The meeting was called to order by President Robert 0. Laven who presided. ROLL CALL Present: Councilmen Allen, Craven, Reinke, Grounds, Szymkowiak Palmer, Zielinski, Laven and Wise. Absent: None 3! REGULAR MEETING FEBRUARY 10, 1969 REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. CITIZENS REQUESTS - MISCELLANEOUS Mrs. Virginia Guthrie commended the Common Council for meeting with the local PTA's in a special session last week to discuss community problems. Councilman Laven said the Council met with interested members of the PTA and'will meet again Tuesday evening, February 25th in the Council Chambers. REPORT FROM AREA PLAN COMMISSION Report on the Airport Industrial Park, Phase II - Zoning 1_ REGULAR MEETING FEBRUARY 10, 1969 January 31, 1969 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached ordinance was originated by the Area Plan Commision and was legally advertised under date of January 11 and 18 and given public hearing on January 21, 1969. The following action was taken: "After due consideration it was moved, seconded and carried that the ordinance be recommended favorably to the Common Council." EXCERPTS FROM THE MINUTES OF THE AREA PLAN COMMISSION MEETING OF JANUARY 21, 1969 A proposed ordinance originated by the Area Plan Commission to zone the following recently annexed land "D" Light Industrial Use and "F" Height and Area District: The East 249 feet of the West one -half of the Southwest one quarter of Section 33, (Airport Industrial Park.) Mr. Kleva indicated that this property was recently annexed to the City and that it is a por- tion of Phase II of the Airport Industrial Park. The zoning property would conform with the zoning on the remainder of the park. It was moved by Mr. Sharp, seconded by Mr. Miller and carried that the ordinance be recom- mended favorably to the Common Council. REPORT OF CITY CONTROLLER A corrected report for the Year 1968 was submitted by City Controller James A. Bickel. The report was accepted as submitted. Mr. Bickel stated that the December report submitted at the January 24th Council meeting was correct as submitted. Councilman Reinke asked Mr. Bickel to explain the account "Track Elevation ". Mr. Bickel explained that it was a tax levy authorized in 1954 at five cents per $100.00 tax valuation and it was intended to build up funds for a new overpass at Olive and Sample Street but was never used. He announced that City Engineer Lloyd Taylor has been working on plans for an overpass. Councilman Laven made a motion to accept the report from the Controller Councilman Craven seconded the motion. Motion Carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATERWORKS OF THE CITY OF SOUTH BEND, INDIANA AND INLAND CHEMICAL CORPORATION, SOUTH BEND, INDIANA, FOR THE PURCHASE OF AN ASSORTMENT OF CHEMICALS FOR USE FROM FEBRUARY7, 1969 TO FEBRUARY 7, 1970 IN THE AMOUNT OF $26,972.50, AS AMENDED. Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council favorable as amended. /s/ William W. REGULAR MEETING ORDINANCES, THIRD READING ORDINANCE NO. 5059 -69' FEBRUARY 10, 1969 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND INLAND CHEMICAL CORPORATION, SOUTH BEND, INDIANA, FOR THE PURCHASE OF AN ASSORTMENT OF CHEMICALS FOR USE FROM FEBRUARY 7, 1969 TO FEBRUARY 7, 1970 IN THE AMOUNT OF $26,972.50, AS AMENDED. The Ordinance was given third reading and passed by a roll call vote 7 ayes, (Councilmen Craven, Grounds, Laven, Palmer, Reinke, Wise and Zielinski) 2 nays,(Councilmen Allen and Szymkowiak) ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AMENDING SECTION 40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, AS AMENDED, ALSO KNOWN AS ORDINANCE NO. 4990 -68, AND THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE (AIRPORT INDUSTRIAL PARK, PHASE II) The ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion that the Ordinance be set for public hearing on February 24, 1969. Councilman Palmer seconded the motion. Motion Carried. The Ordinance was given first reading by title and second reading in full. Councilman Palmer made a motion that the Ordinance be set for public hearing on February 24, 1969. Councilman Grounds seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE APPROPRIATING $2,500.00 FROM THE GENERAL FUND TO ACCOUNT B -725, "OFFICE EQUIPMENT" IN THE OFFICE OF THE CITY CONTROLLER. The Ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion that the Ordinance be set for public hearing on February 24, 1969. Councilman Palmer seconded the motion. Motion carried. 1-42 REGULAR MEETING UNFINISHED BUSINESS FEBRUARY 10, 1969 Councilman Craven asked if there had been anything done about paying Firemen additional pay for holiday work. Councilman Laven stated he had written a letter to the Mayor but had not received a reply yet. Councilman Allen asked that City Attorney Shepa r -d Crumpacker proceed with an ordinance taking care of holiday pay for the firemen and submit it to the Ordinance Committee, Councilman Allen, Chairman of the Urban Redevelopment & Public Housing Committee asked that the councilmanic district maps,upon which councilmen were to mark prospective site; where 600 units of new public housing are to be built, be returned to her before the next Council meet Councilman Laven directed that a letter be sent to Prosecutor William E. Voor commending him for his recent actions against pornography. NEW BUSINESS Councilman Allen noted that her recent public appeal for co- operation to stamp out obscenity has received wide response. The Council agreed at the suggestion of Councilman Szymkowiak, that it should acknowledge the distinction that has been accorded Stanley Covelski, a South Bend resident recently inducted into the Baseball Hall of Fame. He suggested a placque be placed in his honor in the new City- County Building. There being no further business to come before the Council, Councilman Wise made a motion to adjourn.
