HomeMy WebLinkAbout09-28-70 Council Meeting Minutes(REGULAR MEETING - RECONVENED Be it remembered that the Common Council of the City of South Bend, Indiana, reconvened in the Council Chambers in the County -City Building on Monday, September 28, 1970, at 8 :37 p.m. with 8 members present and 1 absent (Councilman Grounds). The meeting was called to order by Council President Robert O. Laven, who presided. REPORT FROM THE COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of September 14, 1970 meeting of the Council and found them correct. They therefore recommend that the same be approved. /s/ Robert 0. Laven Isl Janet S. Allen s Albert E. Palmer There being no objections, the report was accepted as read and placed on file. (CITIZENS REQUESTS - MISCELLANEOUS MATTERS Mrs. Lee E. Swan, 2022 S. Swygart St., South Bend, supported the Walnut Street residents who have been trying to get the City to repair large chuckholes in the section from Prairie Avenue to" Ewing Avenue. She submitted a hand drawn map to each Councilman showing Walnut St. as an arterial that runs from Ewing to Lincoln Way West and said the residents should not be asked to pay a portion of these repairs on Walnut Street. Mrs. F. S. Wlodarski, 1869 Riverside Drive said she agreed with Mrs. Swan and stated that the city has surfaced many streets that don't need it. She also registered a complaint and asked that the Council investigate the disturbances on Sunday afternoons in the 1800 block of Riverside Drive. Her complaint charged indecent behavior, drinking, foul language and tire squealing by persons parking along the St. Joseph River. Council President Laven asked the Clerk to make a note of the complaint and requested a communication be forwarded to the Board of Works & Safety. Mrs. Fredrick Mutzl, 320 Parkovash, South Bend, commented on the action taken by Councilman Allen for getting together a committee to study South Bend's trash problem. Councilman Allen is chair- man'of the Public Improvements Committee. REPORT FROM THE CITY CONTROLLER The report from the City Controller James A. Bickel for the month of August, 1970 was deferred until the meeting of October 13, 1970. Mr. Bickel was out of town and unavailable for comments. REPORT FROM AREA PLAN COMMISSION Mr. Robert Laven, President September 25, 1970 South Bend Common Council ' County -City Building South Bend, Indiana 46601 Dear Mr. Laven; On August 18, 1970, the Area Plan Commission held a public hearing on the proposed ordinance initiated by the Common Council being: An Ordinance amending Section 23 (c) of Ordinance 4990 -68, being Section 40 -8 (c) of the Municipal Code, relating to action by the Common Council on unfavor- able reports from the Area Plan Commission. The Area Plan Commission, at its regular meeting on September 15, 1970, took the following action on the subject ordinance: Motion was made and seconded and unanimously passed that in view of the Commission's opinion that they do not have the power to act on this particular ordinance and in- stead of recommending the ordinance favorably or unfavorably, they provide the opinion that it should require a three - fourths vote on the part of the Common Council to override the Area Plan Commission on an unfavorable report and recommend that state legislation be enacted to require a three - fourths vote to override an unfavorable opinion from the Area Plan Commission. HB :eb There being no objections, the report directed the Clerk to send a letter to requesting that the ordinance referred committee and set for public hearing. Council - President Laven Councilman Grounds, Chairman of the Ordinance Committee, to in the above Area Plan communication be brought out of REGULAR MEETING SEPTEMBER 28, 1970 REPORT FROM THE AREA PLAN COMMISSION Mr. Robert Laven, President Common Council of the City County -City Building South Bend, Indiana Dear Mr. Laven: September 28, 1970 of South Bend Rezoning petition No. 185 -70 Northwest intersection of South Bend Avenue and Edison Road The above petition was duly advertised on September 5th and 12th and a public hearing was held on September 5th and 12th and a public hearing was held on September 15, 1970. The Area Plan Commission, at its regular meeting on September 15, 1970, took the following action on the subject ordinance: After due deliberation, it was moved by Jerry Miller, seconded by Lloyd Taylor, that this petition for rezoning be recommended favorably to the Common Council of the City of South Bend subject to annexation by the city. REPORT FROM THE COMMITTEE OF THE WHOLE Council - President Laven entertained a motion to waive the reading of the Committee of the Whole Reports. Councilman Allen so moved. Councilman Zielinski seconded the motion. Motion carried unanimously. ORDINANCES, THIRD READING ORDINANCE NO. 5233 -70 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CIVIL CITY OF SOUTH BEND AND THE CITY OF SOUTH BEND AND THE CITY OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT FOR THE CONVEYANCE OF TWO PARCELS OF REAL ESTATE LOCATED IN THE CITY OF SOUTH BEND AND OWNED BY THE CIVIL CITY OF SOUTH BEND. I The Ordinance was given third reading. Councilman Wise made a motion for passage of the ordi- nance. Councilman Craven seconded.the motion. There being no discussion on the motion, the Ordinance was passed by a roll call vote of 7 ayes, (Councilmen Laven, Reinke, Craven, Szymkowiak, Wise, Palmer and Zielinski) 1 nay (Councilman Allen) 1 absent (Councilman Grounds). ORDINANCE NO. 5234 -70 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO ACCOUNT L -722 "MOTOR EQUIPMENT" IN THE AMOUNT OF $5,300.00, TO ACCOUNT L -725 "OFFICE EQUIP- MENT" IN THE AMOUNT OF $600.00'AND TO ACCOUNT L -726 "OTHER EQUIPMENT" IN THE AMOUNT OF $1,100.00 AND THE TRANSFER OF SAID SUMS FROM ACCOUNT L -11 "SERVICES PERSONAL ", ALL BEING IN THE ENGINEERING DEPARTMENT AND ALL BEING WITHIN THE GENERAL FUND. The Ordinance was given third reading. Councilman Reinke made a motion for passage of the Ordi- nance. Councilman Craven seconded the motion. There being no discussion on the motion, the Ordinance was passed by a roll call vote of 8 ayes, (Councilmen Laven, Allen, Reinke, Craven, Szymkowiak, Wise, Palmer and Zielinski) 0 nays, 1 absent ( Councilman Grounds). ORDINANCE NO. 5235 -70 AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, IVDIANA, CERTAIN LANDS. (South Bend Avenue, Edison and Ivy Road, South of and adjacent to Turtle Creek Apt. Complex) The Ordinance was given third reading. Councilman Wise made a motion for passage of the Ordi- nance. Councilman Palmer seconded the motion. There being no discussion on the motion, the Ordinance was passed by a roll call vote of 8 ayes, (Councilmen Laven, Allen, Reinke, Craven, Szymkowiak, Wise, Palmer and Zielinski) 0 nays, 1 absent (Councilman Grounds). f REGULAR MEETING SEPTEMBER 28, 1970 Council President Laven announced that because fallen on October 12th, Columbus Day, which is scheduled for October 13, 1970, (Tuesday). ORDINANCES, FIRST AND SECOND READING ORDINANCE the next scheduled Council meeting would have a legal holiday, the next Council meeting is AN ORDINANCE TO APPROPRIATE $22,819.47 FROM THE LOCAL ROAD AND STREET FUND TO THE ACCOUNT "SERVICES CONTRACTUAL ", BEING WITHIN THE LOCAL ROAD AND STREET FUND. The Ordinance was given first reading by title and second reading in full. Councilman Reinke made a motion, seconded by Councilman Zielinski, that the Ordinance be set for Public hearing on October 13, 1970. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Grounds). ORDINANCE AN ORDINANCE CREATING A DEPARTMENT OF ECONOMIC DEVELOPMENT TO PROVIDE FOR INDUSTRIAL EXPANSION. The Ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion, seconded by Councilman Craven, that the Ordinance be set for Public hearing on October 13, 1970. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Grounds). ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Chapter 40, Municipal Code). Northwest of Intersection of South Bend Avenue and Edison Road., Turtle Creek Apt. Complex). The Ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion, seconded by Councilman Palmer, that the Ordinance be set for Public hearing on October 13, 1970. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Grounds). UNFINISHED BUSINESS Councilman Craven said loitering around school buildings has become a major problem for the Police Department. They claim the dropouts have been giving them more trouble than the students. He suggested the Council discuss this in more detail with Attorney Parker of the Legal Department. Councilman Allen announced that letters had been mailed to various organizations and local trash haulers concerning the formation of a Committee to study the trash problem in South Bend. NEW BUSINESS Councilman Zielinski complained that Fisher Street, which is used as a detour around the Sample and Olive Street intersection, has been severly damaged. He said sidewalks, curbs and a fire hydrant won also damaged. City Engineer Lloyd Taylor agreed that Fisher Street should not have been used as a detour but that it would be restored and the damage repaired when the detour is removed. Council President Laven called attention to South Bend's recent avalanche of crimes, such as, vandalism, robbery and car thefts or just a general lack of order. He said 14 panes of glass from his place of business have been broken recently. He said he wondered why people have this total disregard for other people's property and hoped that something could be done about correcting the situation, however, what the solution was he didn't know. Councilman Szymkowiak asked that parents talk to their children and teach them not to damage other people's property. He said that School City spent $40,000 last year replacing school windows broken by vandals. There being no further business to come before the Council, Councilman Allen moved for adjourn- ment.
