Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council
Chambers in the County -City Building on Monday, April 13, 1970 at 8:00 p.m., The meeting was
called to order by Council President Robert 0. Laven. The invocation was given by Reverend
Joseph Jacobs, St. John The Baptist Catholic Church, 3616 St. Johns Way, South Bend, Indiana.

PRESENT: Councilmen Laven, Allen Reinke, Craven, Grounds, Szymkowiak
Palmer and Zielinski.
ABSENT: Wise
Council President Laven entertained a motion to resolve the Council into the Committee of the
Whole on the state of the City to consider the items listed on the agenda for the consideration
of the Committee of the Whole. Councilman Grounds so moved and Councilman Reinke seconded the
motion. Motion carried. Time: 8:03 p.m.

of the Whole in the Council Chambers of the County -City Building on Monday, April 13, 1970, at
8:04 p.m. The meeting was called to order by Chairman William W. Grounds, who presided.

AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS
AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF
THE CITY OF SOUTH BEND, INDIANA (Chapter 40,
Municipal Code), AS AMENDED. (600 ft. S. of Ireland
Road, on Miami Road)
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Speaking in behalf of the petitioners
was Attorney Stephen A. Seall. He said the petitionere, Mr. & Mrs. Robert R. Allen, intend to
build an attractive building to be used as a self - service laundromat and car wash. He stated
that the site plan has been altered at the suggestion of the Area Plan Commission. Councilman
Laven made a motion to amend the Ordinance as follows:
In Section I, last sentence in Section I, delete the period at the end of the sentence
and insert after the word "District "to conform with the site development plan attached
and made a part hereto.
Councilman Palmer seconded the motion. Motion carried. Councilman Reinke made a motion that
the Ordinance go to the Council favorable, as amended. Councilman Palmer seconded the motion
Motion carried.

AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND
CERTAIN TERRITORY CONTIGUOUS THERETO. (Lilac,
Darden and Brick Roads)
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. A group of German Township residents
spoke against the Ordinance. They were: Philip D. Barkley, 50690 Portage Highway, South Bend;
Earl Harness, 52698, Lynnewood Road, South Bend; Charles E. Bode, 22922 Adams Road, South Bend;

Eugene Gorbacz, 21317 Mays Drive, South Bend; and Charles L. Schosker, 23381 Adams Road, South
Bend. Councilman Allm stated that any petitioner who owns the land has the legal right to ask
to be annexed. Attorney William E. Voor, representing the petitioner, Mr. Leo Lippman, an
Indianapolis real estate developer, said that his client had no intention of bringing hardship
on anyone. He said Mr. Lippman had developed other subdivisions in the city, including River-
side Manor, and that sewer and water lines to the proposed annexed area will be installed at the
petitioner's cost. He stated that a_ petition to give the tract the required zoning will be
filed at a later date. The petitioner, he stated,plans to erect multiple- family apartment
houses and some single- family houses.
Councilman Craven made a motion that the Ordinance go to the Council as unfavorable. Councilman
Palmer seconded the motion. Motion defeated.
Councilman Laven made a motion that the Ordinance go to the Council as favorable. Councilman
Reinke seconded the motion. Motion carried.
There being no further business to be considered before the Committee of the Whole, Chairman
Grounds entertained a motion to rise and report to the Council. Councilman Laven so moved,
seconded by Councilman Allen. Motion carried. Time: 9:20 p.m. Councilman Laven enter-
tained a motion for a short recess. Councilman
Zielinski then made a motion for a short recess. Councilman Allen seconded the motion. Motion
carried.
