<br />SEPTEMBER 28, 1970
<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council
<br />Chambers in the County -City Building on Monday, September 28, 1970 at 8:02 p.m. The meeting
<br />was called to order by Council President Robert 0. Laven. The invocation was given by Reverend
<br />George W. Phillips, Executive Director of Teens, Inc., 724 W. Washington Avenue, South Bend,
<br />Indiana.

<br />PRESENT: Councilmen Laven, Allen, Reinke, Craven, Szymkowiak
<br />Wise, Palmer and Zielinski.
<br />ABSENT: Councilman Grounds
<br />RESOLVE INTO COMMITTEE OF THE WHOLE
<br />Council President Laven entertained a motion to resolve the Council into the Committee of the
<br />Whole on the state of the City to consider the items listed on the agenda for the consideration
<br />of the Committee of the Whole. Councilman Zielinski so moved and Councilman Craven seconded the
<br />motion. Time: 8:05 p.m.

<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the County -
<br />City Building, in the Committee of the Whole, in the Council Chambers on Monday, September 28,
<br />1970 at 8:06 p.m. In the absence of Chairman William Grounds, the meeting was called to order
<br />by Council Vice - President Gerald C. Reinke, who presided.
<br />ORDINANCE
<br />AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CIVIL
<br />CITY OF SOUTH BEND AND THE CITY OF SOUTH BEND
<br />DEPARTMENT OF REDEVELOPMENT FOR THE CONVEYANCE OF
<br />TWO PARCELS OF REAL ESTATE LOCATED IN THE CITY OF
<br />SOUTH BEND AND OWNED BY THE CIVIL CITY OF SOUTH
<br />BEND.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard thereon. Chief Deputy City Attorney Robert
<br />Parker spoke in behalf of the City who stated that new srate statutes authorize the city admin-
<br />istration to make transfers of real estate to another-city agency without Council approval, how-
<br />ever before a deed can be executed,by the Mayor, the ordinance for conveyance of the land to
<br />another body and approving the sale, must be passed by the Common Council. Councilman Allen
<br />objected to the demolition of the old City Hall building and stated that other cities are spending
<br />millions of dollars to restore buildings much older than our City Hall so that they will have
<br />some character left in their city. Also opposed to the demolition was Mrs. Fredrick Mutzl, 320
<br />Parkovash, South Bend, Indiana. In reply to Councilman Laven's inquiry as to what the use of
<br />this site will be in the downtown renewal program, Mr. B. 0. Ashenfelter, executive director of
<br />the Redevelopment Department, said it has a retail credit use involved but could be changed.
<br />City Engineer Taylor said the building roof was in bad condition and the building was in need
<br />of many repairs. He also stated that for the transfer and demolition the city will be given
<br />$263,712 in non -cash credits by the federal government, which means the city will get about
<br />$750,000 in grants for downtown renewal. Attorney Parker said the two parcels of real estate
<br />involved are one parcel which was formerly used and occupied by the Water Works on Lincoln Way
<br />and Washington Streets and the site which was formerly used and occupied by the city as a City
<br />Hall and parking lot. Councilman Szymkowiak made a motion, seconded by Councilman Craven, that
<br />the Ordinance go to the Council as favorable. Motion carried. 7 ayes, 1 nay, 1 absent (Council-
<br />man Grounds).

<br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO ACCOUNT
<br />L -722, "MOTOR EQUIPMENT in the amount of $5,300.00 TO
<br />ACCOUNT L -725, "OFFICE EQUIPMENT" IN THE AMOUNT OF
<br />$600.00 AND TO ACCOUNT L -726, "OTHER EQUIPMENT" IN THE
<br />AMOUNT OF $1,100.00 AND THE TRANSFER OF SAID SUMS FROM
<br />ACCOUNT L -11, "SERVICES PERSONAL ", ALL BEING IN THE
<br />ENGINEERING DEPARTMENT AND ALL BEING WITHIN THE GENERAL
<br />FUND.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard thereon. City Engineer Lloyd Taylor explained
<br />that the funds were needed for the purchase of two automobiles; one of which will be used by
<br />Mr. Cecil McHenry who is in charge of weed control and abandoned vehicles; the other being a
<br />Van -type automobile; a new typewriter for the Engineering Department and radios to be used in
<br />cars. He stated the surplus funds in the account L-11 were being transferred to these accounts
<br />for the purchase of the items listed, subject to the approval of the Council. Councilman Szym-
<br />kowiak made a motion, seconded by Councilman Palmer, that the ordinance go to the Council as
<br />favorable. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Grounds).
