The meeting was called to order by Council President Robert 0. Laven, who presided. REPORT FROM COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have inspected the minutes of the February 24, 1970 meeting of the Council and found them correct. CITIZENS REQUESTS - MISCELLANEOUS MATTERS Mr. Leo Wallisch, Laporte Avenue, South Bend, asked the Councilmen to inaugurate a City -wide program to support our local Police Department and introduce a resolution to make it official. REPORT FROM AREA PLAN COMMISSION February 18, 1970 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Harold D. VanSleete, etal, was legally advertised on February 17, 1970. The following action was taken: After due consideration it was moved, seconded and carried that the ordinance and site development plan be recommended favorably to the Common Council. REPORT FROM THE ANNEXATION COMMITTEE To the Common Council of the City of South Bend: March 9 , 1970 Your Committee the Annexation Committee to whom was referred "A Petition to Annex land located at Lilac, Darden & Brick Roads" respectfully report that they have examined the matter and that in their opinion; We believe the petitioned annexation to be in the best interests of the City and offer the Annexation Ordinance for this area on the agenda for First & Second Reading, March 9, 1970. /s/ Robert 0. Bickel answered questions from the Councilmen, each councilman having received a copy of the January, 1970 report. The report was accepted as submitted and placed on file. REPORTS OF THE COMMITTEE OF THE WHOLE Council President Laven entertained a motion to waive the reading of the Committee of the Whole Reports. Councilman Allen so moved, seconded by Councilman Grounds. The Ordinance was given third reading. Councilman Allen suggested that next year when the Ordi- nance is presented to the Council, the items be separated and placed on individual ordinances. Councilman Reinke made a motion, seconded by Councilman Wise, for passage of the Ordinance. There being no further discussion on the motion the Ordinance was passed by a roll call vote of 6 ayes (Councilmen Laven, Craven, Reinke, Grounds, Wise and Palmer) 3 nays (Councilmen Allen, Szymkowiak and Zielinski) IIORDINANCE NO. 5157 -70 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF THE CITY OF SOUTH BEND, INDIANA AND GARNER'S PLUMBING & HEATING PIPING CONTRACTOR OF ARGOS, INDIANA, FOR A SEWER REPAIR AT 1141 CAMPEAU STREET, SOUTH BEND, INDIANA, IN THE AMOUNT OF $3,900.00. There being no discussion on the motion, the Ordinance was passed by a roll call vote of 9 ayes (Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski) 0 nays. 32 REGULAR MEETING MARCH 9, 1970 ORDINANCES, THIRD READING ORDINANCE NO. 5161 -70 AN ORDINANCE AUTHORIZING THE TRANSFER OF $1,077.55 FROM THE SANITATION FUND AND $6,780.90 FROM THE MUNICIPAL BONDS OF 1962 FUND TO THE GENERAL SINKING FUND OF THE CITY OF SOUTH BEND, INDIANA. The Ordinance was given third reading. Councilman Grounds made a motion, seconded by Councilman Zielinski, for-passage of the Ordinance. There being no discussion on the motion, the Ordinance passed by a roll call vote of 9 ayes (Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski) 0 nays. ORDINANCES, FIRST & SECOND READING ORDINANCE NO. 5162 -70 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAKING OF A TEMPOR- ARY LOAN FOR THE GENERAL FUND AND THE ISSU- ANCE AND SALE OF WARRANTS OF THE CITY FOR SUCH PURPOSE, AS AMENDED. The Ordinance was given first reading by title and second reading in full. Councilman Craven made a motion for suspension of the rules. Councilman Palmer seconded the motion. Motion carried unanimously. City Controller James A. Bickel explained that the money that is usually available from the County Treasurer's Office is not there due to the confusion in the reassess- ment program. He noted that the St. Joseph County Board of Review is still holding hearings on appeals of new real estate assessments, therefore, funds are not available to make tax advances to the City because levies for the various townships have not yet been approved by the Indiana State Board of Tax'Commissioners. Planning (Miss Virginia Guthrie, Executive Secretary of the South Bend Civic/Association, stated this was a very unusual situation because the township trustees were late in getting started on this program. She also said she supported Mr. Bickel on this loan and that he may have to apply for another loan in the near future. Councilman Reinke made a motion that the Ordinance be passed. Councilman Palmer seconded the motion. Motion carried by a roll call vote of 9 ayes (Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski) 0 nays, 0 absent.' ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 4990 - CHAPTER 40 OF THE MUNICIPAL CODE (formerly Zoning Ordinance No. 3702) (Location: 4001 & 4015 South Main Street) (Post Office) The Ordinance was given first reading by title and second reading in full. Councilman Reinke made a motion, seconded by Councilman Palmer, that the Ordinance be set for Public Hearing on March 23, 1970. Motion carried ORDINANCE AN ORDINANCE ALLOWING FUNDS TO BE TEMPORARILY TRANSFERRED FROM THE TRACK ELEVATION FUND TO THE MODEL CITIES FUND. The Ordinance was given first reading by title and second reading in full. Councilman Grounds made a motion, seconded by Councilman Craven that a public hearing be held at a Special Meeting, March 13, 1970 at 8:30 a.m. in the Council Chambers in the County -City Building. Motion carried unanimously. ORDINANCE AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY CONTIGUOUS THERETO. (Location: Lilac, Darden & Brick Roads) The Ordinance was given first reading by title and second reading in full. Councilman Grounds made a motion, seconded by Councilman Craven, that the Ordinance be set for Public Hearing on March 23, 1970. Motion carried. 3 REGULAR MEETING MARCH 9, 1970 RESOLUTIONS RESOLUTION A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, AUTHORIZING SUBMISSION OF A COMPREHENSIVE CITY DEMONSTRATION PROGRAM. A public hearing on the above Resolution was held at this time. Speaking in behalf of the Model Neighborhood Planning Agency, Charles F. Lennon, Program Director, said it is urgent that the Council give its approval of the Comprehensive City Demonstration Program because the plan has to be in the Chicago Office of the U. S. Department of Housing and Urban Development by 5:00 p.m. Friday, March 13, 1970. He said the One -year planning period ends Saturday. Also speaking for the adoption of the Resolution were Odell Newburn, Chairman of the Planning Board of the Model Cities Program and Jesse L. Dickinson, Attorney and member of the Planning Board who stated that the assests of the program outweigh the liabilities but there will be changes made later. Speaking against the Resolution were Floyd Carter, 1619 Fassnacht St., South Bend; Norma Ganaway, 214 Birdsell St., South Bend and Norma Lynk, 121 N. Studebaker St., South Bend. Council - President Laven announced this public hearing will be continued at a Special meeting to be held March 13, 1970 at 8:30 p.m. and pointed out to the residents that the Model Cities Progra is one that aims to improve all aspects of a neighborhood, physical, social,educational, recrea- tional and others. Councilman Allen said she would like to see the details of the program and Mr. Lennon replied that details will be worked out within the next 90 -days and he will see that she receives copies of them. RESOLUTION A RESOLUTION ESTABLISHING A RESOURCE SERVICES CENTER FOR DISPENSING OF SERVICES TO THE CITIZENS OF SOUTH BEND AND SURROUNDING AREAS. A public hearing was held at this time on the above Resolution but was postponed until March 23, 1970. Councilman Palmer made a motion that the public hearing be continued on March 23, 1970 and Councilman Craven seconded the motion. Motion carried. This Resolution would establish a Resource Services Center in which the St. Joseph County Welfare Department, Health Department, Legal Aid Department and other agencies could be housed in one building. Miss Virginia Guthrie objected to such an establishment. Wilmer H. Tolle, executive director of the St. Joseph County Welfare Department said such a centralized service is needed and that when his department moves into the new County -City Building, traffic caused by recipient: will become a problem. City Attorney S. J. Crumpacker said the services center has been under discussion for several months and is envisioned as a center where a file would be available on al: persons involved with service agencies, and would provide information to residents on where to go for help. UNFINISHED BUSINESS In response to Council - Presidents request, Councilman Allen, Legislative Committee Chairman gave a report on the City's right to purchase a parking lot for city employees at 117 S. Lafayette Blvd. for $70,000.00. She read all the applicable laws but stated that her committee could not meet with her and the City Attorney did not have time to review the statutes with her, however, after all her research, she still believes the administration had no right to buy the tract without Council approval. She stated that the Cumulative- Capitol improvement funds should 'al- ways be used for - public "- benefits,Inot fora restricted parking lot for certain departmental - workers.
