ROLL CALL JANUARY 26, 1970 City of South Bend, Indiana, met in the Council January 26, 1970 at 8:08 p.m., with all members ancil Preident Robert 0. Laven. The invocation Congregational Church, 19671 Cleveland Road, PRESENT Councilmen Laven, Arlen, Reinke, Craven, Grounds Szymkowiak, Wise, Palmer and Zielinski. ABSENT None. Council- President Laven entertained a motion to resolve the Council into the Committee of the Whole on the state of the City to consider the items listed on the agenda for the consideration of the Committee of the Whole. Councilman Allen so moved and Councilman Wise seconded the motion. Motion carried. The Grounds, who presided. ORDINANCE of the City of South Bend, Indiana, met in the Committee the County -City Building on Monday, January 26, 1970, meeting was called to order by Chairman William W. AN ORDINANCE TO AMEND SEVERAL SECTIONS OF ORDINANCE NO. 4838 -66, ENTITLED "AN ORDI- NANCE REPEALING CHAPTER 36 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962 RELATING TO TAXICABS AND OTHER VEHICLES AND ENACTING AN ORDINANCE REGULATING TAXI- CABS AND TAXICAB DRIVERS: PROVIDING FOR TAXICAB STANDS ON THE PUBLIC STREETS: PROVIDING PENALTIES FOR THE VIOLATION THEREOF ", AS AMENDED. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. City Controller James A. Bickel ex- plained the Ordinance to the Councilmen, stating that this ordinance puts the licensing procedures for taxicab drivers in the hands of the City Controller, instead of the Board of Public Works & Safety, and if there is disapproval, the person has the right to appeal to the Board of Public Works & Safety. Councilman Allen moved, seconded by Councilman Craven, that the Ordinance be returned to the Ordinance Committee for amendments (public liability and numbering of sections to conform with those in the amended Code Book) and the public hearing be continued on February 9, 1970. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF SOUTH BEND, INDIANA AND GATES CHEVROLET, INC., OF SOUTH BEND, INDIANA FOR THE PURCHASE OF VARIOUS PIECES OF EQUIPMENT TOTALING $7,841.00. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. John L. Hunter, Director of Utilities, explained the need for the contract. He stated the units described in the Ordinance are for the normal replacement program at the plant. Gates was the low bidder and since the trucks met specifications, the Board approved the purchases on Jan. 5, 1970. Councilman Palmer moved, ,seconded by Councilman Wise, that the Ordinance go to the Council as favorable. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA AND GATES CHEVROLET, INC., OF SOUTH BEND, INDIANA, FOR THE PURCHASE OF TWO (2) 1970 CHEVROLET VAN TRUCKS IN THE AMOUNT OF $3,538.00. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. John L. Hunter, Director of Utilities, explained that these two Van Trucks.will be used by the Meter Department for installation and removal of meters, stop box and repair work done by this division. He stated that trade -in units are a 1964 International Truck and a 1964 Willy's Jeep. The Board of Water Works Commis- sioners approved and entered into the contract with Gates on Jan. 5, 1970. Councilman Laven moved, seconded by Councilman Craven, that the Ordinance go to the Council as favorable. -Motion carried. nRnTNAVrR AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF SOUTH BEND, INDIANA AND MYERS- SHERMAN COMPANY, STREATOR, ILLINOIS, FOR THE PURCHASE OF ONE (1) VACUUM CATCH BASIN CLEANER AND FLUSHER WITH ATTACH- MENTS AND A JET RODDER AS USED WITH THE CATCH BASIN CLEANER IN THE SUM OF $27,447.00 This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. John L. Hunter, Director of Utilities, stated that this piece of equipment is to clean and maintain the sewer system (under 24- inches in diameter). It will reduce the dragging crews from three to two crews and will institute preventive maintenance program and release two drag crews to clean sewers that have not been serviced for years and are difficult to clean. Mr. Hendrickson, a representative from Myers - Sherman Company answered questions of the Councilmen. Councilman Zielinski moved, seconded by Councilman Wise, that the Ordinance go to the Council as favorable. Motion carried. COMMITTEE OF THE WHOLE MEETING JANUARY 26, 1970 ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA AND ROMP HAMMES FORDLAND FOR FOUR (4) 4 -DOOR SEDANS IN THE SUM OF $7,547.93. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. John L. Hunter, Director of Utilities explained that two cars were involved in accidents and ordinarily would be traded about the first of June and the other two cars are in bad condition and repair costs are becoming high. Councilman Palmer,moved, seconded by Councilman Zielinski, that the Ordinance go to the Council as favorable. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF SOUTH BEND, INDIANA AND TEETER GMC TRUCK, INCOR- PORATED OF SOUTH BEND, INDIANA, FOR THE PURCHASE OF ONE 45,000 GVW CAB AND CHASSIS IN THE AMOUNT OF $10,275.00. This being the time heretofore set for public hearing on the above,Ordinance, proponents and opponents were given an opportunity to be heard thereon. John L. Hunter, Director of Utilities stated that this truck is being purchased for use with the new sewer jet vacuum catch basin cleaner. It is a necessity for the unit to operate, he stated. Councilman Szymkowiak moved, seconded by Councilman Wise, that the Ordinance go to the Council as favorable. Motion carried, 8 ayes, (Councilmen Laven, Allen, Reinke, Grounds, Szymkowiak, Wise, Palmer, and Zielinski'. 1 nay, (Councilman Craven) ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF SOUTH BEND, INDIANA AND' GENERAL EQUIPMENT & MACHINE COMPANY, INCOR- PORATED OF SOUTH BEND, INDIANA, FOR THE PURCHASE OF A 1970 GENERAL ENGINES EAGER BEAVER TRAILER IN THE AMOUNT OF $2,870.00. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. John L. Hunter, Director of Utilities explained that this Ordinance is for the purchase of a new trailer which will be used to haul the crane and bulldozer to the various construction and maintenance work sites, replacing a 1951 Dodge Truck & Trailer which will be traded in on this unit. The Dodge unit is worn out and not reliable he stated. Councilman Reinke moved, seconded by Councilman Zielinski, that the Ordinance go to the Council as favorable. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF SOUTH BEND, INDIANA AND O'BRIEN MANUFACTURING COMPANY, INC., CHICAGO, ILLINOIS, FOR THE PURCHASE OF ONE (1) O'BRIEN SEWERKING MODEL 250 SEWER RODDING MACHINE IN THE SUM OF $2,171.75. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. John L. Hunter, Director of Utilities, explained that this equipment will be used to clean out from the catch basin to -the sewer. it will clean out roots from the catch basin to the sewer. At the present time, a small roto- rooter is being used but it is old and inadequate in its performance and will be used only in an emergency. Councilman Zielinski moved, seconded by Councilman Palmer, that the Ordinance go to the Council as favorable. Motion carried. ORDINANCE AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, IDENTIFIED AS ORDINANCE NO. 4990, ORDINANCE NO. 3702, AS AMENDED, TO THE EXTENT IT IS STILL EFFECTIVE, AND THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, SECTIONS 40 - 1 TO SECTIONS 40 - 43, AS AMENDED, TO THE EXTENT IT IS STILL EFFECTIVE. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Attorney Arthur W. Frisk spoke on behalf of the petitioners, Associates Discount Corporation. He asked that the area be rezoned to commercial for a branch office of the Associates Discount Corp. He pointed out that the area had been approved by the Area Plan Commission for this office building.construction. Councilman Reinke moved, seconded by Councilman Craven, that the Ordinance go to the Council as favorable. Motion carried. `169 COMMITTEE OF THE WHOLE MEETING JANUARY 26, 1970 ORDINANCE AN ORDINANCE PROVIDING FOR TEMPORARY WALKWAYS AROUND CONSTRUCTION PROJECTS AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Reinke made a motion that the Ordinance be amended by substitution. Councilman Wise seconded the motion. Motion carried. Councilman Reinke then read the substituted ordinance in its entirety. Councilman Reinke moved that the public hearing be held on the substituted ordinance on Feb. 9, 1970 and the ordinance be referred back to the Streets, Alleys & Bridges Committee for study, however, he withdrew his motion. Councilman Allen made a motion that the Council portion of the public hearing be held on February 9, 1970 and that the substituted ordinance be referred to the Streets, Alleys, & Bridges Committee for study and brought out of Committee for public hearing.on that date. * *- There being no further business to be considered before the Committee of the Whole, Chairman Grounds entertained a motion to rise and report to the'Council.
