HomeMy WebLinkAbout10-13-69 Council Committee of the Whole Meeting MinutesV-% COMMITTEE OF THE WHOLE MEETING OCTOBER 13, 1969 �OIvhVIITTEE OF THE WHOLE TWEETING OCTOBER 13, 1969 3e it remembered that the Common Council of the City of South Bend, Indiana met in the Committee Df the Whole in the Council Chambers of City Hall. on Monday, October 13, 1969, at 8:00 p.m., all nembers being present. The invocation was given by Reverend Birt Harris, Good Shepherd Church, South Bend, Indiana. The meeting was called to order by Chairman William W. Grounds. DRDINANCE AN ORDINANCE REGULATING THE BURNING OF REFUSE AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents titi'ere given an opportunity to be heard thereon. Councilmen Szymkowiak and Craven explain ed the purpose of the ordinance would ban the burning of garbage and other materials that cause noxious odors. Mr. MCKean,_;Cleveland Road, South Bend, asked if the Ordinance covered the burning that was taking place on Cleveland. Mr. Taylor, City Engineer reel ed that burning will stop next week at that site, however all this material vaill be burned at rumstown dump in the future. Mr. Roman J. Kowalski, 802 Birchwood St. asked about people who owned commercially -sold indoor incinerators for burning garbage. City Attorney S.J. Crumpacker said this Ordinance applied to all garbage burning. Councilman Allen stated the Ordinance was specifically for eliminating out- door garbage burning in trash cans. Councilman Allen made a motion that the Ordinance be re- committed to the Ordinance Committee for f, study. Councilman Laven seconded the motion. Motion carried. Councilman Laven proposed an amendment to Councilman Allen's motion that the Ordinance be brought out of committee on November 10, 1969. Councilman Craven seconded the motion. motion carried. Councilman Laven made a motion that the Ordinance be re- committed to the Ordinance Committee for further study and reported out of the Committee on November 10, 1969. Councilman Craven seconded the motion. Motion carried. 7 ayes. (Councilman Laven, Craven, Allen, Grounds, Palmer, Wise and Zielinski. 2 nays. (Councilmen Reinke and Szymkowiak) ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO ACCOUNT L -323, "TIRES AND TUBES" IN THE AMOUNT OF $150.00 AND THE TRANSFER OF SAID SUM FROM ACCOUNT L -722, "MOTOR EQUIPIVENT ", IN THE ENGINE- ERING DEPARTMENT, ALL BEING WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance, proponents and ,opponents were given an opportunity to be heard thereon. City Engineer Lloyd Taylor explained that the appropriation was for tires for the seven cars in the Engineering Department. Councilman Allen made a motion that the Ordinance go to the Council as favorable. Councilman Zielinski seconded the motion. Motion carried. LORDINANCE AN ORDINANCE APPROPRIATING $2,000.00 FROM THE GENERAL FUND TO ACCOUNT B -242, "PUBLICATION OF LEGAL NOTICES ", IN THE OFFICE OF CITY CONTROLLER. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. City Controller James A. Bickel stated that this amount will carry the account through the end of the year. Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. Motion carried. ORDINANCE AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, WHICH IS COMMONLY DESCRIBED AS WHITCOMB & KELLER "S APARTMENT COMPLEX. (St. Joseph River & Angela Blvd. Bridge) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Hostetler, South Bend, asked if the City was planningto annex additional land near the Whitcomb & Keller Complex. City Engineer Lloyd Taylor replied "No ". Councilman Wise made a motion that the Ordinance go to the Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. ther ITTEE OF THE WHOLE OCTOBER 13, 1969 ORDINANCE AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, WHICH IS GENERALLY DESCRIBED AS LYING EAST OF LINDEN ROAD, SOUTH OF INWOOD ROAD AND NORTH OF THE SOUTH BEND BY -PASS. 25_ This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. City Engineer, Lloyd Taylor showed transparencies on a screen indicating all annexation boundaries. Councilman Laven announced that there would be no tax moratorium on any of the areas to be annexed. He said the Council had decided against tax moratorium because it is not a correct and proper procedure. He stated that most of the Councilmen were opposed to it. Mr. William J. Wren inquired about annexing LaPorte and Chicago and objected to the annexation of this area. Mr. Wren lives at 59075 Keria, South Bend, Indiana. Mrs. Henry C. Kanzig 22195 Indiana #23. inquired if there was an underlying motive for the annexations, 'such as there was on the holy ing ". Councilman Laven answered No Miss Agnes Rupel, 211 W. Navarre, South Bend, asked what /the proposed zoning of the area West of Linden Road. City Engineer Taylor explained that annexation loses zoning for a period of 60 days -- during this period the Council or an individual can petition for the land to be zoned by the Area Plan Commission, who in turn determine what they feel to be the best zoning of that land. A public hearing is held at that time and the Committee recommends the zoning for that land. Their report is then sent to the Common Council. Miss Rupel asked if the land could be farmed after the annexation. Mr. Taylor replied that it could be farmed if she so desired. Councilman Laven said suburban areas depend on the central city for its economic, social cultural and recreational life, and the heart of the City should be kept healthy by annexations which bring more taxes into the community. Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman Laven seconded the motion. Motion carried. ORDINANCE AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND INDIANA, GENERALLY DESCRIBED AS LYING NORTH OF DOUGLAS ROAD, WEST OF MAPLE ROAD AND SOUTH OF THE NORTHERN INDIANA TOLL ROAD. Councilman Reinke made a motion that the public hearing on this 01�dinance be postponed until October -27, 1969. Councilman Laven seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Laven made a motion to rise and report to the Council. Councilman Reinke seconded the motion. Motion carried.
