CITIZENS REQUESTS - MISCELLANEOUS MATTERS Mr. Charles Nix, 4102 W. Washington St., complained of rats and unsightliness of a dump on the North side of Linden Ave. in the LaSalle Park Area on the far West side of South Bend. HE� showed the Councilmen pictures of the area. The Council recommended he confer with the Board of Public Works and Safety. REGULAR MEETING JUNE 8, 1970 PETITIONS Petition to amend Zoning Ordinance We, the undersigned, do hereby respectfully make application and petition the Common Council of the City of South Bend to amend the Zoning Ordinance of the City of South Bend as hereinafter requested, and in support of this application, the following facts are shown: 1. The property sought to be rezoned is located at the North side of Sample Street immediately East of and contiguous to the Cities Service Oil Company service station located on the Northeast corner of the intersection of Mayflower Road and Sample Street (5323 West Sample Street), South Bend, Indiana. 2. The property is owned by Colpaert Realty Corporation. Cities Service Oil Company has an option to purchase the property subject to rezoning. 3. A legal description of the property is as follows: A part of Area 1 as shown on the recorded replat of Belleville Unit "D ", an addition to the City of South Bend, Indiana more particularly described as follows: Beginning at a point on the South line of said Area 1, 125 feet East of the Southwest corner of said Area 1, 75 feet; thence North parallel with the West line of said Area 1, 163.48 feet; thence West parallel with said South line of Area 1, 75 feet; thence South parallel with said West line of Area 1, 163.48 feet to the place of beginning. 4. It is desired and requested that the foregoing property be rezoned: From "C -1" Use and "D" Height and Area District TO "C" Commercial Use and "D" Height and Area District. 5. It is proposed that the property will be put to the following use and the follow- ing buildings will be constructed (include number of dwelling units if residential) Property to be blacktopped and landscaped for parking purposes in conjunction with the operation of the present Cities Service Oil Company automotive service station located immediately to the West. 6. Number of off street parking spaces to be provided is: fourteen (14). 7. Attached is a copy of: (a) an existing plot plan showing the property and other surrounding properties; (b) names and addresses of all the individuals, firms or corporations owning property within 300 feet of the property sought to be rezoned; (c) site development plan. COMMITTEE REPORTS REPORT FROM THE ORDINANCE COMMITTEE To the Common Council of the City of South Bend: Your Committee: The Ordinance Committee June 4, 1970 Councilmen Grounds, Allen, Wise & Zielinski to whom was referred "A RESOLUTION OF COOPERATION TO ESTABLISH A RESOURCE SERVICES CENTER FOR DISPENSING OF SERVICES TO THE CITI- ZENS OF SOUTH BEND AND SURROUNDING AREAS, AS AMENDED.' respectfully report that they have examin- ed the matter and that in their opinion the Ordinance Committee recommends adoption of the Resolution as it is written. /s/ William W. O REGULAR MEETING JUNE 8, 1970 REPORT FROM THE ORDINANCE COMMITTEE �To the Common Council of the City of South Bend: June 4, 1970 Your Committee The Ordinance Committee Councilmen Grounds, Allen, Wise and Zielinski to whom was referred "AN ORDINANCE AMENDING SECTION 23 (c) OF ORDINANCE 4990 -68, BEING SECTION 40 -8 (C) OF THE MUNICIPAL CODE, RELATING TO ACTION BY THE COMMON COUNCIL ON UNFAVORABLE REPORTS FROM THE AREA PLAN COMMISSION" respectfully report that they have examined the matter and.that in their opinion the Ordinance Committee has recommended that the Council obtain an opinion from the State Research Council concerning this Ordinance. /s/ William W. REPORT FROM THE ORDINANCE COMMITTEE To the Common Council of the City of South Bend: June 4, 1970 Your Committee The Ordinance Committee Councilmen Grounds, Allen, Wise and Zielinski to whom was referred "AN ORDINANCE REGULATING THE BURNING OF REFUSE AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF" respectfully report that they have examined the matter and that in their opinion before taking further action on the above Ordinance, The Ordinance Committee recommends the Common Council consider the action and decisions of the St. Joseph County Board of Health and the St. Joseph County Commis- sioners on the proposed County Pollution Ordinance. /s/ William W. RESOLUTION RESOLUTION NO. 239 -70 RESOLUTION OF COOPERATION TO ESTABLISH A RESOURCE SERVICES CENTER FOR DISPENSING OF SERVICES TO THE CITIZENS OF SOUTH BEND AND SURROUNDING AREAS, AS AMENDED. WHEREAS, health and welfare services for the needy are scattered throughout the City of South Bend and, WHEREAS, a large percentage of the citizens of Portage Township, served by the Depart- ment of Health, the Department of Public Welfare, the Township Trustee, and the Legal Aid Society reside in the City of South Bend, NOW, THEREFORE, BE IT RESOLVED, THAT THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, agree to co- operate with the County Commissioners of St. Joseph County to review the necessity and method of providing a building to centralize the services departments into one location which is easily accessible to all citizens, which will contain a master file listing all recipi- ents of the various services and the departments rendering such services, and which will con- solidate and co- ordinate all services. Council President Laven asked ISO REGULAR MEETING JUNE 8, 1970 (RESOLUTION (Resource Services Center, Cont'd.) ,RESOLUTION NO. 239 -70 the Clerk to read the following report: ITo the Common Council of the City of South Bend: June 8, 1970 Your Committee, The Public Improvement Committee, to whom was referred "RESOLUTION OF COOPERATION TO ESTABLISH A RESOURCE SERVICES CENTER FOR DISPENSING OF SERVICES TO THE CITIZENS OF SOUTH BEND AND SURROUNDING AREAS, AS AMENDED," respectfully report that they have examined the matter and that in their opinion, The resolution be recommended favorably to the Common Council, as amended. /s/ Janet S. Allen Chairman Miss Virginia Guthrie, Executive Secretary of the South Bend Civic Planning Association, spoke against the resolution. Councilman Allen said such a center would eliminate duplication of services and welfare assistance and would result in savings. She said this resolution is only agreeing that the Council will cooperate with the County Commissioners in establishing such an office. She said the administrative offices would be in the County -City Building but the dispens- ing services would be available at the center. Councilman Zielinski made a motion for the adoption of the resolution. the motion. Motion carried. 8 ayes (Councilmen Laven, Craven, Allen, Zielinski and Szymkowiak) 0 nays, 1 absent (Councilman Palmer) 1I NEW BUSINESS Councilman Reinke seconded Reinke, Grounds, Wise, Councilman Allen recommended strict enforcement of cracking down on the number of false fire alarms being turned into the Fire Department. Councilman Grounds said the Fire Chief is looking into a new type of alarm system that would eliminate many false alarms. Councilman Allen also said the hippie population in the City is welcome as long as they behave. Councilman Zielinski said he would like an explanation as to why the City is paving roads in newly- annexed areas where the population is low while residents in the City who have been paying taxes for many years have to do without paving. Councilmen Zielinski and Council President Laven asked the Clerk to send a memo to the Board of Public Works & Safety asking for an explana- tion concerning the paving of such areas. (There being no further business to come before the Council, Councilman Wise moved for adjournment. Councilman Craven seconded the motion. Motion carried.
