HomeMy WebLinkAbout04-14-69 Council Committee of the Whole Meeting MinutesCOMMITTEE OF THE WHOLE COMMITTEE OF THE WHOLE MEETING APRIL 14, 1969 4-65 Be it remembered that the Common Council of the City of South Bend, Indiana met in the Committee of the Whole in the Council Chambers of City Hall on Monday, April 14, 1969 at 8:00 p.m., with all members present. The Invocation was given by Reverend Matt Kafka, St. Ada.lbert Church, South Olive Street, South Bend, Indiana. The meeting was called to order by Chairman William W. Grounds. ORDINANCE AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA - 1962, SECTION 40 AS AMENDED AND GENERAL ORDINANCE N0. 4990 -68, AND THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN PARCEL OF LAND. (INTERSECTION MAPLE & DOUGLAS ROADS) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Council President Laven explained to Miss Virginia Guthrie, South Bend Civic Planning Association, that this area was east of Maple Road and it was the only tract (5- acres) of the Hartman sub - division without residential buildings. He also stated the west side of Maple Road was under consideration for annexation. Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman Zielinski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE 4990 (CHAPTER 40 OF MUNICIPAL CODE) OF THE CITY.OF SOUTH BEND, INDIANA (ST. JOSEPH RIVER & ANGELA BLVD. BRIDGE) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Attorney Joseph Helling, 224 W. Jef- ferson Blvd., representing Whitcomb & Keller Builders (petitioners) said.the tract will be developed along with a contiguous 27 acre tract immediately north along the river and which is to be annexed to the city later. He explained the city is now receiving only $400.00 a year in taxes on this property. There will be luxury-apartment houses erected on the site with lagoons arda private entrance from a northward extension of North Shore Blvd. from Angela. Councilman Szymkowiak asked about safety measures being taken around the lagoons - -Mr. Helling said signs will probably be erected denoting no swimming or boating. He also stated measures were taken for safetyyfire equipment will have a 40 ft. turning radius entry and exit. Councilman Laven ask when the project will be completed and Mr. Helling replied "in about three years." Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman Reinke seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND IN THE AMOUNT OF $475.00 TO ACCOUNT M- 252, "REPAIRS OF EQUIPMENT "IN THE AMOUNT OF $375.00 AND TO ACCOUNT M -43, "REPAIR PARTS" IN THE AMOUNT OF $100.00, IN THE BUILDING DEPARTMENT BUDGET AND ALL BEING WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Forrest West, Building Commis- sioner spoke in favor of the Ordinance. Mr. West said his accounts for auto repair are just about depleted as a result of flat tires and transmission repairs of the cars in his department. Questioned by Miss Virginia Guthrie, South Bend Civic Association, and Councilman Allen, Mr. West stated that additional funds are needed to carry him through the 1969 budget year. Miss Guthrie said Mr. West was under - budgeting and suggested that funds be transferred from other accounts in his budget instead of appropriating additional funds. Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. Motion carried. 7 ayes (Councilmen Craven, Grounds Palmer, Reinke, Szymkowiak, Wise, Zielinski) 2 nays (Councilmen Allen, Laven) ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND IN THE AMOUNT OF $3,500.00 TO ACCOUNT B -263 "OTHER CONTRACTUAL SERVICES" IN THE AMOUNT OF $2,000.00 AND TO ACCOUNT B -363, "OTHER OFFICE SUPPLIES" IN THE AMOUNT OF $1,500.00 IN THE OFFICE OF CONTROLLER AND ALL BEING WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the ordinance was City Controller, James A. Bickel, who said space (storage) in the new building is limited and many old records will have to be destroyed or given to the Northern Indiana Historical Society Museum. He said microfilming will start with the minutes of the Board of Public Works and Safety. Councilman Allen suggested that City Hall records be stored in City Hall, which will be vacant after the move to the new complex, or in the ,museum building. Mr. Biclel stated that City Hall will twt be maintained after its abandonment and that records must be kept in the direct custody of city officials. Included in the same ordinance was $1500 for the purchase of bicycle license tags which are renewable every three years and for which funds had not been budgeted. Councilmen Craven and Allen stated they were reluctant to approve this ordinance. Councilmen Palmer made a motion that the Ordinance go to the Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. At this time the Chair was taken by Councilman -at -Large Fred Craven. Councilman Grounds was excused to be absent from the meeting for a short time, _6 COMMITTEE OF THE WHOLE APRIL 14, 1969 COMMITTEE OF THE WHOLE ORDINANCE .» AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF SOUTH BEND, INDIANA, AND WORTHINGTON CORPORATION, HARRISON, NEW JERSEY, FOR THE REPAIR OF A 42MC -1 WORTHINGTON PUMP IN THE SUM OF $5,170.00 This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was John L. Hunter, Superintendent of Utilities. Mr. Hunter said this Ordinance was for tl;Le fir repair on one of three pumps at the Wastewater Plant. The approximate cost for each new pump is around $45,000 Mr. Hunter stated. Councilman Zielinski made a motion that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF THE CITY OF SOUTH BEND, INDIANA, AND CHICAGO PUMP /FMC CORPORATION, CHICAGO, ILLINOIS, FOR THE PURCHASE OF A SEWAGE PUMP IN THE :SUM OF $2,.025.00. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Hunter, Superintendent of Utilities explained that this pump is now two years old and said it would cost about $6,000 to replace the whole unit. Councilman Laven made a motion that the Ordinance go to the Council as favorable. Councilman Zielinski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF THE CITY OF SOUTH BEND, INDIANA, AND DWYER EQUIPMENT COMPANY, SOUTH BEND, INDIANA, FOR THE PURCHASE OF TWO (2) WARNER UTILITY BODIES IN THE AMOUNT OF $3,789.00. This being the time heretofore'set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. John L. Hunter, Superintendent of Utilities spoke in favor of the Ordinance. Councilman Szymkowiak asked how long these units last Mr. Hunter replied " six to eight years" depending on usage. Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman Zielinski seconded the motion. Motion carried. OF THE CITY OF SOUTH AND GENERAL ORDINANCE E,RETO, GENERALLY BY CHANGING THE CERTAIN PARCEL OF This being the time heretofore set for_public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Robert J. DuComb, attorney for the petitioners, Stephen G. Boskey, 1605 Kemble Avenue and other owners, and Arnold Golden, developer said access to the project would be from Riverside Drive and there would be 72 units of four - story luxury apartments on an L- shaped tract along Rose Street and Riverside Drive on the west side of the river.. The petition was to rezone the property to multiple - family residential and height use to permit the erection of the apartment units. Mr. DuComb said the site is now stagnant and undeveloped. Councilman Wise asked if the developers had planned enough parking space and Councilman Laven asked if there was adequate street and traffic lights planned in the area. Mr. DuComb replied that there would not be heavy traffic in the area. Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion carried. There being no further business before the Committee of the Whole, Councilman Allen made a motion to rise and report to the Council. Councilman Reinke seconded the motion.
