HomeMy WebLinkAbout08-11-69 Council Meeting MinutesCOMMITTEE OF THE WHOLE MEETING AUGUST 11,_ 1969 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers of City Hall on Monday, August 11, 1969 at 8 :13 p.m., nine members present, none absent. The invocation was given by Reverend Matt Kafka, St. Adalbert Catholic Church, South Olive Street, South Bend, Indiana. The meeting was called to order by Chairman William W. Grounds, who presided. RDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATION FROM THE GENERAL PARK FUND IN THE AMOUNT OF $25,314.03 TO ACCOUNTS 252, 261, 323, 371, 41, 43, 442, 722 & 726. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. James Seitz, Assistant Superintend- ent of the Park Department, spoke in favor of the Ordinance and explained the need for the appropriation. Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman Craven seconded the.motion. Motion carried. RDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF SOUTH BEND, INDIANA AND E. R. KNAPP & COMPANY,,-ROCHESTER, INDIANA, FOR CONSTRUCTION AND INSTAL- LATION OF GAS MIXING EQUIPMENT MANUFACTURED BY RALPH B. CARTER COMPANY IN THE TOTAL AMOUNT OF $258,385.00. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Water Works Superintendent, John Hunter, explained the function of the equipment to be purchased and installed. He answered various questions from the Councilmen. Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. Motion carried. There being no further business before the Committee of the Whole, Councilman Grounds made a. motion to rise and report to the Council. Councilman Zielinski seconded the motion. Motion carried. REGULAR MEETING AUGUST 11, 1969 REGULAR MEETING Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers in City Hall on Monday, August 11;_1969 at 8 :26 p.m., all members present. The meeting was called to order by Council President Robert 0. Laven, who presided. ROLL CALL PRESENT: Councilmen Laven, Allen, Craven, Grounds Szymkowiak, Wise, Zielinski, Reinke and Palmer. ABSENT: None. IREPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend:' Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of July 28, 1969 meeting of the Council and found them correct. CITIZENS REQUESTS - MISCELLANEOUS MATTERS Mr. John Lawecki, 2115 Glen Street spoke for a group of South Bend residents demanding details of the proposed turnkey public housing project to be built at Ewing Avenue and Grant Streets for low income families. The residents were informed by the Councilmen that there were two public hearings, one at the Area Plan Commission meeting and one at the Common Council, they will be able to attend and express their opinions. Council President Laven told them a petition to annex the 13 -acre tract was filed with the council July 28, 1969 and now is in the council Annexation Committee and under study by the Engineering Department. Later, he said, the petition will be sent to the Area Plan Commission for public hearing and recommendation. I COM14UNICATION This communication from Attorney Joseph A. Roper was withdrawn from the agenda. Councilman Reinke made the motion that the amendment to the original petition be withdrawn and a new petition be redrafted to incorporate both the original petition and the new petition. Councilman Allen seconded the motion. Motion carried. Council President Laven instructed the Clerk to send a letter informing Mr. Roper of the Council's recommendation. COMMITTEE REPORT - ANNEXATION COMMITTEE August 11, 1969 To the Common Council of the City of South Bend: Your Committee The Annexation Committee to whom was referred "A PETITION FOR ANNEXATION AND FOR ZONING CLASSIFICATION." (Midwest Turnkey) Location: Grant & Ewing Streets; Attorney, Robert L. Miller. Respectfully report that they have examined the matter and that in their opinion The Committee recommends that the petition be referred to The Area Plan Commission for zoning recommendation and that said recommendation report be forwarded to the Annexation.Committee, and, also, that a copy of said petition be directed to the Annexation Committee for study. REPORT FROM AREA PLAN COMMISSION July 30, 1969 The Honorable Common Council City of South Bend South Bend, Indiana 46601 Gentlemen: /s/ Fredrick D. Craven Chairman (3516 E. Jefferson Blvd.) The attached petition of Frank Brazeau, et al, was legally advertised under date of July 11 and 18 and given public hearing on July 22, 1969. The following action was taken: After due consideration it was moved, seconded, and carried that the ordinance and site development plan be recommended favorably to the Common Council pro- vided the petitioner revises his site plan to indicate the screening required by the Zoning Ordinance. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE TO PROVIDE FOR THE INDEMNIFICATION OF POLICE OFFICERS. The Ordinance was given.first reading by title and second reading in full. Councilman Grounds made a motion that the Ordinance be set for public hearing on September 8, 1969. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA - 1962, SECTION 40 AS AMENDED AND GENERAL ORDINANCE NO. 4990 -68, AND THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN PARCEL OF LAND. (3516 East Jefferson Blvd.). The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that the Ordinance be returned to the Ordinance Committee for study. Councilman Wise seconded the motion. Motion carried. REGULAR MEETING AUGUST 11, 1969 RESOLUTION RESOLUTION NO. 217 -69 WHEREAS, GOD in his Infinite Wisdom, has called from this life, MR. LLOYD BLOUGH, Husband of Kathryn L. Blough, South Bend City Clerk, WHEREAS, his untimely death has brought much grief and sorrow to his bereaved family and many friends, NOW, THEREFORE, BE IT RESOLVED, that we, the members of the Common Council, hereby extend to Kathryn L. Blough, and to the other members of the family, our sincere sympathy in this their deepest hour of sorrow, and BE IT FURTHER RESOLVED, that a page be set aside in the Council Records of the City of South Bend and this Resolution be copied thereon and a copy be signed by Mayor Lloyd M. Allen Lloyd M. Allen, Mayor South Bend, Indiana The Resolution was unanimously adopted by the Council and placed on file. UNFINISHED BUSINESS Councilman Craven called attention to the issue of trash burning and asked the Council to revive a proposed trash burning control ordinance submitted a year ago by Councilman Szymkowiak. Szymkowiak's proposal would prohibit burning of any trash other than paper and would limit burning to certain hours of the day. Council President Laven asked Craven and Szymkowiak to review the proposed ordinance that has been in Committee since Councilman Szymkowiak presented it a year ago. Councilman Allen asked for a crackdown on "false alarm" fire calls. Councilman Grounds said that since the alarm boxes have been raised the number of "false alarm" calls have been reduced, according to Chief Zura.t. Councilman Allen commented on the lack of communication between the City Recreation Department and a number of residents in South Bend who were quoted as saying in a newspaper article that there aren't enough parks, swimming pools, day care centers, etc. in their area. She said the City does have such recreation for these people in their area and she believes the Director of the Model Cities program in South Bend might be used to get some of these answers to the people. Councilman Szymkowiak announced that a meeting of the Park Board will be held in Newman Center at 8:00 a.m. and a tour of the South Bend parks will be conducted for those attending the meeting. There being no further business to come before the Council, Councilman Craven made a. motion to adjourn. Councilman Allen seconded the motion. Motion carried. Time: 9:15 p.m. ATTEST: TY APPROVED:
