COMMITTEE OF THE WHOLE MEETING MAY 12, 1969

that the Common Council of the City of South Bend, Indiana met in the Committee
the Council Chambers of City Hall on Monday, May 12, 1969, at 8:05 p.m., all
Councilmen, Laven, Allen, Craven, Grounds, Szymkowiak ,.Wise, Reinke,-'Palmer
The invocation was given by Reverend Jack West, Calvary Temple, 3711 South
South Bend, Indiana.
ORDINANCE
AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND
CERTAIN LAND CONTIGUOUS THERETO.
(StATE ROAD #23, SOUTH BEND AVE. AND
VANESS STREET)
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Mr. Joseph Black, 18461 State Road
#23 objected to the annexation, claiming it has irregular boundaries and that the area already
is congested. Mr. Black was speaking for his mother who owns some property An the area.
Councilman Laven replied that the annexation was recommended favorably by the Area Plan Commissic
and stated that the Council recommended third reading be delayed until May 26, 1969. Councilman
Palmer seconded the recommendation. Recommendation carried.
ORDINANCE
AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF
THE CITY OF SOUTH BEND, IDENTIFIED AS ORDINANCE
NO. 4990, ORDINANCE NO. 3702, AS AMENDED, TO THE
EXTENT IT IS STILL EFFECTIVE, AND THE MUNICIPAL
CODE OF SOUTH BEND, INDIANA, SECTIONS 40 -1 TO
SECTIONS 40 -43, AS AMENDED, TO THE EXTENT IT IS
STILL EFFECTIVE. (LOCATION: MAIN & EWING STREETS)
This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. Attorney Douglas Seeley representing
the petitioners, Lyle Burnside and James Locker spoke in favor of the rezoning of the property
at Main and Ewing Streets for the erection of a Kroger supermarket. He stated that there will
be ample parking and truck dock space and there will be a grassy strip between the sidewalk
and the property line. Councilman Craven said the building of the market on this land will be
a definite improvement to the area, the land now being vacant. Councilman Reinke made a motion
that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion.
Motion carried.

ORDINANCE
AN ORDINANCE AMENDING CHAPTER 25 SECTION 61 OF
THE SOUTH BEND MUNICIPAL CODE RELATING TO
OVERTIME PARKING, AS AMENDED.
MAY 12, 1969
.This being the time heretofore set for public hearing on the above Ordinance, proponents and
opponents were given an opportunity to be heard thereon. City Attorney Shepard J. Crumpacker
explained the new Ordinance and said it clarifies the meter regulations. He said six to eight
tickets a day could accumulate on a car parked in violation by feeding a meter if a car is left
beside a meter in excess of the allowable time period, even though the meter does not show
expired. In addition, it provides that police may have a vehicle towed away after four hours at
one spot and the towing charges and fines assessed of the owner. Capt. Gerald Knepper of the
Traffic Division explained the duties of the meter maids under the new ordinance. Mr. Donald
Finley, 2507 Marquette Blvd. who lives in public housing and said he represents some "400"
poor public housing tenants, objected to the meter ordinance and said it will penalize the poor
who cannot afford parking tickets. Councilman Craven made a motion to amend the Ordinance to
read as follows:
Sectional is changed to read Section 1 -A
Item "a" is changed to read "(1)"
Item "b" is changed to read "(2)"
Item "c" is changed to read "(3)"
Section 2 is changed to read Section B
Section 3 is changed to read Section C
Third line of Section C is to read "this city, for a period of more than four hours shall
be presumed to" (three hours is changed to four hours)
Section 4 is changed to read Section 2
Under Section 1 -A, - under caption (2) delete the phrase "whether or not the meter for such
space indicates that the time for occupying such space has expired; or" and insert at
this point the following phrase: "by depositing in any parking meter any coin for the
purpose of parking beyond the maximum legal parking time, for the
particular parking meter zone, or, otherwise, or
Councilman Allen seconded Councilman Craven's motion. Councilman Craven made a motion that the
Ordinance go to the Council as favorable. Councilman Laven seconded the motion. Motion carried.
There being no further business to come before the Committee of the Whole, Councilman Zielinski
made a motion to adjourn. Councilman Reinke seconded the motion. Motion carried. Time: 8:49 p.
