HomeMy WebLinkAbout01-12-70 Council Committee of the Whole Meeting MinutesDEDICATION CEREMONY - COUNTY -CITY BUILDING JANUARY 12, 1970 Time: 7:57 p.m. Council- President Robert O. Laven presided at the dedication ceremonies held preceeding the first regular session of the South Bend Common Council in the City Chambers in the new County - City Building. He said " This first meeting in this new building marks a new period for the city The structure was built for tomorrow and is for you young people who will be using it long after- we are forgotten. We pay you tribute and know you will build a better community." He presented "South Bend All- American" certificates to student representatives of eight City tfigh schools in behalf of the Citizens of the City. They were: David Kaminski, St. Joseph High School; Carol Stockdale, Riley; Brian Stogdill, Adams; Greg Drover, Jackson; Barbara Milon, Central; Kent Zimmerman, LaSalle; Kathy Jackson, Clay, and John Vann, Washington High School. Reverend Russell A. Deitch, pastor of the First Christian Church, 320 South Main Street, South Bend, Indiana gave the invocation. Council- President Laven reviewed the accomplishments of the Council in 1969 and outlined the goals for 1970. They are: 1. To promote lines of communication with all the citizens of South Bend. 2. To enlarge the City in an orderly and well planned manner through annexation. 3. To revise and update local ordinances. This would include building codes, plumb- ing and electrical codes, and local council operating procedures. 4.1 To increase our involvment in our on -going drive to effectively reduce crime in our city. COMMITTEE OF THE WHOLE MEETING JANUARY 12, 1970 5. To increase our involvment in the local problem of drug abuse. 6. To review and analyze the concept of Metropolitan Government as it pertains to the City of South Bend and St. Joseph County with specific emphasis on the Police Department, and the Sanitation Department. 7. To review, analyze and implement proper ordinances for the control of air and water pollution. 8. To review, analyze and implement an equitable retirement program for City employees. 9. To continue to the best of our ability our responsiveness to the needs of a growing community through the use of proper legislation. listed the accomplishments of 1969 as follows: 1. Councilmanic Redistricting 2. Vital Annexations 3. Crime Control 4. An Anti- pornography Bill 5. Action on the Downtown Revitalization Program 6. Start of the Two Municipal Parking Garages. CALL PRESENT Councilmen Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer and Zielinski. ABSENT None. ncil- President Laven entertained a motion to resolve the Council into the Committee of the le on the state of the City to consider the items listed on the agenda for the consideration the Committee of the Whole. Councilman Allen so moved and Councilman Zielinski seconded the ion. Motion carried. The meeting was called to order by Chairman William W. Grounds', ho presided. ' E AN ORDINANCE AMENDING CHAPTER 26, SECTION 26 -13, ORDINANCE NUMBER 1040, SECTION I OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, PRO- HIBITING LOITERING OR PROWLING. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Robert F. Gonderman, Deputy City Attorney explained the Ordinance and answered questions from the various Councilmen. Council - man Zielinski made a motion that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion carried. in AN ORDINANCE PROVIDING FOR TEMPORARY WALKWAYS AROUND CONSTRUCTION PROJECTS AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. City Attorney S. J. Crumpacker stated that South Bend does not have an ordinance to cover this violation. Councilman Reinke said that the Contractors Association of South Bend would like to offer the Council suggestions for the Ordinance. Councilman Reinke made a motion that the Ordinance be sent to the Streets, Alleys, and Bridges Committee and the Ordinance Committee for further study. Councilman Palmer seconded the motion. Councilman Reinke made a motion that the Ordinance also be set for public hearing on January 26, 1970. Councilman Palmer seconded the motion. Motions carried. COMMITTEE OF THE WHOLE JANUARY 12, 1970 ORDINANCE AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, GENERALLY DESCRIBED AS THE FILLMORE ROAD, MAYFLOWER ROAD, PENN CENTRAL, CITY LIMITS ANNEXATION. This being the time heretofore set for public,hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon, however, because the public portion of the hearing was held on Dec. 8, 1969, and due to Council's decision to postpone the remainder of the hearing, only the Council portion of the Committee of the Whole was conducted on this date. This explanation was given to the audience by Chairman of the Committee of the Whole Meeting, Councilman Grounds. Councilman Allen made a motion to amend the Ordinance to exclude the West portion of the tract, between the railroad tracks and Linden Avenue, from the territory proposed for annexation. She said annexation would be a hardship on the residents and installing the city services and street costs would put a strain on the Street Department. City Engineer Taylor stated this was a defici type of annexation but that these are the areas that need the extra care. Councilman Zielinski seconded Councilman Allen's motion. Motion was defeated by a show of hands vote. 3 ayes, (Councilmen Allen, Wise and Zielinski) Councilman Szymkowiak abstained from voting by stating he was not in favor of any annexation in this area. 5 nays, (Councilmen Laven, Reinke, Grounds, Palmer and Craven). Councilman Laven made a motion, seconded by Councilman Reinke, that the Ordinance go to the Council as favorable. Motion carried. 5 ayes, (Councilmen Laven, Reinke, Craven, Grounds and Palmer) 4 nays, (Councilmen Allen, Wise, Zielinski and Szymkowiak) ORDINANCE AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, GENERALLY LYING WEST OF MICHIGAN STREET BETWEEN IRELAND ROAD AND THE BY -PASS. This being the time heretofore set for public hearing on the above Ordinance, g'oponents and opponents were given an opportunity to be heard thereon, Councilman Laven read the following report from the Annexation Committee: To the Common Council of the City of South Bend: Your Committee, The Annexation Committee, to whom was referred "AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, GENERALLY LYING WEST OF MICHIGAN STREET BETWEEN IRELAND ROAD AND THE BY- PASS." respectfully report that they have examined the matter and that in their opinion This area is part of the overall annexation plan of this city, as set forth in the Area Plan Commission study of November, 1966. It is contiguous to the city on two sides. Specific data relating to the area is attached. /s/ Robert 0. Laven Chairman Mr. Roman Kowalski, 802 Birchwood, South Bend, asked if this annexation ordinance complies with the changes made by the State Legislature. City Attorney Crumpacker replied that it does. City Engineer Lloyd Taylor gave the statistical data and physical features of the _area proposed for annexation. It contains 176.9 acres. Mr. Vince Engles, 230 Patterson Dr., South Bend, asked why South Bend was annexing this area. Mr. Engles was one of a group of about 30 Adams High School Civics class attending the meeting. Mr. Taylor explained to the group the reasons for a city annexing territories. Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. motion carried. ORDINANCE AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, WHICH IS COMMONLY DESCRIBED AS LYING NORTH OF KERN ROAD AND EAST OF YORK ROAD. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Laven read a report from the Annexation Committee as follows: To the Common Council of the City of South Bend: Your Committee, The Annexation Committee, to whom was referred "AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, WHICH IS COMMONLY DESCRIBED AS LYING NORTH OF KERN ROAD AND EAST OF YORK ROAD," respectfully report that they have examined the matter and that in their opinion, This is a petitioned annexation by Place & Company of approximately 9 acres adjacent to the present Kensington Farms. This area is to be used in conjunction with the petitioners development project in that area, within the scope of the annexation study of the Area Plan Commission of November, 1966. /s/ Robert 0. Laven Chairman COMMITTEE OF THE WHOLE JANUARY 12, 1970 ORDINANCE (Contd.) North of Kern Rd. and East of York Rd. City Engineer Lloyd Taylor explained the physical features of the proposed area for annexation. He stated that the petition to annex was initiated -by Place & Company. Councilman Reinke made a motion, seconded by Councilman Palmer, that the Ordinance go to the Council as favorable. Motion carried. There being no further business to be considered in the Committee of the Whole, Councilman Ground entertained a motion to rise and report to the Council.
