HomeMy WebLinkAbout01-27-69 Council Committee of the Whole Meeting MinutesCOMMITTEE OF THE WHOLE MEETING JANUARY 27, 1969 Be it remembered that the Common Council of the City of South Bend, Indiana met in the Committee of the Whole in the Council Chambers of City Hall on Monday, January 27, 1969, at 8 :00 p.m., eight members present, Council- men, Laven, Allen, Craven, Grounds, Szymkowiak, Palmer, Reinke and Zielinski. One member absent, Wise. The invocation was given by Reverend James 0. Banks, Sunnyside Presbyterian Church, South Bend, Indiana. The meeting was called to order by Chairman, William W. Grounds, who presided. ORDINANCE AN ORDINANCE REGULATING THE PRESENCE OF MINORS UNDER THE FULL AGE OF EIGHTEEN (18) YEARS ON PUBLIC STREETS AND OTHER PUBLIC PLACES BETWEEN CERTAIN HOURS, WITH EXCEPTIONS. DEFINING RESPONSIBILITIES OF PARENTS OR GUARDIANS OR OTHER HAVING THE LEGAL CARE AND CUSTODY OF MINORS UNDER THE FULL AGE OF EIGHTEEN (18) YEARS AND PROVIDING FOR PENALTIES AND ARRESTS FOR VIOLATION THEREOF, DESCRIBING CERTAIN PROCEDURES IN THE APPRE- HENSION AND PROCESSING OF SUCH MINORS UNDER THE FULL AGE OF EIGHTEEN (18) YEARS AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AS AMENDED. This being the time heretofore set for public hearing on the obove Ordinance, proponents and opponents were given an opportunity to be heard thereon. Miss Virginia Guthrie, South Bend Civic Planning Association,asked what the purpose of the proposed ordinance was. Council - President Laven stated that this ordinance amended Ordinance No. 4731 -65, Section II, and clarifies the procedure of prosecution. It puts into clearer language, the point that if a juvenile is found to violate the ordinance a second time the parents or guardians are subject to fines of from $25.00 to $300.00. Councilman Allen made a motion that the Ordinance go to the Council as favorable. Councilman Zielinski seconded the motion. Motion carried. s A 4 R � COMMITTEE OF THE WHOLE MEETING JANUARY 27, 1969 ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE 4990 CHAPTER 40 MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. (AN ORDINANCE AFFECTING THE ZONING OF APPROXIMATELY 2.8 ACRES OF LAND, 262.5 FEET EAST AND WEST BY 448 FEET NORTH AND SOUTH LYING APPROXIMATELY 290 FEET FROM THE WEST LINE OF IRONWOOD DRIVE, AND 172 FEET NORTH OF THE NORTH LINE OF EDISON ROAD, IN THE CITY OF SOUTH BEND, INDIANA.) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Joseph T. Helling, attorney for the petitioner. Mrs. Frances H. Buzby, said a 2'h story brick luxury unit will be developed by the Portage,Realty Company.if the apartment house tract is rezoned from single- family resi- dence use to B- residential or multiple - family use. Mr. Arthur James, 18107 Edison, who lives immediately south of the tract, objected and said a co wenant exists on the property deeds which limits the use of the area to single- family dwelling use. Joseph T. Helling stated that such a restriction was once drafted years ago but the subdivision was never filed as a plat therefore the covenant was not in effect. Mrs. Buzby executed a release of the covenant and Mr. Helling displayed a copy of the release, dated Nov. 19, 1963. The Area Planning Commission reached the same conclusion when it conducted a hearing on the zoning and gave it a favorable recommendation for the rezoning. Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND HERSEY- SPARLING METER COMPANY, DEDHAM, MASSACHUSETTS, FOR THE PURCHASE OF AN ASSORTMENT OF WATER METERS FOR USE FROM FEBRUARY7, 1969 TO FEBRUARY 7, 1970 IN THE AMOUNT OF $56,539.40, AS AMENDED. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Allen recommended that the date in Section I be amended to read 20th day of January, 1969 instead of 8th day of January, 1969. Councilman Allen made the motion that said date be changed. Motion was seconded by Councilman Szymkowiak. Motion carried. Councilman Laven made the motion that the Ordinance go to the Council as favorableAs Coundednan Szymkowiak seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND BADGER METER MANU- FACTURING COMPANY, MILWAUKEE, WISCONSIN, FOR THE PURCHASE OF AN ASSORTMENT OF WATER METERS FOR USE FROM FEBRUARY 7,1969 TO FEBRUARY 7, 1970 IN THE AMOUNT OF $7,097.30. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Laven asked how the prices compare with the prices Mr. John Hunter, Superintendent of South Bend Water Works, had last year and years previous. Mr. Hunter replied that prices were lower. Councilman Zielinski made the motion that the ordinance be amended to read in Secti o J 20th, 1969 instead of January 8th, 1969. ORDINANCE AN ORDINANCE APPROVING A.- CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND GAMON /CALMET METER DIVISION, NEWARK, NEW JERSEY, FOR THE PURCHASE OF AN ASSORTMENT OF WATER METERS FOR USE FROM FEBRUARY 7, 1969 TO FEBRUARY 7, 1970 IN THE AMOUNT OF $10,502.20. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Laven made the motion that the contract be amended to read 20th.J- nu-- 1969 nstead of 8th of January, 1969. Councilman Szymkowiak seconded the motion. C 4ielinski made the motion that the Ordinance go to the Council as favorable, Councilman Szymkowiak seconded the motion. Motion carried. as amended. There being no further business before the Committee of the Whole, Councilman Allen made a motion to rise and report to the Council. Councilman Laven seconded the motion. Motion (arried.
