HomeMy WebLinkAbout12-09-68 Council Meeting MinutesREGULAR MEETING DECEMBER 9,1968 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers in City Hall on Monday, December 9, 1968 at 8:13 P.M., seven members present, two members absent, Council- man Palmer and Councilman Reinke. The meeting was called to order by President Robert 0. Laven, who presided. ROLL CALL CITIZENS REQUESTS: None PETITION PETITION TO ANNEX LAND PRESENT: Councilman Laven, Allen, Craven, Grounds, Szymkowiak, Wise and Zielinski. ABSENT: Councilman Palmer and Reinke. TO: THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA The petitioners, JAMES P. LOCKER AND LYLE D. BURNSIDE, respectfully petition that the following described real estate in Clay Township, St. Joseph County, Indiana, to -wit: Part of the S.W. 1/4 of Section 31, Twp. 38N. of the 2nd P.M., St. Joseph County, Indiana, more particularly described as follows: Beginning at a point on the N line of the said S.W. 1/4 of the S.E. 1/4 of Sec. 31, 450.80 ft. E. of the N.W. corner thereof; thence N. 89 054'40 "E. along said N. line a distance of 1127.50 feet to a point; thence S. 34 032'40 "W. a distance of 618.43 ft. to a point; thence N. 55 027'20 "W. a distance of 130.00 ft. to a point; thence S. 34 032'40 "W. a distance of 150.00 ft. to a point; thence S. 55 027'20 "E. a distance of 130.00 ft. to the W'ly line of Indiana State Road No. 23 (Edwardsburg Highway); thence S. 34 °32'40 "W. along said W'ly line of said Highway a dis- tance of 227.35 ft. to a point; thence N. 55 027'20 "W. a distance of 131.55 ft. to a point; thence S. 34 032'40 "W. a distance of 108.30 ft. to a point; thenc N. 00 °06'02 "W. a distance of 201.37 ft. to a point; thence S. 89 54'40 "W. a distance of 374.06 ft. to a point; thence N. 00 001'38 "E. a distance of 659.36 ft. to the point of beginning, be annexed to and declared to be part of the incorporated City of South Bend, Indiana. Petitioners further state that said real estate is contiguous and adjacent to said City of South Bend, and that petitioners are the owners or have such interest in said real estate that qualifies said petitioners to request the annexation thereof. Petitioners further state that they have attached hereto a form of Ordinance-'for the convenience, use and approval of the Common Council of the City of South Bend, Indiana. WHEREFORE, petitioners respectfully request that the Common Council of the City of South Bend, Indiana accept and act favorably upon their said petition, and that the above described real estate be annexed to and declared to be a part of the incorporated Ciey of South Bend, Indiana. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend, Indiana: Your Committee of the Whole to whom was referred "AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION FROM THE REDEVELOPMENT BOND FUND IN THE AMOUNT OF TEN - THOUSAND EIGHT HUNDRED SEVENTY -FIVE ($10,875.00) DOLLARS, FOR PAYMENT OF INTEREST DUE ON THE REDEVELOPMENT BOND ISSUE OF 1968." Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council as favorable. /s/ William W. Grounds . REPORT OF THE CITY CONTROLLER The report of the City Controller for the month of November, 1968, was submitted to the Council; each Council- man having received a copy of the report prior to the meeting. There being no objection, the report was accepted and placed on file. ORDINANCE NO. 5051 -68 AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION FROM THE REDEVELOPMENT BOND FUND IN THE AMOUNT OF TEN THOUSAND EIGHT HUNDRED AND SEVENTY -FIVE (10,875.00) DOLLARS FOR THE PAYMENT OF INTEREST DUE ON THE REDEVELOPMENT BOND ISSUE OF 1968. The Ordinance was given third reading and passed by a roll call vote of 7 ayes, (Councilman Laven, Allen, Craven, Grounds, Szymkowiak, Wise and Zielinski). o nays, 2 absent, (Councilman Palmer, and Reinke) NEW BUSINESS Councilman Walter M. Szymkowiak, raised the issue of crime, asked for more police protection and said: `Housewives live in fear'; Symkowiak asserted that "citizens deserve the right to shop, attend church and walk the streets of South Bend, without being assaulted ". At this point Councilman Laven asked Councilman Craven to chair for him. Council President Robert 0. Laven, displaying the Sunday edition of the Tribune, said: "I'm sickened by all this violence." "City administration leaders ought to get their heads to- gether," Laven referred to what he said was the incongruity of the news in the edition- six stories on physical attacks and robberies of older persons, and then other stories relating to the holiday season. The hiring of additional policemen would be asking "responsible people to pay to combat the acts of the few.' Agreeing that more police are needed,Mr,Laven stressed the need of individual responsibility. "These people doing these acts must realize they cannot force themselves upon society." Councilman Janet S. Allen reiterated that money and jobs are not the answer to the acts committed by these must kids. Human relations committeem stop having meetings and take action on something constructive. The 18 to 19 year olds get money by attacking older citizens. We should in some way arouse citizenry to come up with a "job- mobile" then they have no excuse if offered this opportunity. It is time for Business, Sororities, Chamber of Commerce, etc. to get in the act and assist these kids in necessary training. These offenders need to be influenced to reform.` Councilman Wise remarked that "Policemen are shackled in the courts, by judges, the Supreme Court. We must start at the grassroots and get the citizens involved:k Councilman Craven agreed and point6d out that small groups should assist these kids with training of self respect. Miss Guthrie suggested that the "108 Concerned Women" who voiced their opinion in the "Voice of the People" should be invited by the Council to discuss the issues of offenses by juveniles against residents on the streets. The "concerned women" need to stand up when the juvenile offenders are in court and count them- selves on the side of the law. Councilman Laven further stated that he hoped the Council action shows that they are trying. Councilman Allen discussed the fire alarm ordinance referring to Burns Statutes, in which the ordinance committee has discussed false fire alarms. Burns 2 -520 making the parent responsible. There being no further business to come before the Council, Councilman Craven made a motion to adjourn. Councilman Allen seconded the motion. Motion carried. Time: 8 :47 P.M. ATTEST: APPROVED: City Cl President The regular meeting of the Common Council on December 23, 1968 was cancelled due to the nearness of the Holiday, also, there being no urgent matters to be considered at a Public Meeting.
