HomeMy WebLinkAbout10-13-70 Council Committee of the Whole Meeting MinutesREGULAR MEETING OCTOBER 13, 1970 REGULAR MEETING OCTOBER 13, 1970 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers in the County -City Building on Tuesday, October 13, 1970, at 8 :00 p.m. The meeting was called to order by Council President Robert 0. Laven. The invocation was given by Reverend Robert A. MacGill, Dean of the Cathedral of St. James, 117 N. Lafayette Blvd., South Bend, Indiana ROLL CALL PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Palmer and Zielinski. ABSENT: Councilman Wise RESOLVE INTO THE COMMITTEE OF THE WHOLE Council President Laven entertained a motion to resolve the Council into the Committee of the Whole on the state of the City to consider the items listed on the agenda for the consideration of the Committee of.the Whole. Councilman Allen so moved and Councilman Zielinski seconded the motion. Motion carried. Time: 8:07 p.m. II COMMITTEE OF THE WHOLE MEETING Be it remembered that the Common Council of the City building, in the Committee of the Whole, in at 8:08 p.m. The meeting was called to order by 11 ORDINANCE City of South Bend, Indiana, met in the County - the Council Chambers on Tuesday, October 13, 1970 Councilman William W. Grounds, who presided. AN ORDINANCE TO APPROPRIATE $22,819.47 FROM THE LOCAL ROAD AND STREET FUND TO THE ACCOUNT "SERVICES CONTRACTUAL ", BEING WITHIN THE LOCAL ROAD AND STREET FUND. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Lloyd Taylor, City Engineer ex- plained that this amount represents refunds from the state from a two -cent gasoline tax which monies are to be used for street improvements that improve flow of traffic and capacity of street. He explained in detail the construction of each location and in reply to an inquiry from Miss Virginia Guthrie, South Bend Civic Planning Association Executive Secretary, about how the city could spend the money for the projects, already completed, without an appropriation, he said the city already had appropriated funds in the cumulative capital improvement fund. City Control- ler James A. Bickel said the city received an average of $43,000 a month from the state two -cent gasoline tax which is the 7th and 8th cents of the total state gasoline tax. Councilman Szymkow- iak stated that he would like to see the balance of the money for the year used on streets that are badly in need of repair. Councilman Laven made a motion that the ordinance be held in abey- ance with a continuance of the public hearing on October 26, 1970 and that a companion ordinance which appropriates these monies to the various accounts from which they were expended, be drawn up by the City Attorney and Controller and said ordinance be presented to the Council at the October 26th, meeting. Councilman Craven seconded the motion. Motion carried. 8ayes, 0 nays, 1 absent. ORDINANCE AN ORDINANCE CREATING A DEPARTMENT OF ECONOMIC DEVELOPMENT TO PROVIDE FOR INDUSTRIAL EXPANSION. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Robert McGinty, of the South Bend Mishawaka Area Chamber of Commerce Industrial Division stated that a three -man commission would operate the department and that they could issue revenue bonds to finance the construction of industrial buildings which would broaden the city's tax base. He said it doesn't involve tax money from the community. He said the city is the issuing agent through the commission appointed by the Mayor. He further stated that the Commission takes under advisement, contracts with industries and issues bonds in order to provide for facilities to bring that facility to town, therefore,the Commission would consider a number of businesses, both manufacturing and commercial enterprises. Miss Virginia Guthrie, Executive Secretary of the South Bend Civic Planning Assoc., noted that the Civic Planning Association had reviewed the ordinance and are concerned with the responsibility of protecting and helping the present industries that we have now. Mrs. Fredrick Mutzl, 320 Parkovash Avenue objected to the establishment of such a department because of the powers granted to the commission under the Indiana Statute. Councilmen Laven, Craven and Allen agreed the ordinance should be studied more closely. Councilman Laven made a motion that the ordinance be returned to the Ordinance Committee for furthur study and the public hearing be continued, with the recommendation that the Ordinance Committee hold an informal public hear- ing on the ordinance and report back to the Council on or before Nov. 9, 1970. He also recom- mended that members of the Chamber of Commerce be present at the informal public hearing. Councilman Allen seconded the motion. Motion carried. 8 ayes, 0 nays, 1 absent. COMMITTEE OF THE WHOLE MEETING OCTOBER 13, 1970 ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Chapte_r 40, Municipal Code). AS AMENDED. (Northwest of Intersection of South Bend Avenue and Edison Road, Adjacent to Turtle Creek Apartment Complex) This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Jack C. Dunfee, Jr., attorney, representing the Jackson Realty Company, said the petitioners are seeking to add one building to the already existing development of Turtle Creek Apartment Complex. The petitioner wishes to rezone to multiple - family residential use, a 1.43 acre addition to the Turtle Creek Complex located at Edison and South Bend Avenue. Councilman Laven made a motion to amend the ordinance as follows: In Section I, in the last sentence, change the period (.) to a comma (,) and add the following words "subject to the site plan as finally approved by the Area Plan Commission." Councilman Reinke seconded the motion. Motion carried. 8 ayes, 0 nays, 1 absent. Councilman Reinke made a motion, seconded by Councilman Palmer that the Ordinance go to the Council favorable as amended. Motion carried. 8 ayes, 0 nays, 1 absent. There being no further business to be considered before the Committee of the Whole, Chairman Grounds entertained a motion to rise and report to the Council.
