HomeMy WebLinkAbout06-22-70 Council Committee of the Whole Meeting MinutesREGULAR MEETING JUNE 22, 1970 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers in the County -City Building on Monday, June 22, 1970, at 8:07 p.m., with all members present. The meeting was called to order by Council President Robert 0. Laven. The invocation was given by Council President Robert 0. Laven. PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski ABSENT: None Council President Laven entertained a motion to resolve the Council into the Committee of the Whole on the state of the City to consider the items listed on the agenda for the consideration of the Committee of the Whole. Coundlman Zielinski so moved and Councilman Craven seconded the motion. Motion carried. The meeting was called to order by Chairman William W. Grounds, who presided. ORDINANCE AN ORDINANCE SUPPLEMENTING ORDINANCE NO. 4268 -59 (Municipal Code Chapter 20) BY ADDING A NEW ARTICLE DEALING WITH VACANT STRUCTURES AND PROVIDING FOR A PENALTY. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents,were given an opportunity to be heard thereon. City Attorney S. J. Crumpacker said this ordinance would make provisions in the City's Municipal Code to cover vacant structures or abandoned buildings which have remained completely or partially open to the public due to negligence of the owner. The these structures are used by trespassers and have become unkempt and unsound and have become nuisances which adversely affect the public health, safety and contribute to the decay of commercial and residential areas. He said the ordinance also provides a penalty if the owner does not comply with the order of the Building Commissioner or Board of Public Works and Safety when notified of the violation of this ordinance. was The motion /made by Councilman Allen, seconded by Councilman Palmer, and carried, to accept the following amendments: (Councilman Laven recommended Amendment #5.) (Amendment #1 Page 2, Sec. 20 -35, line one, after words "entry court; insert "or stairwell" Amendment #2 Page 2, Sec. 20 -35, line three, delete word "four" after words "depth of" and substitute word "two" Amendment #3 Page 3, Sec. 20 -37, final paragraph (c), after the words "Building Commissioner" insert "or of the Board of Public Works and Safety if an appeal is taken" Amendment #4 Page 2, Sec. 20 -35, line one, after the words "Any alcove ", delete word "or" and, insert a comma Amendment #5 Page 2, second paragraph, after the words "public easements ", insert the words "or which might constitute a public hazard to the public easement," Councilman Allen moved to accept Amend. 41r5.. Councilman Craven seconded her motion to accept Amendment #5. Motion carried. Councilman Allen made a motion, seconded by Councilman Zielinski, that the ordinance go to the Council favorable, as amended. Motion carried. ORDINANCE AN ORDINANCE AMENDING CHAPTER 9, SECTION 9 -2, ORDINANCE NUMBER 4381 -61, SEC. 1, OF THE MUNI- CIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, PROVIDING FOR THE ADOPTION OF A BASIC BUILDING CODE. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Building Commissioner, Forrest West, explained this ordinance would update the City Building Code to the year 1970. Councilman Palmer made a motion, seconded by Councilman Zielinski that the ordinance go to the Council as favorable. Motion carried. ORDINANCE AN ORDINANCE AMENDING CHAPTER 9, SECTION 9 -3, ORDINANCE NUMBER 4381 -61, ARTICLE 32, SECTION 1700.0, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, PROVIDING FOR THE STAN- DARDS OF ACCEPTED ENGINEERING PRACTICE OF PLUMBING SERVICES GENERALLY. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Building Commissioner, Forrest west, explained this ordinance would update the City Plumbing Code by adopting the Administrative Building Council of Indiana - Plumbing Rules and Regulations - Volume III - 1968. Councilman Allen made a motion, seconded by Councilman Zielinski, that the ordinance go to the Council as favorable. Motion carried. 6352 ORDINANCE COMMITTEE OF THE WHOLE MEETING JUNE 22, 1970 AN ORDINANCE AMENDING CHAPTER 11, SECTION 11 -18, ORDINANCE NUMBERS 3913, SEC. 7, AND 4537 -62, SEC. 3, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, PROVIDING FOR, STANDARDS FOR INSTALLATION OF ELECTRICAL EQUIPMENT GENERALLY. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Building Commissioner, Forrest West, explained this ordinance updated the South Bend Municipal Code to conform with the regulations set forth in the National Electrical Code of 1968 and all amendments thereafter, or electrical provisions of other safety codes which have been approved by the American Standards Association. Councilman Zielinski made a motion, seconded by Councilman Craven, that the Ordinance go to the Council as favorable. Motion carried. 11 ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 4150, BEING SECTION 2 -18, OF THE MUNICIPAL CODE, RELATING TO ANNUAL LEAVE OF OFFICERS AND EMPLOYEES OF THE CITY, AS AMENDED. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Kenneth W. Buhle, 1532 Vernerlee Lane, South Bend, spoke in favor of the ordinance. He said the schedule was an improvement in City fringe benefits, but was inferior to most agreements negotiated in private industry. Mr. Buhle represented the Teamsters Local #364 of South Bend. Mrs. Lee E. Swan, 2022 Swygart Ave., South Bend spoke against the ordinance. Councilman Reinke said this ordinance would clarify the vacation schedule as it is now in the Municipal Code book. Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. Motion was defeated. Councilman Laven made a motion for the acceptance of the following amendments: Amendment #1 In Section I, Item (a), #2 In line #2, delete the word "eleven" and substitute the word "ten ". (Motion carried, 8 ayes, 1 nay) Amendment #2 In Section I, Item (a), #3 In line #1 delete the words "more than nine" and substitute the words "ten years ". (Motion carried, 8 ayes, 1 nay) Amendment #3 In Section I, Item (a), #4 In line #1 delete the words or more ". Amendment #4 "more than nineteen" and substitute the words "twenty (Motion carried, 8 ayes, 1 nay) In Section I, Item (d), #4 In line #1 after the words "shall mean ", delete the remainder of the sentence, and, substitute the words "uninterrupted employment by the City." (Motion carried, 8 ayes, 1 nay) Councilman Allen seconded Councilman Laven's motion. Motion carried, 8 ayes, 2 nays. Councilman Laven made a motion, seconded by Councilman Allen, that the Ordinance go to the Council favorable, as amended. Motion carried, 8 ayes, 2 nays. There being no further business to be considered before the Committee of the Whole, Chairman Grounds entertained a motion to rise and report to the Council.
