The meeting was called to order by President Robert 0. Laven, who presided. anr.r. Onr.r. PRESENT: Councilmen Laven, Allen, Craven, Grounds, Szymkowiak, Wise, Zielinski, Reinke and Palmer. ABSENT: None. REPORT FROM COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of August 11, 1969 meeting of the Council and found them correct. Palmer DPMTMTnMQ Petition to amend Zoning Ordinance West of Miami Hills East of Southmore Heights Attorney: Jack Dunfee We, the undersigned, do hereby respectfully make application and petition the City of South Bend, Indiana to amend the Zoning Ordinance of the City of South Bend, Indiana as herein- after requested, and in support of this application, the following facts are shown: 1. The property sought to be rezoned is located at an inland site bounded on the West by the apartment buildings belonging to the Petitioner, on the East by the West line of Miami Hills Addition to the City of South Bend, on the South by Erskine Park Golf Course, and on the North by the South line of Crestview Addition to the City of South Bend; the access to said parcel being by way of High Street South from Donmoyer Avenue and by Chippewa Avenue West from Miami Street. 2. The property is owned by Southmore Mutual Housing Corp. 3. A legal description of the property is as follows: Commencing at a concrete monument set at the Southwest corner of the Southeast quarter of Section 24, Township 37 North, Range 2 East; thence North 1 degree 56 minutes West along the North -South center line of said Section 24 a distance of 1532.5 feet to a concrete monument; thence North 86 degrees 44 minutes East a distance of 1,400 feet to a concrete monument and to the Place of Beginning; thence South 1 degree 39 minutes East, along the West boundary of Miami Hills Addition to the City of South Bend, Indiana, a distance of 2183 feet, more or less, to a concrete monument set in the Northerly boundary of Erskine Park Municipal Golf Course; thence South 86 degrees 50 minutes West, along the Northerly boundary of the said Golf Course, a distance of 431 feet, more or less; thence North 1 degree 39 minutes West a distance of 1040 feet; thence'North 40 degrees 14 minutes East a distance of 520 feet; thence North 1 degree 39 minutes West a distance of 275 feet; thence North 29 degrees 26 minutes West a distance of 345 feet; thence North 1 degree 39 minutes West a distance of 175 feet; thence North 86 degrees 44 minutes East a distance of 380 feet to the Place of Beginning, containing 19.2 acres, more or less, in St. Joseph County, Indiana. 4. It is desired and requested that the foregoing property be rezoned: From A Residence Use and A Height and Area District To B Residence Use and Height and Area District. 5. It is proposed that the property will be put to the following use and the following buildings will be constructed: (Number of dwelling units if residental) 15 apartment buildings with a total of 300 residential units (20 units per building) and consisting of 45 one bedroom apartments, 180 two- bedroom apartments, 45 three- bedroom apartments and 30 four - bedroom apartments. di REGULAR MEETING AUGUST 25, 1969 REPORT FROM THE CONTROLLER The report of the City Controller for the month of August, 1969 was submitted to the Council, each Councilman having received a copy of the report prior to the meeting. Councilman Zielinski made a motion that the report be accepted as read and placed on file. Councilman Allen seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee, the Committee of the Whole to whom was referred: "AN ORDINANCE APPROPRIATING MONEYS FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE SEVERAL DEPARTMENTS OF THE CITY GOVERN- MENT OF THE CITY OF SOUTH BEND, INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1970, AND ENDING DECEMBER 31, 1970, INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT." Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council favorable as amended. /s/ William W. Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council.favorable as amended. ORDINANCES, THIRD READING ORDINANCE NO. 5098 -69 /s/ William W. ORDINANCES, THIRD READING ORDINANCE NO. 5099 -69 AN ORDINANCE LEVYING TAXES AND FIXING THE RATE OF TAX- ATION FOR THE PURPOSE OF RAISING REVENUE TO MEET THE NECESSARY EXPENSE FOR THE FISCAL YEAR ENDING DECEMBER 31, 1970, AS AMENDED. The Ordinance was given third reading and passed by a roll call vote of 9 ayes, (Councilmen Laven, Allen, Grounds, Zielinski, Palmer, Wise, Reinke, Craven and Szymkowiak. 0 nays. RESOLUTIONS RESOLUTION NO. 218 -69 RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AUGUST 25, 1969 WHEREAS, THE CHICAGO SOUTH SHORE AND SOUTH BEND RAILROAD (hereinafter called the "RAILROAD ") has for many years past operated its trains into the City of South Bend along and over the streets of South Bend, and WHEREAS, the City of South Bend is experiencing population growth and increased vehicular traffic along and upon its streets, and WHEREAS, -said increased vehicular traffic is complicated and made more hazardous by the presence of the RAILROAD'S tracks across and along the streets of South Bend and the opera- tion of the RAILROAD'S trains along said tracks, and WHEREAS, it is the belief and conviction of the COMMON COUNCIL of the City of South Bend that the traffic problems of the City and the congestion upon the streets over which the RAILROAD operates its trains will be improved and lessened by the removal of the tracks and the rail traffic thereon, 232 REGULAR MEETING AUGUST 25, 1969 IRESOLUTIONS(Continued) that City, BE IT, THEREFORE, RESOLVED by the COMMON COUNCIL that it request and hereby does request the RAILROAD terminate its passenger trains at a point nearer the westerly limits of the and BE IT FURTHER RESOLVED that the RAILROAD be requested to remove its.tracks as they now exist in and along LaSalle Street from LaPorte Avenue on the west to the point where said tracks enter the RAILROAD'S coach yard on the east, and back fill the slot created by such removal, and BE IT FURTHER RESOLVED that the RAILROAD be requested to move its coach yard, passenger station and related facilities to a point nearer the westerly limits of the City, and BE IT FURTHER RESOLVED that the COMMON COUNCIL does hereby support the petition of the RAILROAD to the Public Service Commission of Indiana requesting permission and authority to accomplish the aims and objectives of this resolution. COMMON COUNCIL OF THE CITY OF SOUTH BEND /sf Robert 0. Laven President of Common Council Adopted this 26th day of August, 1969 A public hearing was held at this time. Mayor Lloyd Allen and City Attorney Crumpacker announced their support of this resolution. Mayor Allen stated that bus service will probably be provided _ to the new station on the West side of the City near the Bendix Corporation. The resolution will be sent to the Indiana Public Service Commission to support the railroad's petition to abandon its track and relocate the station. Councilman Reinke made a motion that the resolution be 'iaccepted. Councilman Szymkowiak seconded the motion. Motion carried. ] RESOLUTIONS (RESOLUTION NO. 219 -69 RESOLUTION APPROVING APPLICATION FOR PRELIMINARY LOAN FOR LOW -RENT PUBLIC HOUSING. WHEREAS, it is the policy of this locality to eliminate substandard and other inadequate housing, to prevent the spread of slums and blight, and to realize as soon as feasible the goal of a decent home in a suitable living environment for all of its citizens; and WHEREAS, under the provisions of the United States Housing Act of 1937, as amended, the United States of America, Housing Assistance Administration (hereinafter called the "Govern- ment") is authorized to provide financial assistance to local public housing agencies for undertaking and carrying out preliminary planning of low -rent housing projects that will assist in meeting this'goal; and WHEREAS, the Act provides that there shall be local determination of need for low -rent housing to meet needs not being adequately met by private enterprise and that the Government shall not make any contract with a public housing agency for preliminary loans for surveys and planning in respect to any low -rent housing projects unless the governing body of the locality involved has by resolution approved the application of the public housing agency for such pre- liminary loan; and WHEREAS, the Housing Authority of the City of South Authority ") is a public housing agency and is applying to the to cover the costs of surveys and planning in connection with Bend (herein called the "Local Government for a preliminary loan the development of low -rent housing; NOW, THEREFORE, be it resolved by the City Council of the City of South Bend as follows: 1. There exists in the City of South Bend a need for such low -rent housing at rents within the means of low- income families; 2. The application of the Local Authority to the Government for a preliminary loan an amount not to exceed $ 140,000.00 for surveys and planning,in connection with low -rent housing projects of not to exceed approximately 350 dwelling units is hereby approved. /s/ Janet S. Councilman Wise questioned the large amount of the loan. Councilman Reinke said the Area Plan Commission had done much of the work on site selection for the units. Mayor Allen spoke in behalf of the resolution. Councilman Allen made a motion that the Resolution be accepted by the Council. Councilman Grounds seconded the motion. Motion carried. 5 ayes, (Councilmen Laven, Allen, Palmer, Craven and Grounds) 4 nays, (Councilmen Reinke, Szymkowiak, Wise and Zielinski) There being no further business to come before the Council, Councilman Craven made a motion to adjourn.
