fire Chief Richard Busfield explained this appropriation was to be used for electric services in the Fire Stations. At the present time, total amount in the account is $18.24 noted Councilman Craven. Councilman Laven made a motion, seconded by Councilman Zielinski, that the ordinance go to the Council as favorable, Motion carried. 9 ayes, 0 nays, 0 absent. (ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION IN THE AMOUNT OF $8,000.00 FROM ACCOUNT Q -11, "SERVICES PERSONAL ", TO ACCOUNT Q -726, "OTHER EQUIPMENT ", IN THE FIRE DEPARTMENT BUDGET, ALL BEING WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Assistant Fire Chief Richard Busfield explained this appropriation is needed for hose and other equipment in order to up -date all of the Fire companies. He said some of the new equipment they have was burned (hose) in the recent Nu -way store fire, therefore it must be replaced. Councilman Szymkowiak made a motion, seconded by Councilman Craven, that the ordinance go to the Council as favorable. Motion carried. 9 ayes, 0 nays, 0 absent. Council President Laven announced that #8 on the Agenda has been omitted from the Agenda. ORDINANCE AN ORDINANCE CREATING A DEPARTMENT OF ECONOMIC DEVELOPMENT TO PROVIDE FOR INSUSTRIAL EXPANSION. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Those speaking against the proposed ordinance were: Mr. Lee Ullery, 726 Diamond Ave. South Bend;Dr. L. L. Taylor, 1318 E. Wayne St., North, South Bend, Indiana; Dr. Kenneth DeVoe, 52978 Highland Dr., South Bend; Mr. & Mrs. Fredrick Mutzl, 320 Parkovash Ave., South Bend; and Mr. Matthew Krizman, 24228 Indiana Rd. #23, South Bend, City Attorney S. J. Crumpacker assured the remonstrators that the ordinance, based on a state statute, does not permit personal property to be acquired through the power of eminent domain vested in government, even through the wording is in the ordinance. He said the people were taking parts of the act out of context and that the act must be read in reference to all other state acts. Councilman Laven said he was distressed when he hears people argue against progress. Councilmen Szymkowiak and Craven expressed strong support of the ordinance. Mr. Gordon E. Medlock, a representative of Bache & Co., investment firm, explained the significance of tax free municipal bonds and said they spur industrial development because industry does not have to spend its own funds for capital improvements. Mr. Paul Hass, 19879 Kingsway Court, South Bend, said he owned property in South Bend and that he favored the ordinance. Mr. Frank Pollack, 525 South Sherdian St., South Bend stated that he hadlistenedto both sides and he was against the adoption of the ordinance. Councilman Allen moved for a recess. Councilman Reinke seconded the motion. Motion carried. Time: 9:45 p.m. The Council portion of the Committee of the Whole reconvened. Time: 9:55 p.m. Councilman Allen asked City Engineer Taylor what the budget costs of other cities were who have this act. Mr. Taylor stated no other city in Indiana has a budget for the commission. Councilman Grounds asked if the Council has the power to cancel the commission. City Attorney Crumpacker replied that it has the power to do so. Councilman Laven made a motion, seconded by Councilman Reinke, that the ordinance go to the Council as favorable. Motion carried. 8 ayes, 1 nay, 0 absen COMMITTEE OF THE WHOLE MEETING OCTOBER 26 1970 There being no further business to be considered before the Committee of the Whole, Chairman Grounds entertained a motion to rise and report to the Council.
