Be it remembered that the Common Council of the City of South Bend, Indiana met in the Committee
of the Whole in the Council Chambers of City Hall on Monday, July 28, 1969, at 8:20 p.m., with
nine members present, none absent. The invocation was given by Reverend Bernard L. White,
St. John Baptist Church, South Bend, Indiana. The meeting was called to order by Chairman
William W. Grounds, who presided.
ORDINANCE
AN ORDINANCE APPROPRIATING THE SUM OF $39,400.00 FROM THE
CUMULATIVE BUILDING AND SINKING SEWER FUND FOR ENGINEERING
SERVICES.
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Andrew A. Toth, 311 S. Eddy, explained
his plan for solving the problem of storm water drainage in the City. His plan was submitted
to the City Engineer, Lloyd Taylor and he replied that the plan was being considered. Councilman
Allen made a motion that the Ordinance be amended to read in the title, second paragraph of
Section I, - CUMULATIVE SEWER BUILDING AND SINKING FUND - . Councilman Zielinski seconded the
motion. Motion Carried. Councilman Reinke made a motion that the Ordinance go to the Council
as favorable, as amended. Councilman Craven seconded the motion. Motion carried.
ORDINANCE
AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE
GENERAL FUND IN THE AMOUNT OF $1,654.00 TO ACCOUNT
C -11, "SERVICES PERSONAL" AND IN THE AMOUNT OF $286.00
TO ACCOUNT C -213, "TRAVELING EXPENSES ", IN THE OFFICE
OF THE CITY CLERK AND ALL BEING WITHIN THE GENERAL FUND.
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Inquiries were made by Miss Virginia
Guthrie, Executive Secretary of the Civic Planning Assoc. as to the reasons more help was needed
in the Clerk's Office. Mrs. Blough stated that an increase in Court work necessitates the
additional clerk. Councilman Reinke agreed that the Clerk should attend the meeting of the
Municipal Clerks in New York because she is an officer of the Organization. Councilman Reinke
made a motion that the Ordinance go to the Council as favorable. Councilman Szymkowiak seconded
the motion. Motion carried.
ORDINANCE
AN ORDINANCE CREATING A "JUNK VEHICLE FUND" AND
DENOMINATING THE BOARD OF PUBLIC WORKS AND SAFETY
AS THE DEPARTMENT OF CITY GOVERNMENT RESPONSIBLE
FOR THE REMOVAL, STORAGE AND DISPOSAL OF ABANDONED
VEHICLES ACCORDING TO THE ABANDONED VEHICLE ACT
ENACTED BY THE 1969 INDIANA GENERAL ASSEMBLY.
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Mr. Lloyd Taylor, City Engineer, and
City Attorney S. J. Crumpacker, explained the Junk Vehicle Ordinance Fund. They explained
that this Ordinance would create a junk vehicle fund and authorize the city to dispose of the
junk cars under a state enabling statute. Owners would be assessed a fee, if they can be found,
for the removal of the cars. The police chief would designate a special policeman to conduct the
program. Councilman Laven made a motion that the Ordinance be amended to read as follows:
"Section III. Whenever the term "officer" is used in the Abandoned Vehicle Act. the Chief of
Police of the City of South Bend, Indiana, is hereby empowered to delegate such duties and powers
as are conferred by said Act upon such officer to special police officers appointed by the Board
of Public Works and Safety pursuant to statute." The present Section III is changed to read
"Section IV." .Councilman Craven seconded the motion. Motion carried. Councilman Wise made a
motion that the Ordinance go to the Council favorable, as amended. Councilman Laven seconded
the motion. 8 ayes (Councilmen Laven, Craven, Wise, Grounds, Zielinski, Reinke, Palmer and
Szymkowiak. 1 nay, (Councilman Allen).
ORDINANCE
AN ORDINANCE FURTHER AMENDING ORDINANCE NO. 3232, AS
AMENDED, COMMONLY KNOWN AS THE COUNCILMANIC DISTRICT
ORDINANCE, BEING SECTION 12 OF CHAPTER 1 OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND.
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Councilman Laven outlined the salient
points of the redistricting ordinance and said it was conceived with the aid of the University
of Notre Dame Professors and Computer Center. Councilman Reinke made a motion that the Ordinance
be recommended to the Council as favorable. Councilman Laven seconded the motion. Motion carried
7 ayes, (Councilmen Laven, Craven, Wise, Grounds, Reinke, Allen and Palmer.) 2 nays, Councilmen
Zielinski and Szymkowiak.

AN ORDINANCE AMENDING ORDINANCE NO. 3232, ADOPTED BY THE
COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, THERE-
AFTER AMENDED AND AS ADOPTED AND CODIFIED OCTOBER 14, 1963,
COMMONLY KNOWN AS THE COUNCILMANIC DISTRICT ORDINANCE OF
THE CITY OF SOUTH BEND.
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Councilman Zielinski explained the

minority plan and said its variations would be even less than that of the majority plan.
Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman
Zielinski seconded the motion. Motion defeated. 2 ayes, (Councilmen Zielinski and Szymkowiak)
7 nays. (Councilmen Palmer, Allen, Reinke, Grounds, Wise, Craven, and Laven).
There being no further business before the Committee of the Whole, Councilman Grounds made a moti
to rise and report to the Council. Councilman Zielinski seconded the motion. Motion carried.
