SPECIAL MEETING
OCTOBER 7, 1968
Be it remembered that the Common Council of the City of South Bend, Indiana, met in Special Session pursuant to
call of Special Meeting in accordance with law in City Hall on Monday, October 7, 1968, at 8:20 P.M., in the
Council Chambers. The meeting was called to order by Robert 0. Laven, President.
ROLL CALL
PRESENT Councilmen, Laven, Allen, Craven, Reinke, Grounds,
Szymkowiak, Wise, Palmer, and Zielinski.
ABSENT None.
Robert 0. Laven, President, stated that the purpose of the Special Meeting was to conduct a pub9.ic hearing on a
proposed Cumulative Sewer Building and Sinking Fund Ordinance and that said hearing would be conducted by the
Committee of the Whole of the Council.
COMMITTEE OF THE WHOLE MEETING
William W. Grounds, Chairman of the Committee of the Whole, then called the committee to order and announced
that the Committee would conduct a public hearing on the following proposed ordinance, to -wit:
AN ORDINANCE TO CREATE A CUMULATIVE SEWER
BUILDING AND SINKING FUND TO BE KNOWN AND
DESIGNATED AS THE SEWAGE TREATMENT, STORM
SEWER AND DISPOSAL PLANT FUND, AND PROVIDING
FOR A TAX LEVY OF $.25 ANNUALLY FOR A PERIOD
OF TWELVE (12) YEARS, AS AMENDED.
Councilman Robert 0. Laven stated that it was the intent to levy taxes for the fund in 1968, payable in 1969,
and the proposed ordinance should be amended to reflect such intention and another public hearing be held.
Whereupon Councilman William W. Grounds stated that since this was a public hearing on the proposed ordinancce,
anyone present who wished to be heard could speak. No one spoke other than Virginia Guthrie, executive
secretary of the South Bend Civic Planning Association, who said she would withhold comment until the public
hearing on the proposed ordinance as amended. Whereupon Councilman Robert 0. Laven moved that the proposed
ordinance be amended as follows:
SECTION III. The entire section be deleted and the following
be substituted:
"There is hereby levied for each year commencing 1968, payable in
1969, and extending throught 1979, payable in 1980 a tax levy to
be paid into said fund of the sum of $.25 on each One Hundred
($100.00) Dollars of taxable property located within the said City
of South Bend, Indiana."
SECTION IV. On the second line, after the word "the ", delete
"7th" and insert 1121st ".
Councilman Wise seconded the motion. Motion carried. Councilman Laven made a motion the ordinance go to the
Council favorable as amended. Councilman Wise seconded the motion. Motion carried. Councilman Allen made
a motion to rise and report to the Council. Then Councilman Laven seconded the motion. Motion carried.

The meeting of the Common Council then reconvened at 8:28 P.M., Robert 0. Laven presiding.
Your Committee of the Whole to whom was referred "AN ORDINANCE TO CREATE A CUMULATIVE SEWER BUILDING AND
SINKING FUND TO BE KNOWN AND .DESIGNATED AS THE SEWAGE TREATMENT, STORM SEWER AND DISPOSAL PLANT FUND, AND
PROVIDING FOR A TAX LEVY OF $.25 ANNUALLY FOR A PERIOD OF TWELVE (12) YEARS, AS AMENDED ", respectfully re-
port that they have examined the matter and that in their opinion the amended ordinance be amended as follows:
SECTION III. The entire section be deleted and the following
be substituted:
"There is hereby levied for each year commencing 1968 payable in 1969, and
extending through 1979, payable in 1980 a tax levy to be paid into said
fund of the sum of $.25 on each One Hundred ($100.00) Dollars of taxable
property located within the said City of South Bend, Indiana."
SECTION IV. On the second line, after the word "the ", delete
"7th "-and insert "21st ".
There being no objection, the report was accepted as read. Councilman Wise moved the ordinance be amended as
follows:

Councilman Grounds seconded the motion. Motion carried. City Attorney, Arthur W. Frisk suggested a

separate motion be made to set the public hearing. Councilman Grounds made a motion to set the amended Ordinance
for public b:ear.ii1g at a Special Meeting, October 21, 1968 at 8 :00 P.M. Councilman Szymkowiak seconded the
motion. Motion carried.
This concluding the business before the Council, Councilman Palmer made a motion to adjourn. Councilman Wise
seconded the motion. Motion carried. Time: 8:33 P.M.
