Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council
Chambers in the County -City Building on Monday, June 8, 1970, at 8:04 p.m. The meeting was
called to order by Council President Robert 0. Laven. The invocation was given by Reverend Matt
Kafka, St. Adalbert Church, South Olive Street, South Bend, Indiana.
ROLL CALL
PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds,
Szymkowiak, Wise and Zielinski
ABSENT: Councilman Palmer
Council President Laven entertained a motion to resolve the Council into the Committee of the
Whole on the state of the City to consider the items listed on the agenda for the consideration
of the Committee of the Whole. Councilman Allen so moved and Councilman Zielinski seconded the
motion. Motion carried. Time: 8:05 p.m.

of the Whole in the Council Chambers of the County -City Building on Monday, June 8, 1970, at
8:06 p.m. The meeting was called to order by Chairman William W. Grounds, who presided.

AN ORDINANCE AMENDING ORDINANCE NO. 4150,
BEING SECTION 2 -18 OF THE MUNICIPAL CODE,
RELATING TO ANNUAL LEAVE OF OFFICERS AND
EMPLOYEES OF THE CITY.
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Chairman Grounds asked the Clerk to
read the following report from the Ordinance Committee:

to whom was referred "AN ORDINANCE AMENDING ORDINANCE NO. 4150, BEING SECTION 2 -18 OF THE MUNI-
CIPAL CODE, RELATING TO ANNUAL LEAVE OF OFFICERS AND EMPLOYEES OF THE CITY" respectfully report
that they have examined the matter and.that in their opinion this ordinance amending Section
2 -18 of the Municiple Code, of Ord. 4150, Annual Leave, be amended as follows:
In Section I, Item (a), #3
In line #1 delete the words "more than nine" and
substitute the words "ten years ".
In Section I, Item (a), #4 0
In line #1 delete the words "more than nineteen" and
substitute the words "twenty or more ".
In Section I, Item (d)
In line #2 and #3, delete the words "the cumulative
total of years worked for the City, in the event that
employment by the City has not been continuous,"
And add, after the word "employees," (line #4 of Item (d).)
the following: "with continuous employment by the city ".

Councilman Wise made a motion the report from the Ordinance Committee be accepted and
nance be sent back to the Ordinance Committee for further study and the Public Hearin
Ordinance be continued on June 22, 1970. Councilman Szymkowiak seconded the motion.
carried. Miss Virginia Guthrie, Executive Secretary of the South Bend Civic Planning
said she will postpone her remarks until the continued public hearing.

AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE
CITY OF SOUTH BEND, INDIANA -1962 SECTION 40 AS
AMENDED AND GENERAL ORDINANCE NO. 4990 -68, AND
THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS
THE SOUTH BEND ZONING ORDINANCE BY CHANGING THE
CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN
PARCEL OF LAND. (Commonly known as the Barnhart
property, approximately] 100 feet north of Jackson
Road, .recently annexed to the City of South Bend,
Indiana, on Miami Hwy.)

This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Mr. Doug Carpenter, Senior Planner,
Area Plan Commission, explained that this parcel of land is now being used residentially and was
recently annexed to the city. He said the expiration date for zoning of this property is soon,
thus it must be zoned before the date of expiration. He stated the staff recommended the property
be zoned "A" Residential and "A" Height and Area to conform with its present use. Councilman
Laven made a motion, seconded by Councilman Reinke, that the Ordinance go to the Council as
favorable. Motion carried.

of Jackson Road, recently annexed to the City of

This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Mr. Doug Carpenter, Senior Planner,
Area Plan Commission, explained that this land is now being used residentially and was recently

There being no. further business to be considered before the Committee of the Whole, Chairman
Grounds entertained a motion to rise and report to the Council. Councilman Allen so moved,
seconded by Councilman Wise. Motion carried. Time 8:14 p.m.
