HomeMy WebLinkAbout10-13-69 Council Meeting MinutesREGULAR MEETING OCTOBER 13, 1969 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers in City Hall on Monday, October 13, 1969, at 10:10 p.m., all.members present. The meeting was called to order by Council - President Robert 0. Laven, who presided. Present: Councilmen Laven, Allen, Craven, Grounds Szymkowiak, Palmer, Reinke, Wise and Zielinski Absent: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of September 22, 1969 meeting of the Council and found them correct. It is our understanding that the original petition for Voluntary Annexation and Rezoning Classifi- cation to which the undersigned were co- signers with Mr. and Mrs. Charles Kovatch, has not proceeded through the various annexation procedures where it would be irrevocable. It is, also, our understanding that with this confirmation, our participation in the original petition is terminated and that the property owned by the undersigned will not be considered a part of the petition. Notice is, therefore, hereby formally given that in respect to property owned by the undersigned, which is part of a previous petition for Voluntary Annexation and Rezoning, the undersigned are no longer desirous of petitioning for said Voluntary Annexation and Rezoning and hereby withdraw their property from consideration of same. Bickel, for the month of September, 1969 was submitted to the Council, each Councilman having received a copy of the report prior to the meeting. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: October 13, 1969 Your Committee of the Whole, to whom was referred "AN ORDINANCE REGULATING THE BURNING OF REFUSE AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF" respectfully report that they have examined the matter and that in their opinion the Ordinance be re- committed to the Ordinance Committee for further study and reported out of the Committee on November 10, 1969." /s/ William W. Xr. �136 REGULAR MEETING OCTOBER 13, 1969 ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, WHICH IS GENERALLY DESCRIBED AS THE LIBERTY HIGHWAY--BY-PASS ANNEXATION. The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that a public hearing be held on October 27, 1969. Councilman Craven seconded the motion. Motion carried. RESOLUTION RESOLUTION NO. 226-69 A RESOLUTION AUTHORIZING LEASE OF;AN UNUSED FIRE STATION TO A.C.T.I.O.N., INC., FOR USE AS OFFICES. WHEREAS, the City of South Bend, being the owner of a vacated fire station premises described in the copy of a lease, attached hereto as hereinafter recited, and has no current use for the premises, and WHEREAS, A.C.T.I.O.N., INC., a non profit corporation and the agency designated to administer the local anti-poverty program, desire to lease said premises for offices again, for October 1, 1969, through September 30, 1970, and WHEREAS, the City of South Bend by virtue of said Lease can obtain in-kind credits toward its contribution to such program as required by the Federal Anti-Poverty Program. NOW, THEREFORE, BE IT RESOLVED BY THE CO I MMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I. Pursuant to the authority set forth in the Acts of the General Assembly for the year 1905, Chapter 129, that certain lease, entered into by and between the A.C.T.I.O.N., INC. and the City of South Bend by and through the Board of Public Works and Safety, and its Mayor, on the 6th day of October, 1969, which lease is attached hereto, marked exhibit "A", and incorpor- ated herein by reference to the same extent as if it were fully recited herein, is hereby approved and confirmed. Isl Fredrick D. Craven Member of the Common Council A public hearing was held at this time on the above Resolution. City Attorney S. J. Crumpacker said this was a renewal of an existing lease. Council President Laven made a motion for the adoption of the resolution. Councilman Grounds seconded the motion. Motion carried. RESOLUTION RESOLUTION NO. 227-69 A RESOLUTION AUTHORIZING LEASE OF AN UNUSED FIRE STATION TO A.C.T.I.O.N., INC., FOR USE AS A NEIGHBORHOOD CENTER. WHEREAS, ,the city'of South Bend, being the owner of a vacated fire station premises described in the copy of a lease, attached hereto as hereinafter recited, and has no current use for the premises, and WHEREAS, A.C.T.I.O.N., INC., a non-profit corporation and the agency designa ted to administer the local anti-poverty program, desire to lease said premises again, for October 1, 1969, through September 30, 1970, for a neighborhood center to provide social service to the residents of the city of South Bend, and WHEREAS, the City of South Bend by virtue of said lease can obtain in-kind credits toward its contribution to such program as required by the Federal Anti-Poverty Program. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I. Motion carried. a] REGULAR MEETING OCTOBER 27, 1969 UNFINISHED BUSINESS - NONE NEW BUSINESS Councilman Raymond Zielinski said he had heard rumors that an Engineering firm is drawing up plans for a Madison Street bridge over the river and he stated that he believed the Olive - Sample Street railroad crossing has higher priority. City Engineer Taylor said the rumors are not true. There being no further business to come before the Council, Councilman Craven made a motion to adjourn. Councilman Allen seconded the motion.
